Chapter 1 General Provisions Article 1 In order to strengthen the management of village planning and construction in this city, build ecologically livable and beautiful villages, and promote rural revitalization, in accordance with the "Urban and Rural Planning Law of the People's Republic of China" and "China The People's Republic of China Land Management Law and other laws and regulations are formulated in conjunction with the actual situation of this city. Article 2 These regulations apply to planning, construction and management activities in villages outside the urban development boundary. Article 3 The management of village planning and construction shall follow the principles of planning first, rational layout, adapting measures to local conditions and intensive development. Article 4 The municipal and county (city, district) people's governments shall strengthen the management of village planning and construction and include the preparation and management funds of village planning into the fiscal budget of the same level. Article 5: The natural resources authorities are responsible for the planning and management of villages within their respective administrative regions.

The competent departments of agriculture and rural affairs are responsible for the reform and management of rural homesteads within their respective administrative regions.

The competent departments of housing and urban-rural development are responsible for the management of village housing construction within their respective administrative regions.

The competent departments of development and reform, finance, transportation, water affairs, ecological environment, forestry, human resources and social security should, in accordance with their respective responsibilities, do a good job in village planning, construction and management. Article 6: The town people's government is responsible for the organization, preparation and implementation of village planning within its region and the supervision and management of village construction. The town people's government should clarify its institutions and personnel, strengthen village planning and construction management and law enforcement capacity building.

The town people's government can select and hire professionals through various forms such as social recruitment and purchasing services, guide and support planners, architects and engineers to serve in the countryside, and improve the level of village planning and construction management. Article 7 The village committee shall assist in village planning, construction and management work.

Village committees should play the role of villagers’ autonomous organizations and organize villagers to participate in village planning, construction and management in accordance with the law. Article 8 Municipal and county (city, district) people's governments shall improve the construction of land spatial planning and construction management information platforms, strengthen the collection and application of village planning and construction, village public facilities maintenance and other relevant information, and promote the sharing of information. , improve management efficiency.

County (city, district) people's governments, town people's governments, and sub-district offices should establish and improve village planning and construction archives management systems to provide convenience for citizens, legal persons, and other organizations to review. Article 9 The municipal and county (city, district) people's governments shall play a leading role in planning, encourage the orderly participation of social capital, guide rural collective economic organizations or village committees to explore, develop and rationally utilize local excellent traditional culture and other resources, and develop distinctive economy. Article 10 People's governments at all levels and natural resources and other competent departments shall strengthen educational guidance and use various methods to publicize and popularize laws and regulations on village planning, construction and management. Chapter 2 Village Planning Article 11 When formulating village planning, we should adhere to the "integration of multiple plans into one", adapt measures to local conditions, and coordinate village development goals, ecological protection and restoration, protection of cultivated land and permanent basic farmland, inheritance and protection of historical culture, infrastructure and basic The layout of public service facilities, industrial development space, housing layout, village safety and disaster prevention and reduction, and clear plans for recent implementation projects. Article 12 The village plan approved in accordance with the law is the basis for village planning and construction management and should be strictly implemented.

Any unit or individual carrying out various village development, protection, and construction activities must abide by the village plan that has been approved and announced in accordance with the law, and submit to planning management. Article 13: Village planning shall be organized and compiled by the town people's government.

The unit responsible for the preparation of village planning should have the corresponding qualification level. Article 14 Village planning is prepared based on administrative villages. Several administrative villages whose construction land is adjacent to each other, whose public facilities need to be built for exclusive use, or where there are other practical needs, can prepare village plans contiguously.

Village planning should clarify the layout of village infrastructure and public service facilities such as the main entrance and exit channels of the natural village, water supply and sewage facilities, domestic garbage collection facilities, and the building facades and heights of rural residences. , color, building safety, etc. put forward control requirements. Article 15 Village planning may, in accordance with relevant regulations, reserve flexible quotas of construction land for rural villagers' residences, rural public facilities, public welfare construction and industrial development. Article 16 After the draft village planning is completed, it shall be announced in public places in the village for no less than 30 days, and the opinions of experts and villagers shall be solicited and heard through various forms such as symposiums, hearings, and demonstration meetings.

The opinions of experts and villagers should be fully considered, and the acceptance status and reasons for the opinions should be attached to the materials submitted for approval. Article 17 The villagers committee shall review the draft village plan after the announcement and form deliberation opinions.

The villagers' meeting or villagers' representative meeting discusses the draft village plan and the villagers committee's deliberation opinions. Unless otherwise provided by law, a villagers' meeting must be convened with the participation of more than half of the villagers over the age of 18 or representatives of more than two-thirds of the households in the village, and must be approved by more than half of those present. If a village with a large population or dispersed residents has established a villagers' representative meeting in accordance with the law, the villagers' representative meeting must be held with the participation of more than two-thirds of the members, and must be approved by more than half of the people present at the meeting. Article 18 The draft village plan that is discussed and approved by the villagers' meeting or villagers' representative meeting shall be submitted by the town people's government to the people's government at the next higher level for review and approval.

The town people's government shall announce the village plan on the village committee bulletin board and public places within ten working days from the date it is approved, and publish it on the government website for a long time.
