Lao Lai owes money, but what if he doesn't pay back the assets under his name?

If Lao Lai has no property under his name, he should file a lawsuit with the court first. Investigate the real situation of its assets through the court. Find out whether there is a * * * relationship with the debtor when the debt relationship occurs. You can check whether the property under their relatives' names was transferred after the debt relationship. If so, you can apply for enforcement. If the parties cannot be found, it is impossible to investigate all the assets of the debtor. If the company has no executable property under its name and refuses to execute the effective judgment of the court, then negative information such as overdue repayment will be recorded in the personal credit report, restricting high consumption and immigration, and may even be detained by the judicial authorities.

Legal basis: Article 2 of "Several Provisions of the Supreme People's Court Municipality on Publishing the Information of the List of Executed Persons with Dishonesty".

If the person subjected to execution has the circumstances specified in Items 2 to 6 of Article 1 of these Provisions, the time limit for inclusion in the list of persons subjected to execution without trust shall be two years. If the person subjected to execution obstructs or resists execution by means of violence or threats, or if the circumstances are serious or he has repeatedly broken his promise, it may be extended for one to three years.

The people's court may decide to delete the information of dishonesty in advance if the person subjected to execution actively performs the obligations specified in the effective legal documents or actively corrects the act of dishonesty.
