Article 2 These Measures shall apply to flood control and flood control-related activities within the administrative area of this province.

Article 4 People's governments at all levels should strengthen unified leadership over flood control work, organize relevant departments and units, mobilize social forces, rely on scientific and technological progress, adhere to the combination of flood control engineering measures and non-engineering measures, strengthen the construction and management of flood control engineering facilities, strengthen the construction of hydrological, meteorological and communication facilities, and do a good job in flood control, flood fighting and post-disaster recovery and relief.

Article 5 The water administrative department of the people's government at or above the county level (hereinafter referred to as the water administrative department), under the leadership of the people's government at the corresponding level, is responsible for the daily work of flood control within its administrative area, such as organization, coordination, supervision and guidance.

Other relevant departments of the people's governments at or above the county level shall, under the leadership of the people's governments at the corresponding levels, be responsible for relevant flood control work according to their respective responsibilities.

Article 6 All units and individuals have the obligation to protect flood control engineering facilities and participate in flood control and flood fighting according to law, and have the right to stop and report illegal acts that hinder flood control.

Seventh people's governments at all levels or relevant departments shall commend and reward units and individuals that have made remarkable achievements in flood control work.

Chapter II Flood Control Planning

Eighth flood control planning is the basic basis for the management of rivers and lakes and the construction of flood control facilities.

Flood control planning shall be based on comprehensive river basin planning and regional comprehensive planning, and shall be prepared in accordance with the following provisions:

(a) the flood control planning of the Yangtze River and other inter-provincial rivers within the administrative area of this province shall be implemented in accordance with the provisions of Article 10 of the Flood Control Law.

(II) Flood control planning for Poyang Lake, Ganjiang River, Fuhe River, Xinjiang River, Raohe River and Hexiu River shall be compiled by the provincial water administrative department jointly with relevant departments and the municipal people's government with districts, and submitted to the provincial people's government for approval.

(3) Flood control plans for rivers, lakes and municipal boundary rivers in other cities divided into districts shall be compiled by the provincial water administrative department, the municipal water administrative department divided into districts and the people's governments of relevant departments and counties (cities, districts), and submitted to the provincial people's government for approval after being examined and put forward by the municipal people's government divided into districts.

(4) Flood control planning for rivers, lakes and border rivers across counties (cities, districts) shall be formulated by the municipal water administrative department with districts in conjunction with relevant departments and the people's governments of counties (cities, districts) and submitted to the municipal people's government with districts for approval.

(5) Flood control plans for other rivers and lakes shall be formulated by the water administrative department of the county (city, district) jointly with relevant departments and submitted to the people's government at the corresponding level for approval.

(6) The urban flood control planning of a city divided into districts shall be compiled by the water administrative department, the construction administrative department and other relevant departments organized by the municipal people's government divided into districts, and shall be approved by the municipal people's government divided into districts after being audited by the provincial water administrative department, but the urban flood control planning of Nanchang City and Jiujiang City shall be approved by the provincial people's government. The approved flood control plan shall be incorporated into the overall urban planning.

(7) The urban flood control plan of the town where the county (city, district) people's government has the task of flood control shall be compiled by the water administrative department, the construction administrative department and other relevant departments organized by the county (city, district) people's government, and shall be submitted to the people's government at the county level for approval after being audited by the municipal water administrative department with districts, and incorporated into the overall urban planning; Urban flood control planning for other towns with flood control tasks shall be compiled by the water administrative department, construction administrative department and other relevant departments of the county (city, district) people's government and submitted to the people's government at the county level for approval.

The approved flood control plan shall be reported to the water administrative department at the next higher level for the record. Modification of flood control planning shall be reported to the original approving authority for approval.

Ninth provincial waterlogging control planning by the provincial administrative department, submitted to the provincial people's government for approval.

The local people's government shall organize relevant departments and units to strengthen the construction of observation, early warning and forecasting facilities, and formulate and implement risk-avoidance plans and measures.

The people's governments at or above the county level shall incorporate the prevention and control of soil erosion into the flood control planning of river basins, formulate and implement prevention and control plans, and strengthen the comprehensive management of soil and water conservation.

