The real estate development departments of the people's governments of cities and counties shall be responsible for the supervision and management of real estate development and business activities within their respective administrative areas.
The departments responsible for land management of the people's governments at or above the county level are responsible for land management related to real estate development and operation. Chapter II Real Estate Development Enterprises Article 5 A real estate development enterprise refers to an enterprise engaged in real estate development and business activities for the purpose of making profits. Article 6 The establishment of a real estate development enterprise shall meet the following conditions:
(a) there are more than eleven full-time technicians in real estate and construction engineering with qualification certificates, more than two full-time accountants and more than one full-time statistician;
(two) to sign labor contracts with professional and technical personnel and pay social insurance premiums;
(3) Other conditions stipulated by laws and administrative regulations. Article 7 The establishment of a real estate development enterprise shall apply to the market supervision and administration department for registration.
The market supervision and management department shall listen to the opinions of the competent department of real estate development at the same level when examining the application for registration of the establishment of real estate development enterprises. Eighth real estate development enterprises to implement the qualification management system. Those who have not obtained the qualification certificate shall not engage in real estate development and business activities.
Real estate development enterprises shall not conceal the real situation and resort to deceit to obtain qualification certificates; The qualification certificate shall not be forged, altered, transferred, leased or lent. Ninth newly established real estate development enterprises shall apply for the issuance of temporary qualification certificates.
The temporary qualification certificate is valid for one year. If the development project is not completed, the validity period may be extended, but the extension period shall not exceed two years.
Real estate development enterprises shall, within 30 days before the expiration of the temporary qualification certificate, submit an application for qualification level verification to the competent department of real estate development; The competent department of real estate development shall verify the corresponding qualification grade according to the development and operation performance of the enterprise. Article 10 A real estate development enterprise shall submit the following documents when applying for qualification grade approval:
(a) the declaration form of qualification grade;
(2) Temporary qualification certificate;
(3) A copy of the business license;
(four) the identity certificate of the legal representative and the qualification certificate and employment contract of professional and technical personnel;
(five) the report on the implementation of the real estate development project manual, residential quality guarantee and residential instruction manual;
(six) the relevant certification materials for the development and operation of the project. Article 11 The qualifications of real estate development enterprises are divided into Grade I qualification, Grade II qualification, Grade III qualification and Grade IV qualification according to enterprise conditions, and undertake real estate development projects of corresponding scale:
(1) The scale of development projects undertaken by first-class qualified real estate development enterprises is not limited;
(two) the construction area of the development project undertaken by the real estate development enterprise with secondary qualification shall not exceed 250,000 square meters;
(3) The construction area of development projects undertaken by real estate development enterprises with Grade III qualification shall not exceed100000 square meters;
(4) The construction area of the development project undertaken by a real estate development enterprise with Grade IV qualification shall not exceed 30,000 square meters.
Real estate development enterprises with provisional qualifications shall undertake development projects of corresponding scale in accordance with the requirements of qualification certificates.
If a real estate development project is developed by stages, its construction area shall be calculated according to the total scale.
Real estate development enterprises shall not undertake development projects.
The qualification grade of real estate development enterprises shall be approved in accordance with the relevant provisions of the state and the autonomous region. Twelfth real estate development enterprise qualification grade approved in accordance with the following provisions:
(a) the first-class qualification, with the consent of the administrative department of construction of the autonomous region, shall be submitted to the administrative department of construction of the State Council for examination and approval in accordance with the relevant provisions;
(two) the examination and approval measures for enterprises with two-level qualifications and below shall be formulated by the administrative department of construction of the people's government of the autonomous region. Thirteenth real estate development enterprise division, merger, change of name, address, legal representative, should be within 30 days after the change of business license, to the original qualification examination and approval department for change procedures.
If a real estate development enterprise terminates its business activities, it shall cancel its qualification certificate with the original qualification examination and approval department.
