Can refugees get nationality when they come to Germany?
1, principle of origin and place of birth
If one parent has German nationality, their children will also acquire German nationality. For children born out of wedlock, if the mother is German, the children are German; If only the father has German nationality, German nationality can only be obtained after confirming the blood relationship between father and son or father and daughter. This confirmation must be made before the child is 23 years old.
Foreign children born in Germany can automatically acquire German nationality if one of their parents has lived in Germany for more than eight years and has held the right of permanent residence (Aufenthalt erechtigung) or indefinite residence (U efritte auf enthaltserlauis) for more than three years.
2. The principle of choosing nationality
In principle, Germany does not allow dual nationality, so foreigners who join German nationality are required to withdraw from their original nationality first. However, in the case of obtaining German nationality according to the principle of birthplace, there is the possibility of dual nationality, that is, when one or both parents are foreign nationals, the newborn obtains German nationality according to the German nationality law, but at the same time has foreign nationality according to the principle of descent. According to the German Nationality Law, as long as he has other nationalities at the same time, he will choose whether to continue to hold German nationality in the form of a written statement at the age of 23 according to the requirements of the competent authorities. If he keeps his foreign nationality, he will lose his German nationality. If he retains German nationality, he must submit proof that he has lost or renounced his foreign nationality. If he is over 23 years old, he will automatically lose his German citizenship and hold dual citizenship before that. At the same time, the new nationality law allows dual nationality to be retained under special circumstances, but it must be approved by the competent authorities.
3. Simplify naturalization procedures.
Naturalization is an important way to acquire German nationality. Applicants who meet the following conditions may apply for naturalization:
Years of residence: it is required to live legally in Germany for at least eight consecutive years (originally 15 years).
Type of residence: you must hold permanent residence (Aufenthalt erechtigung) or residence permit (Aufenthaltserlau is).
Give up or lose one's original nationality
* Economically, a stable source of income (excluding social or unemployment benefits) is required.
Politics: Applicants are required to agree with the principles of freedom and democracy and the Basic Law, and have no criminal conviction record.
Cultural aspect: sufficient knowledge of German is required.
In addition, the new naturalization policy relaxes the requirements for the naturalization of foreign spouses and adult foreign children of German citizens in terms of residence time, marriage years and language level.
Germany's new nationality policy shows that the current German government has adopted a more open and tolerant thinking in dealing with foreign immigrants, focusing on promoting the integration of foreign immigrants into German social and economic life.
