Sentencing standards for partnership gambling fraud

The standard sentencing standard for the crime of partnership fraud is that it can only be carried out if the crime reaches more than 3,000 yuan. The sentencing standard is determined by fixed-term imprisonment of less than three years. The "Interpretations of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases of Fraud" stipulates that: the value of defrauding public and private property is between 3,000 yuan and more than 10,000 yuan, between 30,000 yuan and more than 100,000 yuan, and more than 500,000 yuan. shall be determined as "relatively large amount", "huge amount" and "especially huge amount" as stipulated in Article 266 of the Criminal Law.

Anyone who reaches the above amount and has the following circumstances shall be severely punished as appropriate:

(1) Publishing false information by sending text messages, making phone calls, or using the Internet, radio and television, newspapers and magazines, etc. Information and defraud an unspecified majority of people;

(2) Defrauding disaster relief, emergency rescue, flood prevention, special care, poverty alleviation, immigration, relief, and medical money and materials;

(4) Defrauding the disabled, elderly or people who have lost the ability to work out of their property;

(5) Causing suicide or mental disorder of the victim or other serious consequences.

Anyone who opens a casino shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or surveillance, and shall also be fined; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years, and shall also be fined.
