New regulations on stay and permission in Macao

Chapter I General Provisions

First goal

The administrative regulations supplement the laws that stipulate the general principles of the entry, stay and residence permit system; This law is hereinafter referred to as "the law of principle".

Article 2 Composition of family groups

1. In order to apply the provisions of this administrative regulation, family groups, especially those of residents, applicants or foreign workers with special qualifications, include:

(1) spouse;

(2) A person who has a de facto marriage relationship and meets the conditions mentioned in Article 1472 of the Civil Code;

(3) The first-degree lineal blood relatives of himself and his spouse;

(four) I and my spouse's minor lineal relatives and adopted minors.

Two, under special circumstances, other minors or blood relatives confirmed by the applicant can also be regarded as family members.

Chapter II Entry into and Exit from the Macao Special Administrative Region

Article 3 Entry-exit administration

1. The Exit-Entry Department of the Macao Special Administrative Region (hereinafter referred to as the Exit-Entry Department) is responsible for the exit-entry administration, and it is conducted in the following ways:

(a) computer records of residents' entry and exit;

(2) Making computer records on the entry and exit of non-local residents, and making records on the relevant passports or travel documents or other documents deemed appropriate, indicating the period of stay allowed in accordance with the provisions of this administrative regulation.

Article 4 Transshipment, Transshipment or Transit

If no border record is made and no entry permit is issued, passengers who are in the Macao International Airport, at any entry-exit station, or transported, transshipped, transited or transited from one entry-exit station to another by the authorities shall not be regarded as entering the Macao Special Administrative Region.

Article 5 Certificates

1. Except as stipulated in the following paragraph, only people with valid passports can enter and leave the Macao Special Administrative Region.

2. The following persons may enter or leave the Macao Special Administrative Region without passports:

(1) Holding a Macao resident identity card or a travel document issued by the competent department of the Macao Special Administrative Region;

(two) holding a one-way or two-way permit or other travel documents issued by the relevant authorities in People's Republic of China (PRC);

(3) holders of Hong Kong permanent identity cards or re-entry permits;

(4) Holders of seamen's identity cards referred to in ILO Convention No.200 1. 1May 95813rd108;

(5) 19441The holder of the flight license referred to in Annex I to the Convention on International Civil Aviation on February 7th or the crew certificate referred to in Annex IX, but only when performing work;

(6) nationals or residents of the countries concerned who have reached an agreement with the Macao Special Administrative Region on entry and exit without passports;

(7) Holding other valid travel documents;

(8) Other certificates held according to laws or international treaties applicable to the Macao Special Administrative Region;

(9) Persons who hold the travel documents mentioned in Article 28 of the Convention on the Status of Refugees of July 28th, 2008 1 951as amended by the Protocol of 19671March 3rd.

3. Holders of the certificates referred to in items (2) to (8) of the preceding paragraph may enter the Macao Special Administrative Region only if these certificates allow them to return or enter any country or region.

Four, one-way permit holders and travel document holders who are only allowed to enter or return to the Macao Special Administrative Region, if their permanent resident status has been confirmed in advance or have a residence permit, can be exempted from meeting the conditions stipulated in the preceding paragraph.

Five, in special circumstances with appropriate reasons, others may also be exempted from complying with the conditions listed in the third paragraph.

6. Under the circumstances mentioned in the fourth and fifth paragraphs, those who intend to enter the Macao Special Administrative Region, except those who hold one-way permits, must hold the pre-approval for entering the Macao Special Administrative Region.

Article 6 Immunity and refusal

1. The following persons are exempt from the formalities stipulated in Article 3 of the principled law:

(a) Persons mentioned in international treaties that provide for exemptions from the above-mentioned procedures;

(2) Holders of certificates referred to in items (1) to (6) and (4) of the second paragraph of the preceding article;

(3) Holders of Hong Kong identity cards;

(four) passport holders issued by the relevant departments of People's Republic of China (PRC);

(5) granting exemptions or permits to persons referred to in Article 8;

(6) Holding a valid special stay permit or a non-local worker's identity card; *

(7) Holding identity documents issued by the Hong Kong Special Administrative Region to diplomatic or consular personnel;

(8) those who intend to enter the Macao Special Administrative Region for no more than 48 hours in order to transfer to other destinations, but must use the Macao International Airport;

(9) A person who has obtained a residence permit in the Macao Special Administrative Region.

