Provisions on the management of fishery resources in the Yangtze River

Chapter I General Principles

Article 1 In order to strengthen the protection, proliferation and rational utilization of fishery resources in the Yangtze River, safeguard the legitimate rights and interests of fishery producers and promote the development of fishery production in the Yangtze River, these Provisions are formulated in accordance with the Fisheries Law of People's Republic of China (PRC), the Wildlife Protection Law of People's Republic of China (PRC) and other relevant laws and regulations.

Article 2 All units and individuals engaged in fishery production or related activities in the mainstream of the Yangtze River and Tongjiang waters must abide by these Provisions.

Article 3 The Yangtze River Fishery Resources Management Committee shall be responsible for the management and coordination of the Yangtze River fishery resources. The office of the Yangtze River Fishery Resources Management Committee (located in the Donghai District Fishery and Fishing Port Supervision and Administration Bureau of the Ministry of Agriculture) is responsible for the daily work.

Chapter II Management and Protection of Fishery Resources

Fourth Yangtze River fishery resources protection objects:

(1) National first-class and second-class protected aquatic wild animals: baiji, Chinese sturgeon, Dan's sturgeon, sturgeon, mullet, Songjiang perch, finless porpoise, giant salamander, Monopterus albus, SINONOVACULA tenuipes and Taiwan Province Hucho.

(2) Fish: shad, eel, carp, herring, grass carp, bighead carp, crucian carp, bream, bream, mullet, pike, Coilia ectenes, and river.

(3) Shrimp and crab: Eriocheir sinensis, white shrimp (white shrimp) and Macrobrachium nipponense (green shrimp).

(4) Shellfish: Hyriopsis cumingii, Hyriopsis plicata, Japanese moth.

(5) Others: Tortoise.

Article 5 The first-class and second-class aquatic wildlife protected by the Yangtze River countries as mentioned in Item (1) of Article 4 shall be protected by the fishery administrative departments at all levels according to the Wildlife Protection Law of People's Republic of China (PRC), the Regulations for the Implementation of Aquatic Wildlife Protection in People's Republic of China (PRC) and other relevant laws and regulations.

Article 4 The minimum fishing standards for protected objects in Items (2), (3), (4) and (5) shall be formulated by the fishery administrative departments of provinces and municipalities directly under the Central Government.

Article 6 It is forbidden to fry and poison fish, electric fish, osprey and otter, and it is forbidden to use harmful fishing gear such as river bow (net), dense mesh net (cloth net, net and cage net), rolling hook, ecstasy and bottom trawl for fishing. Fishing with nets is forbidden at the gate along the river.

Article 7 It is strictly forbidden to catch parent and juvenile shad in the upper reaches of the sea.

From May 15 to August 3 1 day every year, it is forbidden to use double-layer and triple-layer gill nets in the Yangtze River estuary to Jiujiang River. Every June1-July 3 1, the main spawning grounds of shad from Xingan of Ganjiang to Ji 'an River are closed. Fishing is prohibited during the peak period of juvenile fish leaving Poyang Lake in Jiangxi Province and entering the river; No fishing time shall be less than ten days; The specific fishing ban time is determined by the Yangtze River Fishery Resources Management Committee in consultation with the Jiangxi Provincial Fishery Bureau and the Yangtze River Fishery Resources Monitoring Station, and implemented by the Jiangxi Provincial Fishery Bureau. If shad is caught for scientific research, the office of the Yangtze River Fishery Resources Management Committee will issue a special (concession) fishing license and implement quota fishing.

Article 8 The spawning ground of Eriocheir sinensis in the Yangtze Estuary is forbidden to catch spring crabs with eggs, and the fishing of parent crabs, young crabs and crab fry of Eriocheir sinensis is restricted in the main stream of the Yangtze River. Units and individuals that really need to catch parent crabs, young crabs and crab fry due to artificial breeding, reproduction, proliferation and release shall apply to the fishery administrative departments of provinces and municipalities directly under the Central Government. After examination, it shall be reported to the office of the Yangtze River Fishery Resources Management Committee to issue a special (chartered) fishing license to limit the fishing net, fishing time and fishing reach.

The purchase and transportation of young crabs and crab fry in the Yangtze River must have a quasi-purchase permit and a quasi-transportation permit issued by the fishery administration and fishing port supervision and management institutions of provinces and municipalities directly under the Central Government.