Eleventh the construction of flood control projects, other water projects and hydropower stations on rivers and lakes shall conform to the flood control plan; Reservoirs shall, in accordance with the requirements of flood control planning, maintain sufficient flood control storage capacity.

The flood control project and other water projects and hydropower stations specified in the preceding paragraph shall not start construction without obtaining the planning consent signed by the relevant water administrative department that meets the requirements of flood control planning.

Chapter III Governance and Protection

The planning control lines of other rivers and river sections shall be drawn up by the corresponding water administrative departments in accordance with the flood control planning authority stipulated in Article 8 of these Measures and submitted to the people's government at the corresponding level for approval.

Thirteenth development and utilization of rivers, lakes (including coastline) and reservoir construction tourism projects must conform to the flood control plan and report to the water administrative department for examination and approval.

Article 14 The utilization and construction of urban river shoreline shall conform to the requirements of flood control planning, and keep the flood discharge smooth.

Fifteenth in the management of rivers and lakes, the following acts that affect the stability of river regime and flood control safety are prohibited:

(a) without the approval of the water administrative department, the construction of mechanical groins, dikes, water blocking channels, water blocking roads and other buildings and structures that hinder flood discharge;

(two) planting tall crops and trees (except wave forest and dike forest) and other water-blocking plants in the flood channel;

(3) Abandoning or stacking sunken ships, slag, stone slag, coal ash, soil, garbage and other wastes that hinder flood discharge;

(4) Building houses, opening canals, drilling wells, digging pits, burying graves, exploiting underground resources, conducting archaeological excavations and conducting fair trade activities on dikes and berms;

(five) other obstacles to river stability and flood control safety.

Sixteenth in the reservoir dam management, prohibit the following acts that affect flood control safety:

(a) Deforestation, land reclamation and other steep slopes lead to soil erosion;

(2) drilling wells, blasting, quarrying, taking soil, mining, frying fish, sliding wood, building docks and other acts endangering dam safety.

Sand mining, quarrying, earth borrowing and gold panning (hereinafter referred to as sand mining) within the scope of river management shall be reported to the water administrative department for approval in accordance with the law, and mining shall be carried out in accordance with the approved location, scope, time, sand mining volume and operation mode, and bridges, dikes, revetments, hydrological forecasting facilities, underwater cables, optical cables, hydrological flow sections, etc. shall not be damaged. , and shall not interfere with the safety of shipping.

When sand mining endangers the stability of river regime and the safety of flood control, the water administrative department shall, in accordance with the management authority, order sand mining units and individuals to stop mining immediately.

Eighteenth beaches within the scope of river management shall not be occupied without authorization. If temporary occupation is really necessary, it shall be approved by the competent water administrative department, and the occupation time shall be strictly controlled.

Article 19 For the river-related engineering facilities that are seriously blocked or need to be rebuilt or dismantled for improving the flood control standard of the river, the water administrative department shall put forward a plan according to the river management authority, report it to the relevant people's government according to the authority prescribed by the State Council, and order the construction unit to rebuild or dismantle it within a time limit; Due to the change of property rights, the construction unit can not be rebuilt or dismantled, and the owner shall be ordered to rebuild or dismantle within a time limit.

Twentieth rivers, lakes, reservoirs and other flood control facilities management scope, by the people's governments at or above the county level in accordance with the relevant provisions of laws and regulations, and set up stakes, to be announced.

According to the needs of flood control and project management, the people's governments at or above the county level may allocate the state-owned land within the management scope to the management unit of flood control engineering facilities according to law.

Twenty-first in accordance with the flood control plan, river regulation, dike repair and reinforcement need to permanently occupy land and project management land, and land allocation procedures shall be handled according to law. The available land increased by river regulation shall be uniformly arranged and used by the people's governments at or above the county level, and priority shall be given to the construction and management of flood control works and facilities.

