Regulations of Hainan Province on the Administration of Village Planning
Villages within the development boundaries of towns and industrial parks should be included in the planning and management of towns and industrial parks. Third people's governments at or above the county level shall, according to the level of rural economic and social development in their respective administrative areas, determine the areas where village planning should be made in accordance with the principle of adjusting measures to local conditions and stressing practical results. Villages in the identified areas shall make plans in accordance with these regulations. Article 4 Village planning is the legal basis for developing and protecting land space, controlling the use of land space, issuing planning permits for construction projects and various village constructions.
Any unit or individual carrying out various development, protection and construction activities within the village shall abide by the village planning approved and published according to law and obey the planning management. Article 5 The formulation and implementation of village planning shall follow the principles of adhering to the villagers' dominant position, planning before construction, respecting the natural pattern, highlighting the tropical islands and ethnic characteristics, preserving the unique natural and pastoral features of mountains, rivers, fields, lakes and grasses, and maintaining the landscape characteristics of villages and dwellings, which meets the needs of land use, industrial development, residential area layout, improvement of living environment, ecological protection and historical and cultural inheritance. Article 6 The people's governments of cities, counties and autonomous counties shall co-ordinate the formulation and implementation of village planning within their respective administrative areas.
The competent departments of natural resources and planning of the people's governments of provinces, cities, counties and autonomous counties shall be responsible for the guidance and supervision of village planning and management within their respective administrative areas.
The relevant departments of the people's governments of provinces, cities, counties and autonomous counties, such as agriculture and rural areas, housing construction, development and reform, ecological environment, finance, civil affairs, water affairs and tourism, are responsible for the relevant work of village planning and management according to their respective responsibilities.
Township people's governments shall be responsible for organizing and implementing village planning within their respective administrative areas. Article 7 People's governments at all levels shall incorporate the funds for village planning and management into the fiscal budget at the corresponding level, strengthen the planning and construction of village infrastructure, public service facilities and public welfare undertakings, improve the living environment and living conditions, and improve the level of village public services. Chapter II Formulation of Village Planning Article 8 Village planning shall be formulated and revised according to the overall land and space planning of the city, county and autonomous county where it is located, and shall be linked with relevant special planning. Ninth village planning should be based on specific circumstances, combined with the actual needs of the village classification. Need to focus on the development or transformation of the village, you can step by step to prepare a practical comprehensive planning; Other villages that need to be planned can only be used as control rules for village planning, such as land and space use, construction control, and improvement requirements of human settlements.
If the state and this province have other provisions on the preparation of village planning, those provisions shall prevail. Tenth village planning has been approved in accordance with the law before the implementation of this Ordinance, the Township People's government organization assessment, in line with the provisions of this Ordinance, with the consent of the people's governments of cities, counties and autonomous counties, you can no longer prepare a separate village planning; If it does not conform to the provisions of these regulations, it shall be revised or compiled separately according to law.
According to the village planning of this Ordinance, no other village spatial planning will be prepared.
The measures for the preparation of village planning shall be formulated by the provincial natural resources and planning department. Eleventh village planning should strictly abide by the permanent basic farmland control line and ecological protection red line determined by the overall land and space planning of cities, counties and autonomous counties, and shall not exceed the construction land index. Twelfth village planning can include the following contents:
(1) Defining the orientation of village development, the development and protection of land space, the goal of improving human settlement environment, the direction of leading industries, etc. ;
(two) the permanent basic farmland control line and ecological protection red line determined by the overall land space planning of cities, counties and autonomous counties, and the implementation of construction land planning control indicators;
(three) the requirements for the management of the overall style of the village, and the specific contents, measures and requirements for the improvement of the living environment of the village;
(four) the layout of infrastructure and public service facilities such as roads, water supply, drainage, power supply, information, radio and television, fire protection, flood control, sewage and garbage disposal;
(5) Delineating the scope of village disasters and safety protection, and defining the contents and measures of comprehensive disaster prevention and mitigation;
(six) the village development boundary, refine the layout of industrial land and rural villagers' residential land, and determine the control requirements of industrial land development intensity and scale;
(seven) land remediation and ecological restoration requirements, clear governance rules and measures;
(eight) historical and cultural protection line, clear village historical and cultural protection and inheritance measures;
(nine) planning the recent implementation of ecological restoration, arable land consolidation, supplementary arable land, industrial development and other projects.
Where the state and the province explicitly require the inclusion of village planning content, its provisions shall prevail. Thirteenth village planning can reserve no more than 5% of the mobile construction land index for rural villagers' houses, rural public facilities, public welfare undertakings and industrial development. The use of mobile indicators shall not occupy permanent basic farmland and ecological protection red line.
Rural villagers' houses, rural public facilities, public welfare undertakings and industrial development can use the land use mobility indicators listed in the preceding paragraph, and can make points arrangements.