2. The entry permit or visa of the party concerned may be refused for any reason stipulated in Article 4 of the principled law.

Article 7 Entry permit and residence permit

1. To enter the Macao Special Administrative Region, the parties concerned or their agents must fill in the documents in Form 1 and apply to the Chief Executive through the Immigration Department.

Two, the application, the application can include the applicant's family members.

3. The entry permit issued according to the documents in Form II must be used within 120 days from the date of issuance, otherwise, the entry permit will be invalid; The entry permit allows the holder to stay in the Macao Special Administrative Region within the period specified in the permit.

4. The Immigration Department may grant entry permit and stay permit for up to 30 days to those who intend to enter the Macao Special Administrative Region but do not have the entry permit or visa referred to in the above paragraphs.

5. The Chief Executive may order that certain persons or groups, nationals or residents of a certain country or region shall not be granted the permission mentioned in the preceding paragraph, provided that they have obtained an entry visa in advance.

Outside the eighth regulation

The Chief Executive was ordered to:

(1) Allow nationals or residents of any country or region to enter the Macao Special Administrative Region without a visa;

(2) Under special circumstances with proper reasons, people who do not meet the legal conditions for entry or stay are allowed to enter and stay in the Macao Special Administrative Region.

Chapter III Conditions for Staying in the Macao Special Administrative Region

Article 9 restrictions

1. The longest stay in the Macao Special Administrative Region can only be 30 days before the expiration of the passport or any documents mentioned in Article 5, paragraph 2 (3) to (9) and the relevant return or entry permit.

Second, the provisions of the preceding paragraph:

(a) does not apply to holders of Macao resident identity cards or travel documents issued by the competent authorities of the Macao Special Administrative Region;

(2) It does not apply to the passport holder referred to in Item (2) of Paragraph 2 of Article 5;

(3) Under exceptional circumstances, it is not applicable to persons who intend to transfer via Macao to other destinations for a short stay and guarantee to enter or return to any country or region.

Article 10 special stay period

1. Anyone who holds any documents referred to in Item (3) of Paragraph 2 of Article 5 may stay in the Macao Special Administrative Region for no more than one year.

2. Anyone who holds the documents referred to in Item (4) of Paragraph 2 of Article 5 may stay in the Macao Special Administrative Region during the period when the ship concerned calls at the Macao Special Administrative Region.

3. Holders of the documents referred to in Item (5) of Paragraph 2 of Article 5 may stay in the Macao Special Administrative Region during the flight interval between two planes on official business.

4. Nationals of member states who hold passports issued by member states of the European Union or Schengen Agreement may stay in the Macao Special Administrative Region for up to 90 days.

5. Nationals or residents of countries or regions that have reached mutual visa exemption agreements with the Macao Special Administrative Region may stay in the Macao Special Administrative Region for the maximum period stipulated in the relevant agreements.

6. Holders of two-way permits issued by the relevant authorities in People's Republic of China (PRC) may stay in the Macao Special Administrative Region for up to 90 days within the time limit specified in the relevant endorsement.

Article 1 1 Extension of stay permit

1. The residence permit of the Macao Special Administrative Region may be extended once or more, but the longest extension period is 90 days.

Second, the authority to extend the residence permit belongs to the highest person in charge of the entry-exit department; Applicants must submit an application with reasons to the Immigration Bureau at least five days before the residence permit expires.

Extension outside Regulation 12

1. Under special circumstances, the Chief Executive may grant an extension of the period of stay permitted under the preceding article.

2. To apply for extension of stay, you should fill in the application form in Form 3 and explain the reasons, and apply to the entry-exit affairs office at the latest 10 days before the expiration of the validity period of the residence permit held by the applicant.

Article 13 Rejection of application

At first, the Immigration Department may not accept any application submitted beyond the time limit stipulated in the above two articles, or any application with obvious lack of reasons.

Chapter IV Residence Permit

Article 14 Application for residence permit

1. An application for residence permit must be made to the Chief Executive, and an application form in Form 4 should be filled in, signed by the person concerned or his agent, and then submitted to the Immigration Department.

Two, the application shall specify the activities that the applicant is engaged in or intends to engage in in the Macao Special Administrative Region, and explain the reasons for the application.