Chapter IV Management of Flood Control Areas and Flood Control Engineering Facilities

Article 22 Flood control areas are divided into flood areas, flood storage and detention areas and flood control protection areas. The scope of floodplain, flood storage and detention area (including sub-flood storage area, the same below) and flood control protection area shall conform to

Article 23 The provincial people's government shall organize relevant departments and regions to formulate safety construction plans for flood-flooded areas and flood storage and detention areas according to the requirements of flood control planning, control the population growth of flood storage and detention areas, organize residents living in frequently used flood storage and detention areas to move out in a planned way, and take other necessary safety protection measures.

The safety construction planning of national flood storage and detention areas such as Kangshan, Zhuhu, Huang Hu and Zhoufang Xietang shall be compiled by the provincial people's government, organized by the water administrative department and relevant departments and the municipal people's government with districts, and reported to the water administrative department of the State Council for approval; The safety construction planning of other flood storage and detention areas shall be compiled by the municipal people's government divided into districts and organized by the water administrative department and relevant departments and the people's government at the county level, and submitted to the provincial water administrative department for examination and approval.

Areas and units that directly benefit from flood storage and detention areas according to law shall bear the obligation of compensation and assistance in accordance with the relevant provisions of the state and the province.

Measures for the administration of safety construction in flood storage and detention areas and measures for support, compensation and assistance in flood storage and detention areas shall be formulated by the provincial people's government.

Article 24 When constructing a non-flood control construction project in a flooded area or a flood storage and detention area, it is necessary to evaluate the possible impact of flood on the construction project and the possible impact of the construction project on flood control, prepare a flood impact assessment report and put forward defensive measures. If the flood impact assessment report has not been examined and approved by the relevant water administrative department, the construction unit shall not start construction.

The flood control engineering facilities arranged by the construction unit in the flood storage and detention area must be completed and accepted at the same time as the main project and put into use at the same time.

Twenty-fifth hydrological stations shall, according to the technical standards for hydrological measurement, delimit protected areas in the upper and lower reaches of the measured river, and report to the people's governments at or above the county level for approval, and set up ground signs at the upper and lower boundaries of the protected areas of the measured river.

No unit or individual may damage, occupy, damage or move hydrological forecasting facilities without authorization, and shall not engage in activities that endanger and affect hydrological forecasting.

If it is necessary to relocate or rebuild hydrological forecasting facilities due to engineering construction, relevant procedures shall be handled in accordance with state regulations, and the relocation or reconstruction costs shall be borne by the engineering construction unit.

Twenty-sixth people's governments at all levels should strengthen the management of flood control engineering facilities, establish and improve the quality management system, and ensure the quality of the project.

The construction of key flood control engineering facilities must strictly follow the basic construction procedures, and implement the project legal person system, bidding system, project supervision system, contract management system and completion acceptance system according to law. It is strictly forbidden to subcontract or illegally subcontract the winning project.

Twenty-seventh people's governments at all levels shall organize relevant departments to conduct regular inspection, supervision and management of flood control projects such as river dikes and reservoir dams. The competent department of flood control works and facilities shall organize relevant units to reinforce dangerous reservoirs, sluices, dikes and other water projects, and repair key projects damaged by water. The relevant people's governments shall, in accordance with the hierarchical management authority, give priority to funding.

People's governments at all levels and relevant competent departments shall strengthen the supervision and management of tailings dams and take measures to avoid dam collapse caused by floods.

Chapter V Flood Control and Flood Fighting

Twenty-eighth flood control and flood fighting work to implement the responsibility system of the chief executive of the people's governments at all levels, unified command, graded responsibility.

Twenty-ninth people's governments at or above the county level with flood control tasks shall set up flood control headquarters composed of relevant departments, local garrison, and heads of people's armed forces departments. All flood control member units shall, in accordance with their respective responsibilities, do a good job in flood control.

Article 30 The formulation of flood prevention schemes for the Yangtze River and inter-provincial rivers within the administrative area of this province shall be implemented in accordance with the provisions of Article 40 of the Flood Control Law.

Flood prevention schemes for other rivers and lakes shall be compiled by the flood control headquarters of the people's government in accordance with the flood control planning authority as stipulated in Article 8 of these Measures and submitted to the people's government at the corresponding level for approval.

