How to handle foreign-related marriage procedures?
Where China citizens and foreigners (including foreigners residing in China and temporarily coming to China, foreign Chinese and foreign nationals residing in China), compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and people going abroad voluntarily marry, remarry and divorce by agreement, both men and women must apply for marriage registration at the same time to the foreign marriage registration office of the local civil affairs bureau. When applying, you must abide by the provisions of the Marriage Law of the People's Republic of China.
First, marriage registration
China citizens and foreigners, compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and overseas Chinese applying for marriage shall not be over 22 years old for men and 20 years old for women. The following documents must be held separately:
(1) China citizen
1. My household registration certificate (household registration book, ID card);
2. The proof of marital status issued by the people's government of the rural township (town) or the city street office where I live.
(2) Foreigners and overseas Chinese
1. my passport or other proof of identity and nationality;
2. A foreigner's residence certificate issued by China's public security organ or an identity certificate issued by the foreign affairs department, or a temporary entry and residence certificate for China;
3. A certificate of marital status issued by a notary office in China certified by the Ministry of Foreign Affairs (or an organ authorized by the Ministry of Foreign Affairs) and the Chinese embassy or consulate in that country; Or a certificate of marital status issued by embassies and consulates in China;
4. Foreign students in technical secondary schools, junior colleges and undergraduate courses are generally not allowed to get married while studying at school. Other students (advanced students, graduate students, etc.). If you want to marry a citizen of China, in addition to the above certificate, you must also hold the academic certificate of your institution;
5. Divorce certificate or spouse's death certificate of the remarried person (the divorce certificate shall be certified by the Chinese embassy (consulate) in the country or directly by the embassy (consulate) in the country).
(3) Hong Kong compatriots
1. Hong Kong Identity Card, Home Visit Permit or Seaman's Certificate;
2. A certificate of marital status issued by the Hong Kong Marriage Registry certified by a Hong Kong lawyer entrusted by my judicial organ, and a statement that the applicant certified by a lawyer has never registered for marriage elsewhere;
3. Remarriage divorce certificate or spouse death certificate.
(4) Macao compatriots
1. Macao resident identity card, home visit permit or seaman's certificate;
2. Marriage qualification certificate or no marriage registration certificate issued by Macao Marriage and Death Registration Bureau;
3. Divorce certificate or spouse death certificate of the remarried person.
(5) Taiwan Province compatriots.
1. Travel Permit for Compatriots in Taiwan Province Province issued by China's embassies and consulates abroad or Travel Permit of the People's Republic of China printed with the words "Compatriots in Taiwan Province Province";
2. The last volume of my household registration book has no spouse certificate or a copy of the notarial certificate issued by the notary office of Taiwan Province Province;
3. Divorced or widowed Taiwan Province compatriots are also required to provide a divorce certificate notarized by a notary office or a spouse's death certificate. If the above proof cannot be provided, a notarized divorce statement or a divorce announcement published in newspapers in Taiwan Province Province or Hong Kong and Macao can be provided. Without notarization, it has no legal effect.
(6) Overseas Chinese
1. Passport issued by my embassy or consulate in that country;
2. I don't have a spouse certificate issued by the notary office of the country where I live and certified by my embassy or consulate in that country or I don't have a spouse certificate issued by my embassy or consulate in that country;
3. Divorce certificate or spouse death certificate of the remarried person certified by the Ministry of Foreign Affairs and Chinese embassies and consulates abroad.
(7) Overseas personnel
People who go abroad refer to China citizens who have left the country according to law and stayed abroad legally for more than 6 months and have not settled. Overseas personnel need to register for marriage:
1. My passport;
2. Proof of marital status issued by the employer;
3. "Certificate of Marital Status" issued by China's embassies and consulates abroad or by a notary office in the country of residence certified by China's embassies and consulates abroad;
4. Both men and women who apply for marriage registration must hold divorce certificates if they are divorced; Widowed must hold a spouse's death certificate;
In addition, both men and women who apply for marriage registration should go to the hospital designated by the marriage registration authority for pre-marital health examination; Submit 3 bareheaded half-length photos (2 inches) of both men and women, which must be reviewed by the marriage registration authority. Those who meet the requirements shall be granted registration and a marriage certificate shall be issued.
Second, the divorce registration
China citizens and foreigners who want a divorce in China shall file divorce proceedings with the people's court in accordance with the relevant provisions of the Civil Procedure Law of People's Republic of China (PRC). Those who ask for remarriage shall be treated as married. Overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, as well as overseas Chinese and China citizens who voluntarily divorce and have properly handled child support and property, may apply for divorce registration at the local foreign-related marriage registration office. If one party requests a divorce or one party cannot apply for a divorce at the marriage registration office, it may directly file a divorce lawsuit with the people's court where the domestic (mainland) party is registered. After divorce, if both men and women voluntarily resume the relationship between husband and wife, they shall apply for marriage registration.
