Relevant provisions on the overseas settlement of retired cadres

Legal analysis: the short-term vacation of retired personnel and cadres to Hong Kong and Macao, except for special circumstances, generally does not exceed three months; Generally, those who go abroad do not exceed one year. Holidays are counted from the date of departure. The holidays of retired and resigned workers shall be approved by the units that issue retirement fees and retirement living expenses; The leave of retired and resigned cadres shall be approved by the competent department according to the cadre management authority. After the retired cadres leave the country for a short period of time, they will not go through the formalities if they request (including my letter or entrust relatives and friends to handle it on their behalf) to settle abroad and go to Hong Kong and Macao; If you want to go abroad, you should apply to the original work unit or the competent department and go through the relevant formalities according to the regulations. Retirees are generally no longer sent abroad to perform official duties. For a small number of people with special expertise, it is really necessary to be employed or borrowed after retirement, such as going abroad to attend international professional and technical conferences, conducting economic and technological investigations or negotiations, and signing economic, technological and trade contracts. If the situation is special, others can't take the place, and I am in good health and can undertake the task of going abroad, I may, in accordance with the principle of "strictly controlling if necessary", approve the execution abroad as appropriate.

Legal basis: Article 1 of the Notice on Further Strengthening the Administration of party member Cadres Going Abroad on Business further strengthens the administration of going abroad on business.

(1) Strengthen education to nip in the bud. We should conscientiously study and implement Theory of Three Represents, and educate party member cadres abroad on ideals and beliefs, patriotism, national spirit, foreign affairs discipline and security. It is necessary to combine education with management, and adhere to and improve effective practices and systems such as centralized training and conversation reminders for overseas personnel. It is necessary to timely understand and master the ideological trends of people going abroad, find problems, and take measures in advance to nip in the bud.

(2) Strengthen management and strictly control. When party member cadres go abroad on business, they must be examined and approved in strict accordance with the examination and approval authority stipulated in the Regulations on Examination of Persons Going Abroad on Business (the General Office of the Central Committee of the CPC [1991] No.8) and the Supplementary Regulations on Examination of Persons Going Abroad on Business (the General Office of the Central Committee of the CPC [1993] No.23). The relevant provisions of the Opinions on Strengthening the Management of Leading Cadres at or above the County (Division) Level in Party and Government Organs (No.23 [1999]) shall be strictly implemented when party member cadres at or above the county (division) level go abroad for approval.

(three) improve the system, standardize the behavior of party member cadres during going abroad (border) on business. For party member cadres stationed abroad, the sending units should formulate corresponding management measures and regulations. Temporary overseas delegations should set up temporary party branches (party groups); Without the consent of the delegation leaders, members of the delegation shall not act alone; Do not change the tour route without authorization; Shall not extend the time limit outside the country (territory) without authorization; Important information should be reported to the dispatched unit and the Ministry of Foreign Affairs and other relevant departments in a timely manner.