Flood prevention schemes for flood storage and detention areas in Kangshan, Zhuhu, Huang Hu, Zhoufang Xietang and other countries are compiled by the flood control headquarters of the provincial people's government, and reported to the flood control headquarters of the State Council for approval after being audited by the provincial people's government.

Flood prevention schemes for large and medium-sized reservoirs and flood storage and detention areas in Quangang, Jianjiang and Qingfeng Mountain streams determined by the province shall be compiled by the flood control headquarters of the municipal people's government with districts where they are located, and shall be submitted to the provincial people's government for approval after being audited by the people's government at the corresponding level.

Flood prevention schemes for other medium-sized reservoirs and important small (I) reservoirs shall be compiled by the flood control headquarters of the local people's government at the county level, audited by the people's government at the corresponding level, approved by the municipal people's government with districts, and reported to the flood control headquarters of the provincial people's government for the record.

Flood prevention schemes for other small (1) reservoirs and small (2) reservoirs shall be jointly prepared by the flood control headquarters of the local county-level people's government and the relevant township people's governments, and submitted to the county-level people's government for approval, and reported to the flood control headquarters of the municipal people's government with districts for the record.

Flood control schemes for large and medium-sized tailings ponds in mining enterprises shall be compiled by the competent department in conjunction with the flood control headquarters of local people's governments at or above the county level, submitted to the municipal people's government with districts for approval, and submitted to the flood control headquarters of the provincial people's government for the record.

The approved flood prevention plan must be strictly implemented by the relevant localities and units. If it is really necessary to change, it must be approved by the original approval authority.

Article 31 The flood control headquarters of the people's governments at or above the county level shall conduct key inspections on key flood control projects, important flood control facilities, key river sections and their flood control preparations within their respective administrative areas, and urge relevant departments and units to implement various flood control measures within a time limit.

The relevant departments and units shall regularly check the water projects and other flood prevention preparations within their respective flood control responsibility areas.

Article 32 The flood season in this province is from April 6th to September 30th every year. Under special circumstances, the flood control headquarters of the provincial people's government may declare to enter or extend the flood control period in advance.

When the water regime of rivers and lakes is about to exceed the guaranteed water level or safe flow, the reservoir water level is close to the designed flood level, or the flood control engineering facilities are in great danger, the flood control headquarters of the people's government at or above the county level may declare an emergency flood control period. When the water situation slows down, the relevant flood control headquarters shall timely announce the end of the emergency flood control period.

Article 33 During the flood season, the operation of reservoirs and other water engineering facilities must strictly implement the approved flood control plan and obey the command, dispatch and supervision of the flood control headquarters of the people's government with jurisdiction.

During the period of emergency flood control, any unit or individual must obey the command of the flood control headquarters and the dispatch of materials, equipment, means of transportation and manpower.

Article 34 Flood control schemes for key dikes with cultivated land of more than 50,000 mu (including 50,000 mu) shall be organized by the flood control headquarters of the municipal people's government with districts where they are located and submitted to the flood control headquarters of the provincial people's government for approval; Flood control schemes that affect large and medium-sized reservoirs across the administrative area of a city divided into districts and large reservoirs that have significant flood control and regulation effects on the main stream of the Five Rivers shall be organized by the flood control headquarters of the municipal people's government divided into districts or the relevant competent departments and submitted to the flood control headquarters of the provincial people's government for approval.

Flood control schemes for dikes of more than 10,000 mu (including 10,000 mu) but less than 50,000 mu, other medium-sized reservoirs and important small (1) type reservoirs shall be organized by the flood control headquarters of the people's government at the county level and submitted to the flood control headquarters of the municipal people's government with districts for approval.

Flood control schemes for other dikes and small reservoirs shall be formulated by the water administrative department of the county (city, district) jointly with the local township people's government and submitted to the flood control headquarters of the people's government at the corresponding level for approval. The approved flood control plan shall be reported to the flood control headquarters of the people's government at the next higher level for the record.

Flood control schemes for reservoirs, hydropower stations, dams and other projects under construction shall be compiled by the project construction unit, and shall be submitted to the flood control headquarters of the people's government at the next higher level for the record after being examined and approved by the flood control headquarters of the people's government at the same level according to the jurisdiction of the construction project.

