Visa Guide: About UK Visa Appeal

What does this guide include?

This guide explains who has the right to appeal visa applications or other entry permits and how to appeal.

Who can appeal?

For some types of applications, you have the right to appeal after your visa is rejected. The most common situations are listed below:

? Visit-if you want to visit your immediate family in Britain.

? Children and relatives-settled in Britain.

? Husband, wife, lover or unmarried couple-settled in Britain.

? Students (and their relatives)-have been studying in Britain for more than six months.

? Work permit holders (and their relatives)-working full-time in the UK.

If your visa is refused and you wish to stay in the UK for six months or more, you also have the right to appeal. Immigration officials will tell you that you have the right to appeal and provide you with the required appeal form.

If you appeal?

If rejected, you will receive two documents:

1) visa refusal notice (indicating the reason why the entry visa officer refused to sign you);

2) Notice of Appeal (you must fill in the form and return it to the entry visa officer, stating why you think the entry visa officer refused your visa wrongly).

Is there a time limit for appeal?

Yes You must submit the appeal materials within 28 days after receiving the rejection notice.

How much will it cost?

There is no charge for dismissing the appeal.

Who decides the outcome of the appeal?

In Britain, appeals will be heard by an independent judge.

What happens when you file an appeal?

When the entry visa officer receives your appeal, they will review your application and consider your further comments and any new evidence in the notice of appeal. If the decision can be changed, a visa will be issued. If the entry visa officer cannot change the decision, the result will be determined according to the type of appeal.

The entry visa officer will issue a written document (explaining why he refused your visa or entry), and submit the document and the notice of appeal to the Immigration Appeal Office.

Please note:

All Chinese documents submitted at appeal must be translated into English. Incomplete appeal documents (such as unsigned, wrong date of birth, misspelled name) or lack of English translation will cause unnecessary delay.

Other considerations:

The validity of the appeal is within 28 days from the date you receive the notice of refusal. You should submit your rejection notice together with the AIT-2 appeal form.

The AIT-2 appeal form must be filled in English. In particular, please fill in the form as completely and clearly as possible. Please fill in the mailing address in Chinese and Pinyin. Postal code must be filled in.

The appellant or the appeal agent (if any) must sign the AIT-2 Appeal Form (Item 6). If your AIT-2 appeal form is not signed, it will be returned.

All supporting materials shall be submitted at the same time as the AIT-2 appeal form, and the translated version of Chinese documents shall be submitted in English or at the same time, and the translated version shall be signed by the translator to confirm that the translated content is completely faithful to the original Chinese text.

All supporting materials must be clearly listed in item 7 of the AIT-2 appeal form.

Prepare all auxiliary materials, and be sure to use A4 size paper.

Do not use staples to bind materials, but you can use different needles.

What does the Immigration Asylum Tribunal (AIT) do?

The Immigration Asylum Tribunal (AIT) set up by the British Parliament to solve immigration appeal cases will arrange for your representative in the UK to receive all relevant documents, including the explanatory documents of the entry visa officer. Then, the American Association in Taiwan will arrange an independent judge to hear the case. When handling an appeal, the presiding officer will fully consider the evidence submitted by you (or your representative) and make an independent ruling according to the Immigration Ordinance and the grounds for appeal.

Where can I get independent advice?

You can get appeal advice and help from the Immigration Advisory Service Center (IAS). IAS is a voluntary organization independent of the government, providing you and your representatives with credible advice.

IAS can help applicants decide whether to appeal. The Immigration Bureau may also appeal to the Immigration Appeal Board on behalf of the applicant.