Three, the application can include the applicant's family members.

Article 15 documents

The application for residence permit shall be accompanied by the following documents:

(1) Attach the passport, travel document or identification document held by the applicant as appropriate;

(2) A China citizen who was born in China but does not live in the mainland of China must attach a certificate issued by the relevant authorities of the country or region where the applicant is located, proving that the applicant has lived in the mainland of China for two consecutive years before applying;

(3) A certificate of no criminal record in the Macao Special Administrative Region, and a certificate of no criminal record issued by the relevant competent department of the country or region where the applicant recently lived or a document of the same nature;

(four) the birth narrative certificate of each applicant or a document of the same nature;

(5) documents proving that the applicant has the ability to earn a living; If there are family members, documents proving that their family members have the ability to earn a living;

(6) A statement of the applicant's honorary commitment to abide by the laws of the Macao Special Administrative Region;

(7) Six photos of each person mentioned in the application.

2. The certificate referred to in Item (2) of the preceding paragraph consists of a residence certificate issued by the competent department of the country or region where the applicant lives or a document with the same effect, which can be divided into two or more certificates according to the number of countries or regions where he lives.

Three, in the case of family reunion or application for beneficiary family members, it is still necessary to prove the kinship with the applicant by documents; If he has reached the age of 16, a certificate of no criminal record shall be attached in accordance with the provisions of item (3) of the first paragraph.

Article 16 Rejection of application

If the applicant or his family members do not meet the conditions listed in the first paragraph of Article 9, the Immigration Department will refuse to accept all or part of the application as appropriate.

Article 17 Exemption of documents

Under special circumstances, the submission of any documents mentioned in Article 15 may be exempted by submitting an application with proper reasons.

Article 18 Guarantee

1. Anyone who intends to obtain a residence permit must use the documents in Form 5 to provide an appropriate guarantor to guarantee his departure expenses. The guarantor must be a permanent resident who usually lives in the Macao Special Administrative Region.

Two, the guarantor referred to in the preceding paragraph, can be replaced by bank guarantee or other guarantees.

Article 19 Residence permit for China citizens

1. Holders of the documents referred to in Article 10, paragraph 3, of the Basic Law shall apply to the entry-exit administration for residence permit in Form 6 within 10 days from the date of their entry into the Macao Special Administrative Region.

Two, after the expiration of the period referred to in the preceding paragraph, you can still apply for the relevant license by paying the fine stipulated in Article 34 of this administrative regulation.

Three, during the review of the relevant files, the Immigration Bureau may require the submission of any documents referred to in article fifteenth.

Four, in the issuance of residence permits, in particular, should consider the provisions of the "principle law" of the ninth paragraph (a).

Five, according to the above provisions were issued residence permits, Macao resident identity cards issued by the competent authorities of the Macao Special Administrative Region.

Six, in order to form a file issued by the Macao resident identity card, the entry-exit department shall issue a residence certificate, and send the certified copy of the certificate, together with the copy of the document referred to in the first paragraph, to the competent department of the Macao Special Administrative Region.

Seven, the certificate referred to in the preceding paragraph within ninety days after the issuance of Macao resident identity card, residence permit shall be invalid.

Article 20 Residence permit for Portuguese citizens

1. Portuguese citizens who intend to stay in the Macao Special Administrative Region should submit an application in Form 4 to the Immigration Department in order to apply for a residence permit.

2. The provisions of paragraphs 3 and 4, as well as paragraphs 5, 6 and 7, shall be applied after necessary coordination.

Article 21 Minors born outside the Macao Special Administrative Region

1. Permanent residents referred to in paragraph 3 of Article 10 of the Basic Law and minor children of certificate holders who were born outside the Macao Special Administrative Region and obtained residence permits in accordance with the provisions of Article 14 shall go through the formalities stipulated in paragraph 6 of Article 19 with necessary cooperation.

Two, the residence permit issued to minors referred to in the preceding paragraph does not need to be extended according to the provisions of the following article.

Article 22 Extension of residence permit

1. The validity period of the residence permit is one year in principle, except for the residence permit issued in accordance with Article 19; Upon the application of the interested party or his agent, the residence permit can be extended for two years at a time, and the relevant application shall be submitted before the expiration of the validity period.

Second, the extension of the residence permit depends on whether it meets the premise and elements stipulated by laws and administrative regulations.