Thirty-fifth the use of levees for flood discharge and returning farmland to lakes shall be subject to the comprehensive planning of river basins and the overall layout of flood control in the whole province. The principle of application is determined by the flood control headquarters of the provincial people's government, and the people's government at the county level is responsible for the daily use and management of dikes.

It is forbidden to repair the double dike after it is destroyed or burst naturally. A single dike can be repaired and strengthened, but it cannot be raised. When the flood level exceeds the flood level, it is forbidden to increase the water retaining of the sub-dike.

Thirty-sixth water conservancy projects related to flood control are operated in various ways, such as contracting and leasing. , and the operators and owners shall specify the responsibilities of flood control, project management and maintenance in the contract. Operators must obey the unified management of the water administrative department and the command and dispatch of the flood control headquarters of the relevant people's government to ensure the safe operation of the project, and shall not change its original design functions such as flood control, water supply and drainage.

Thirty-seventh in the flood season, flood control command vehicles and emergency rescue vehicles are exempt from road and bridge (ferry) tolls. Flood control vehicle passes shall be issued by the flood control headquarters of the provincial people's government in conjunction with the provincial public security and traffic administrative departments.

Article 38 In case the local government needs to request the army and the armed police to support flood fighting and emergency rescue according to the water conditions and dangerous situations, the flood control headquarters of the people's government at or above the county level shall make a request in accordance with the prescribed procedures, and the provincial military region and the provincial armed police corps shall make contact arrangements. People's governments at all levels and their flood control headquarters shall provide logistical support for troops participating in flood fighting and emergency rescue.

Article 39 If the water level or flow of rivers and lakes meet the flood diversion standards stipulated by the state or the province, and flood storage and detention areas such as Kangshan, Zhuhu, Huang Hu and Zhoufang Xietang need to be activated, the activation conditions and approval procedures stipulated in the flood control plan approved by the flood control headquarters of the State Council shall be strictly implemented; If other flood storage and detention areas are opened up, the opening conditions and approval procedures stipulated in the flood control plan approved by the provincial people's government shall be strictly implemented. No unit or individual may obstruct or delay the opening of flood storage and detention areas according to law; In case of obstruction or delay, the people's government at or above the county level shall enforce it.

Chapter VI Safeguard Measures

Fortieth flood control expenses shall be raised according to the principle of combining government investment with reasonable burden of beneficiaries; Encourage all sectors of society to support flood control in various forms.

Article 41 People's governments at all levels shall, in accordance with the principle of the unification of administrative power and financial power, be responsible at different levels, make overall arrangements for financial funds to be used for flood control work, and gradually raise the overall level of flood control investment with economic development and fiscal revenue growth.

Forty-second flood control expenses are mainly used for the following matters:

(a) the preparation of flood control planning and the construction, maintenance and management of flood control engineering facilities;

(two) the construction, maintenance and management of non-engineering flood control facilities such as soil and water conservation, hydrological forecasting, meteorology and communication facilities;

(3) Flood fighting and emergency rescue in flood-stricken areas and restoration of water-damaged projects;

(four) flood control materials reserve and transportation costs;

(five) other flood control fees allowed by national and provincial regulations.

Forty-third flood control materials to implement the principle of grading reserve, grading burden, overall scheduling. The materials reserved by the province are mainly used for flood fighting and emergency rescue of key flood control projects in the province; The materials reserved by cities and counties are mainly used for flood fighting and flood control projects within their respective administrative areas. Townships, enterprises and institutions with flood control tasks should reserve necessary flood control materials, which are mainly used for flood fighting and emergency rescue in their own regions and units.

The reserved flood control materials shall be subject to the unified dispatch of the flood control headquarters at a higher level, and the transferred materials shall be compensated in accordance with the provisions of the state and the province.

Forty-fourth people's governments at or above the county level and relevant departments shall, in accordance with the provisions of the state and provincial people's governments, strengthen the collection and management of water conservancy construction funds to ensure that the water conservancy construction funds are used for the construction and maintenance of water conservancy projects and flood control facilities.