Article 9 It is forbidden to catch eel fry entering river waters. Units and individuals that need to catch four seedlings for breeding and scientific research shall apply to the fishery administrative departments of provinces and municipalities directly under the central government. After being audited by the relevant fishery administrative departments and reported to the office of the Yangtze River Fishery Resources Management Committee for approval, the fishery administration and fishing port supervision and management institutions of provinces and municipalities directly under the Central Government will issue special fishing licenses to the four fry. Operation units and individuals shall restrict fishing at designated time and area. Units and individuals that need to catch other economic fish fry for artificial reproduction shall apply to the local fishery administrative department at the county level, and obtain a franchise (concession) fishing license with the approval of the fishery administration and fishing port supervision institutions of provinces and municipalities directly under the Central Government, and limit fishing in the designated fishing area and time.

Article 10 It is forbidden to catch young fish and fry as bait.

Article 11 The Yangtze River Fishery Resources Monitoring Station is responsible for monitoring the main fishery resources and rare aquatic wild animals in the Yangtze River, and regularly reports the monitoring situation to the fishery administration and fishing port supervision and management institutions at all levels along the Yangtze River, so as to provide scientific basis for management.

Article 12 All units and individuals engaged in fishing production in the main stream of the Yangtze River and its Tongjiang waters must apply to the fishery administration and fishing port supervision institutions affiliated to the fishery administrative departments at or above the county level in accordance with the regulations, obtain a fishing license, and pay the protection fee for the proliferation of fishery resources before they can operate. The collection standard of the protection fee for the proliferation of fishery resources in the Yangtze River shall be implemented in accordance with the Measures for the Collection and Use of the Protection Fee for the Proliferation of Fishery Resources in the Provinces and Municipalities along the Yangtze River.

Article 13 In principle, fishing production shall not be operated across provinces or municipalities directly under the Central Government. If it is really necessary to operate across provinces and municipalities directly under the central government, an application shall be made to the fishery administrative department of the province or municipality directly under the central government where the operation is located, and a temporary fishing license shall be obtained, and the fishery resources proliferation protection fee shall be paid before the operation.

Fourteenth fishing vessels shall be under the unified management of the fishery administration and fishing port supervision and management institutions of provinces and municipalities directly under the central government. The construction or transformation of any fishing boat must be approved by the fishery administration and fishing port supervision and management institutions under the fishery administrative departments of provinces and municipalities directly under the central government according to the examination and approval authority, and all provinces and municipalities directly under the central government should control the blind growth of fishing boats.

Chapter III Environmental Protection of Waters

Fifteenth to strengthen the environmental protection of fishery waters, strictly implement the "People's Republic of China (PRC) * * * and China fishery water quality standards" and the relevant provisions of fishery water quality.

Sixteenth fishery environmental monitoring stations at all levels along the Yangtze River are responsible for monitoring the pollution of the main stream of the Yangtze River and its Tongjiang fishery waters and accidents that endanger fishery resources due to pollution. Loss of fishery resources caused by pollution shall be investigated and dealt with by fishery administration and fishing port supervision and management institutions in accordance with relevant laws and regulations.

Seventeenth construction of water conservancy projects, dredging channels, building port anchorage, erecting bridges, sand quarrying, underwater blasting, etc. In fishery waters, the construction unit shall solicit the opinions of the fishery administrative department in advance. If the construction affects fishermen's production and causes losses of fishery resources, the construction unit shall be responsible for compensation and take remedial measures. Anyone who builds a sluice on the migration channel of fish, shrimp and crabs should open the sluice in time to receive seedlings. Reclaiming land from lakes is prohibited. Other important fish, shrimp and crab seed bases, feeding grounds, spawning grounds, wintering grounds and migration routes shall not be reclaimed.

Chapter IV Reward and Punishment

Eighteenth units and individuals that have made remarkable achievements in the implementation of these provisions and the protection of fishery resources in the Yangtze River shall be commended and rewarded by the fishery administrative departments of provinces and municipalities directly under the central government.

Nineteenth in violation of these provisions, the fishery administration and fishing port supervision and management institutions shall be punished in accordance with relevant laws and regulations.

Chapter V Supplementary Provisions

Article 20 The Ministry of Agriculture shall be responsible for the interpretation of these Provisions.

Article 21 These Provisions shall come into force as of the date of promulgation. The original Interim Provisions on the Management of Fishery Resources in the Middle and Lower Reaches of the Yangtze River shall be abolished at the same time.
