How to apply for 309 visa?

The prerequisite for applying for a 309 visa is that the applicant is overseas and the applicant’s spouse is an Australian citizen, permanent resident or New Zealand citizen. In addition, the following requirements must be met:

1. Both husband and wife are over 18 years old

2. Both husband and wife have a real marital relationship and continue to maintain that relationship during the application period

3. Married applicants: You and your spouse are recognized by Australian law and registered as a married couple.

4. Or de facto marriage applicants: Before applying, you and your spouse have been a de facto couple living together for more than 12 months, and the dating time does not count. If you have not maintained a cohabitation relationship for more than 12 months, but you must meet one of the following conditions, you can also apply for a 309 visa:

(1) Already have two children

(2) Before the Australian spouse obtains a humanitarian visa, you have a de facto marriage relationship.

(3) Registered cohabiting relationship in Australia. (Not applicable to all states or territories, only Victoria, Tasmania and New South Wales)

5. Applicants must meet health and character requirements.