Forty-fifth financial and auditing administrative departments should strengthen supervision and inspection and special audit of the use of special funds such as flood control expenses and water conservancy construction funds to ensure earmarking.

Forty-sixth water administrative departments should strengthen water administrative supervision and investigate and deal with acts endangering flood control safety in accordance with the provisions of relevant laws, regulations and rules.

No unit or individual may obstruct or threaten the staff of flood control headquarters and water administrative departments to perform their duties according to law.

Chapter VII Legal Liability

Forty-seventh in violation of the provisions of article thirteenth of these measures, the development and utilization of rivers, lakes and reservoirs shall be ordered by the water administrative department to stop the illegal act; If flood control is affected, but remedial measures can be taken, it shall be ordered to take remedial measures within a time limit and may be fined 1 10,000 yuan but not more than 50,000 yuan; If flood control is seriously affected, it shall be ordered to dismantle it within a time limit and may be fined not less than 50,000 yuan but not more than 100,000 yuan.

Forty-eighth in violation of the provisions of Article fifteenth and Article sixteenth of these measures, the water administrative department shall order it to stop the illegal act, remove obstacles or take other remedial measures, and may impose a fine of more than one thousand yuan and less than ten thousand yuan; If flood control is seriously affected, a fine of not less than 10,000 yuan but not more than 50,000 yuan may be imposed.

Article 49 Whoever, in violation of the provisions of Article 17 of these measures, excavates sand without the approval of the water administrative department, or, in violation of the provisions of Article 18 of these measures, occupies beaches within the scope of river management without authorization, shall be punished by the water administrative department in accordance with the relevant provisions of the Regulations on River Management in Jiangxi Province.

Fiftieth in violation of the provisions of article nineteenth of these measures, overdue renovation or not in accordance with the requirements of the demolition, forced demolition by the water administrative department, the cost borne by the construction unit or owner; If neither the construction unit nor the owner is at fault, the local people's governments at or above the county level shall compensate the construction unit or the owner in an appropriate way.

Article 51 Whoever, in violation of the provisions of the first paragraph of Article 33 of these Measures, refuses to obey the supervision, management and flood control dispatching of the flood control headquarters shall report to the people's government at or above the county level for approval before compulsory execution.

Article 52 If, in violation of the provisions of Article 35 of these measures, the double-retreating dike that has been flattened or burst naturally is rebuilt, the single-retreating dike is heightened or a sub-dike is added on the single-retreating dike during the flood season, the flood control headquarters of the people's government at or above the county level shall order it to stop the illegal act and restore the original state; If the offender cannot make restitution, he shall make restitution on his behalf, and the expenses required shall be borne by the offender.

The relevant personnel of the people's government at the county level and the township (town) with poor supervision responsibility shall be punished according to law.

Fifty-third one of the following acts, which constitutes a crime, shall be investigated for criminal responsibility according to law; If it does not constitute a crime and should be punished for public security administration, it shall be punished in accordance with the provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment:

(1) obstructing or threatening the staff of flood control headquarters and water administrative departments to perform their duties according to law;

(two) lying about the danger of flood, deliberately spreading rumors and disturbing social order.

Fifty-fourth people's governments at all levels and their relevant departments have one of the following acts, and shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Failing to implement flood control planning or flood control planning;

(2) Failing to implement flood control inspection measures, causing serious consequences;

(three) other abuses of power, dereliction of duty, causing heavy losses in flood control and flood fighting work.

Chapter VIII Supplementary Provisions

Article 55 The term "double-retreating levee" as mentioned in these Measures refers to that the land below the water level of the corresponding lake mouth in the levee is 22.00 meters (Wusong elevation, the same below) or below the flood level of the same river once every 20 years retreats to the waters or beaches, and residents living below the corresponding elevation in the levee move to towns outside the levee.

The term "single-withdrawal dike" as mentioned in these Measures refers to that the land in the dike is planted and cultivated in low water, and the high water is withdrawn from the lake for flood storage. Residents who have lived in the dike for 20 years below the water level of the corresponding lake mouth or the flood level of the same river move out of their original residence and immigrate to build towns.