Article 23 Overdue renewal

1. After the residence permit expires, the interested party may still apply for renewal within 180 days after paying the fine stipulated in Article 36 of this administrative regulation.

Second, the extension depends on the submission of a reasonable application and proof that the corresponding fine has been paid.

Three, did not apply for renewal within the time limit stipulated in the first paragraph, the residence permit is invalid, and the continuous time of obtaining permanent resident status is lost; However, it can be properly proved that the application for renewal has not been made due to force majeure.

Article 24 Failure

The residence permit will be invalid for the following reasons:

(a) no longer meet any preconditions or requirements for applying for a residence permit;

(two) according to the principle of the law and the provisions of this administrative regulation, it is impossible to maintain the license, especially if the parties do not usually live in the Macao Special Administrative Region.

Article 25 the issuance of certificates

1. The entry-exit department issues the certificate in Form 7 to those who have obtained the residence permit according to the above provisions (excluding Articles 19 and 20). The voucher is valid for 60 days, so that the person can use the voucher to apply for the issuance of Macao resident identity cards according to relevant laws.

Two, each renewal of residence permit, issue the same certificate.

Three, the documents referred to in the preceding two paragraphs contain fingerprints and photos of interested parties, only for identification purposes.

Article 26 Minors under the age of five

For minors under the age of five, the procedures specified in the above article can only be applied when applying for the issuance of Macao resident identity cards.

Chapter V Change of Address and Permit to Return to China

Article 27 Change of address

If a holder of a residence permit changes his address, he shall notify the Immigration Bureau within 30 days from the date of change.

Article 28 Entry Permit Certificate

1. Residents who leave the country for other countries or regions for a short period of time may apply to the Immigration Department for a re-entry permit issued according to the documents in Form 8 if they need to confirm with the authorities of that country or region that they are allowed to return to the Macao Special Administrative Region.

Two, the validity of the permanent residents' Home Visit Permit is generally one year, but under special circumstances, the validity period can reach five years after application and explanation.

3. The validity period of the re-entry permit issued to non-permanent residents may be equal to the validity period of their residence permit, but the longest period shall not exceed two years.

4. The validity of the Re-entry Permit can only be extended under special circumstances with proper reasons.

5. The exceptional extension of the validity of the re-entry permit shall not be used as a reason for failing to extend the residence permit in time within the statutory time limit under any circumstances.

Chapter VI Expenses, Illegal Acts and Fines

Twenty-ninth fees payable for residence permit.

1. The residence permit can only take effect after paying a fee of MOP 20,000.00. In case of fee exemption, it will take effect from the date when the exemption decision is made.

Two, the following persons are exempt from the fees stipulated in the first paragraph:

(1) China citizens;

(2) Portuguese citizens;

(3) Family members of residents of the Macao Special Administrative Region referred to in Article 2;

(four) the person who is exempted from this fee in the international treaty;

(five) the external staff of the public administration of the Macao Special Administrative Region, or the external staff who have provided services for enterprises that have been licensed for public works or public services;

(6) The buyer of the real estate in the Macao Special Administrative Region or the buyer by appointment, provided that the buyer by appointment must prove that the contract has been fulfilled within 180 days from the relevant fee payment period.

3. If the residence permit benefits other family members other than the family members of the interested party mentioned in Article 2, the fees payable by the applicant shall be doubled.

Four, under special circumstances with appropriate reasons, other interested parties except those specified in the above paragraphs may also be exempted from paying the relevant fees.

Article 30 Time limit and expiration

1. The fees specified in the preceding article shall be paid within 20 days from the date of notification of the residence permit.

Two, except for force majeure, the period referred to in the preceding paragraph shall not be extended; If the relevant fees are not paid, the residence permit will be invalid and the applicant may not apply for a permit again within two years. Even if an application is filed, the entry-exit administration will refuse to accept it.

Thirty-first expenses caused by other acts.

1. Acts related to entry, stay and residence permit shall be charged according to the following proportion on the basis of the fees stipulated in Article 29:

(1) A fee of 0.5% shall be charged for issuing the entry permit referred to in Article 7 of these Administrative Regulations;

(2) A fee of 0.5% shall be charged for issuing the vouchers referred to in Article 25;

(3) A fee of 65,438+0% will be charged for the replacement of the vouchers mentioned in Article 25, but only 0.25% will be charged for the failure, loss or damage that can be reasonably explained;

(4) A fee of 0.5% shall be charged for issuing the entry permit referred to in Article 28.

