Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Flood Control Law of People's Republic of China (PRC) and the Flood Control Law of People's Republic of China (PRC) and in combination with the actual situation of this province. Article 2 People's governments at all levels should strengthen unified leadership over flood control work, organize relevant departments and units, mobilize social forces, take measures to strengthen the construction of flood control engineering facilities, consolidate and improve flood control capacity, and do a good job in flood control and flood relief and post-disaster recovery and relief. Article 3 The water administrative department of the people's government at or above the county level shall, under the leadership of the people's government at the corresponding level, be responsible for the daily work of flood control within its administrative area, such as organization, coordination, supervision and guidance.

River basin management institutions set up by the water administrative department of the State Council in important rivers shall exercise their duties of flood control coordination, supervision and management according to law within their jurisdiction; River basin water conservancy management institutions under the water administrative department of the people's governments of provinces and cities (prefectures) shall, upon the entrustment of the water administrative department, exercise relevant flood control duties within their jurisdiction. The local people's governments concerned should strengthen coordination with the river basin management agencies, actively cooperate with them, and do a good job in river basin flood control. Chapter II Flood Control Planning Article 4 Flood control planning is the basic basis for the management of rivers and lakes, the construction of flood control engineering facilities and activities related to flood control safety.

Flood control planning should be incorporated into the overall plan for national economic and social development. The overall land use planning, urban planning and other comprehensive and professional planning involving flood control, and the layout of major construction projects, must consider the safety of flood control, and there are special plans or demonstrations for flood control and waterlogging elimination. Article 5 The compilation and examination and approval of flood control plans for major rivers and lakes and urban flood control plans determined by the state shall be carried out in accordance with the provisions of Article 10 of the Flood Control Law.

Flood control planning of Xiaoqing River, Dagu River, Weihe River, Dawen River, Tuhai River, Ma Jiahe, Dehui New River, Dongyu River, Zhuzhao New River, Yihe River, Shuhe River, Sihe River, Ji Liang Canal and Nansi Lake under the management of this province and flood control planning across the above-mentioned basins shall be compiled by the provincial administrative department in conjunction with relevant departments and relevant cities (prefectures) and submitted to the provincial people's government for approval.

River basin flood control planning of other rivers managed by this province shall be compiled by the water administrative department of the city (prefecture) or county (city, district) where the river is located in accordance with the management authority in conjunction with relevant departments and reported to the people's government at the same level for approval. Inter-city (prefecture) and county (city, district) river basin flood control planning shall be compiled by the water administrative department at the next higher level in conjunction with relevant departments and local people's governments and submitted to the people's government at the same level for approval. Regional flood control planning shall be formulated by the water administrative department at or above the county level in conjunction with relevant departments according to the flood control planning of river basins, and shall be implemented after being approved by the people's government at the same level.

Flood control plans approved by the people's government shall be reported to the water administrative department at the next higher level for the record. Article 6 The overall plan for storm surge prevention in the whole province shall be compiled by the provincial administrative department in conjunction with relevant departments and submitted to the provincial people's government for approval.

The water administrative departments at or above the county level in coastal areas shall, in accordance with the overall plan for storm surge prevention in the whole province, jointly with relevant departments, prepare the storm surge prevention plan for the region, report it to the people's government at the corresponding level for approval, and report it to the water administrative department at the next higher level for the record.

The approved storm surge prevention plan should be incorporated into the flood control plan. Article 7 Land for river regulation planning, land for dike construction planning and land for artificial spillway determined in flood control planning shall be designated as planned reserved areas according to law.

The Yellow River, Zhangweihe River, Hanzhuang Canal, rivers and lakes planning reserved areas listed in the second paragraph of Article 5 of these Measures shall be approved by the state, approved by the provincial land administrative department and the provincial water administrative department jointly with the relevant regions, and reported to the provincial people's government for approval according to the authority prescribed by the State Council, and shall be announced.

Other river planning and protection areas, with the consent of the relevant land administrative departments and water administrative departments, shall be reported to the municipal (prefecture) and county (city, district) people's governments for approval in accordance with the prescribed authority, and shall be announced.

Where the land in the planned reserved area involves land for other projects, the relevant land administrative departments and water administrative departments shall solicit the opinions of the relevant departments when examining and approving. In the planned reserved area, no new construction, reconstruction or expansion of industrial and mining facilities unrelated to flood control and expansion of residential areas shall be allowed; Under special circumstances, if it is really necessary to occupy the land in the planning reserved area mentioned in the preceding paragraph, it shall be submitted for approval in accordance with the basic construction procedures stipulated by the state, and solicit the opinions of the relevant water administrative departments. Chapter III Control and Protection Article 8 The planning and management of the Yellow River and its inter-provincial rivers and sections shall be carried out in accordance with the provisions of Article 19 of the Flood Control Law.

The planning and control of other rivers and river sections shall be formulated by the water administrative department in accordance with the fifth flood control planning authority of these measures and reported to the people's government at the same level for approval. Article 9 The water administrative department at or above the county level and other relevant departments shall, according to the flood control plan, formulate plans for river regulation, waterlogged area control, reservoir reinforcement, dampproof dike construction and urban drainage facilities construction, and organize their implementation after being submitted to the people's government at the same level for approval.

The management and development of estuaries and coastal beaches shall be subject to flood control planning. Article 10 According to the flood control plan, the land needed for river regulation shall be allocated or adjusted by the people's governments at or above the county level in accordance with the relevant provisions of the state.

The newly available land for river regulation belongs to the state, which is arranged and used by the people's governments at or above the county level, giving priority to the construction and management of resettlement and flood control engineering facilities.
