How to apply for a marriage certificate for a foreign-related marriage

China citizens and foreigners (including foreigners residing or temporarily residing in China, overseas Chinese and foreigners residing in China) apply for marriage in China.

Both men and women must * * * apply for registration with the marriage registration authority designated by the people's government of the province, autonomous region or municipality directly under the Central Government where one of China citizens is registered. China citizens and foreigners applying for registration shall hold the following documents respectively:

(1) China citizens must have:

① my household registration certificate;

(2) My name, gender, date of birth, nationality, marital status (unmarried, divorced, widowed), occupation and nature of work, and the certificate issued by the people's government at the county level where I live or the organs, schools, institutions and enterprises at or above the county level where I work.

(2) Foreigners must have:

(1) My passport or other identification and nationality certificates;

(2) Alien Residence Permit issued by the public security organ, or identity certificate issued by the foreign affairs department, or temporary entry and residence certificate;

(3) A certificate of marital status issued by a notary office in China certified by the Ministry of Foreign Affairs (or an organ authorized by the Ministry of Foreign Affairs) and Chinese embassies and consulates in that country, or a certificate of marital status issued by Chinese embassies and consulates in that country.

(3) Foreign nationals must have:

(1) my passport or identity and nationality certificate replaces my passport (except stateless persons);

② Alien Residence Permit issued by the public security organ;

(3) My name, gender, date of birth, nationality, marital status (unmarried, divorced, widowed), occupation and nature of work, and the certificate issued by the people's government at the county level where I live or the organs, schools, institutions and enterprises at or above the county level where I work.

Both men and women applying for marriage must also submit the pre-marital health examination certificate issued by the hospital designated by the marriage registration authority.

China citizens and foreigners who have complete certificates and meet the statutory requirements may apply to the marriage registration authority with their own certificates and photos of both men and women.

The parties applying for marriage registration shall truthfully provide relevant certificates and certificates to the marriage registration authority, and shall not conceal the true situation.

(2) Review

The marriage registration authority shall examine the application of the parties, find out whether the application for marriage meets the conditions for marriage, ask the parties if they have any questions, and ask them to provide relevant certification materials when necessary.

(3) Registration

1. Register it.

The marriage registration authority shall register immediately and issue a marriage certificate to those who meet the conditions for marriage; A divorced person shall cancel his divorce certificate. However, China citizens and foreigners who apply for registration shall go through the registration formalities and issue marriage certificates within one month after receiving the application. The marriage certificate of a foreign-related marriage shall be affixed with photos of both men and women, and stamped with the special seal for marriage registration of the people's government at or above the county level.

When the parties who apply for marriage registration are interfered by the unit or others and cannot obtain the required documents, the marriage registration authority shall register them if it finds that they really meet the conditions for marriage.

2. Not registered

The marriage registration authority shall not register the applicant in any of the following circumstances:

(1) Under the legal age of marriage;

(2) Involuntary;

(3) Having a spouse;

(4) Belonging to lineal blood relatives or collateral blood relatives within three generations;

(5) Suffering from diseases that are medically considered unsuitable for marriage.

How to prove the authenticity of foreign-related marriage;

In order to provide evidence that * * * lives together, both parties to the marriage must link their lives together. After marriage, both parties should have enough trust so that they can enjoy their assets and seek the future. They take concrete measures to show the essence of husband and wife living together. You can collect some evidence:

1, evidence of the authenticity of transnational marriage

2. Joint bank checking account and savings account

3. Joint credit card

4. Joint automobile registration documents and automobile insurance.

5. Medical insurance enjoyed by both parties.

6. The property rights of the house are jointly owned or jointly leased.

7. Joint bills for water, electricity, gas, telephone and internet.

8. Beneficiaries whose spouses are included in retirement plans

9. Spouses are included as beneficiaries of life insurance.

10. In the process of applying for immigration or adjusting the status, the parties will be required to provide proof of the husband and wife living together. Therefore, in addition to the evidence listed above, the parties should also provide the following documents as far as possible:

1 1. Letters or emails exchanged by both parties about their relationship or wedding planning.

12. Air tickets, boat tickets, train tickets and hotel receipts for both parties traveling together.

13, photos of scenic spots and various activities that the two sides traveled together.

14. Receipts for both parties to buy engagement or wedding rings or special gifts for each other.

15, wedding photos and photos taken with relatives and friends at the wedding.

16, photos of * * * living and playing together in different periods after marriage.

17, child's birth certificate, or pregnancy certificate, or obstetrician's treatment certificate, etc.

Article 21 The marriage conditions shall be governed by the laws of the parties' habitual residence. If * * * does not have the same habitual residence, the law of the country of nationality of * * * shall apply; If one party does not have the same nationality and gets married in the country of habitual residence or nationality, the law of the place of marriage shall apply.

Article 22 The marriage formalities shall be valid if they conform to the laws of the place of marriage, the laws of one party's habitual residence or the laws of the country of nationality.

Article 23 The personal relationship between husband and wife shall be governed by the law of habitual residence. If * * * does not have the same habitual residence, the laws of * * * the same country of nationality shall apply.

Article 4 of the Regulations on Marriage Registration

When mainland residents get married, both men and women should go to the marriage registration office where one of them has a permanent residence.

If a China citizen marries a foreigner in the Mainland, and a mainland resident marries a Hong Kong resident, a Macao resident, a Taiwan Province resident or an overseas Chinese in the Mainland, both men and women shall * * * go through the marriage registration office where the permanent residence of the mainland resident is located.

Article 5, paragraph 4

Foreigners who register for marriage shall present the following documents and supporting materials:

(a) my valid passport or other valid international travel documents;

(2) A certificate issued by the notary office or competent authority of the host country, and certified by the people of China and the embassy (consulate) of China or the embassy (consulate) of China in that country that I have no spouse, or a certificate issued by the embassy (consulate) of China in that country that I have no spouse.