Two, issued to the family passport entry permit for more than one person, the fee should be charged at twice the fee set in the preceding paragraph (a).

Three, according to the relevant international treaties, according to the provisions of the treaty does not apply to the provisions of the first paragraph (a).

4. If an entry permit is issued to minors under the age of 12, or to a team of more than 10 people organized by the same tour operator, the fee charged to each person shall be reduced to 50% of the fee specified in Item (1) of Paragraph 1.

Five, the official visit to the Macao Special Administrative Region, or organized cultural, religious, sports exchanges or other similar exchange activities, such as special and reasonable circumstances, the first paragraph (a) of the provisions of the fee can also be reduced, the maximum reduction of 50%.

Article 32 overstaying

1. Those who stay in the Macao Special Administrative Region for more than the permitted period of stay shall be fined 0. 1% of the expenses stipulated in Article 29 of this administrative regulation, and the overstay shall be limited to 30 days; The fine must be paid immediately after the criminal is detained or surrenders himself.

2. Those who fail to make their overstaying conform to the standards in accordance with the provisions of the preceding paragraph and during the preceding paragraph shall be regarded as illegal immigrants, and shall not apply for residence permit, extension of residence permit or residence permit for foreign workers within two years. Even if they do this, the Immigration Department will refuse to accept them.

Thirty-third did not make a notice of change of address.

1. Failure to notify the change of address in accordance with Article 27 may result in a fine of 5% of the fee stipulated in Article 29.

Two, is a recidivist, the amount of fines prescribed in the preceding paragraph increased to two times.

Three, recidivism refers to the same illegal act within one year from the date of the last illegal act.

Article 34 I didn't go to the immigration office.

1. Those who violate the provisions of the first paragraph of Article 19 of this administrative regulation will be fined 65,438+0% of the fees stipulated in Article 29 for each day beyond the time limit for applying for residence permit, but the upper limit is MOP 5,000.00.

Two, only after it is proved that the fine referred to in the preceding paragraph has been paid, can the overdue application for residence permit be reviewed.

Article 35 transporting passengers who are not allowed to enter the country

When an airline transports passengers or crew members who are not allowed to enter the Macao Special Administrative Region according to law, regardless of whether the passengers or crew members are allowed to enter Macao later, a fine of MOP 65,438+00,000.00 will be imposed on each passenger or crew member who is not allowed to enter Macao, unless it is proved that the airline cannot be reasonably required to know the situation of the passengers or crew members concerned under certain circumstances.

Article 36 Extension of residence permit

Those who apply for residence permit within the time limit shall be fined 0. 1% of the fee stipulated in Article 29 of this administrative regulation for each day overdue.

Article 37 the authority of fines

1. In addition to the system stipulated in the following article, the highest person in charge of the entry-exit department has the right to impose the fines stipulated in this administrative regulation.

Second, in order to apply the provisions of the preceding paragraph, if any unit finds any illegal act, it shall notify the entry-exit affairs department so as to prepare relevant records.

Article 38 Payment of expenses

1. If anyone is found overstaying when leaving the Macao Special Administrative Region, the person in charge of the entry-exit department on duty will be fined, and the fine will be paid immediately.

2. If the offender fails to pay the fine referred to in the preceding paragraph automatically, the Chief Executive may instruct him to be prohibited from entering the Macao Special Administrative Region for at least 180 days.

Three, other fines should be paid within ten days from the date of the relevant notice.

4. If the actor fails to pay the relevant fines automatically according to the provisions of the preceding paragraph, he shall submit the relevant transcripts with the nominal effect of execution to the court with jurisdiction for compulsory collection.

Chapter VII Final Clauses

Article 39 Forms

For the forms in the formats 1, 3, 4, 5, 6 and 9 specified in this administrative regulation, those who are interested in obtaining them can download them from the official website of the security forces according to the regulations to be formulated soon.

Article 40 Supplementary formats

In application forms 1, 3, 4 and 6, if the applicant's family members should be included, the documents in Form 9 should be attached.

Article 41 Approval of format

The format prescribed in this administrative regulation shall be approved by the Chief Executive.
