Rural homestead belongs to collective ownership. 1. Units and individuals using land must use the land in strict accordance with the purposes determined in the overall land use planning. That is, the homestead can only be used for building houses, can only be used, and cannot occupy other land. 2. Where the ownership and use right of land is changed according to law and the land use is changed according to law, the parties concerned must, within 30 days from the date of change, submit an application for registration of land change to the land administrative department of the people's government at or above the county level with the approval document, and the registration authority shall handle the registration of land change according to law and replace or change the land certificate. 3, rural residents or cadres, workers and urban residents who have settled in their hometowns, who can use the old housing base, shall not occupy new land. If it is really necessary to occupy new land, I shall apply for it, with the consent of the township (town) people's government, the permission of the town planning management department, the audit of the land management department and the approval of the people's government at the county level. Its homestead area: 20 to 30 square meters per person, and the family with more than four people is counted as four people. The newly occupied land area for extended residence shall be combined with the original homestead area. If all newly-built houses use land other than cultivated land and forest land, the land area may be appropriately increased, but the increased part shall not exceed 30 square meters per household at most. Rural residents due to relocation and other reasons to vacate the old housing base, recovered by the land owner, unified arrangements for use. The application for homestead after the sale or rental of houses shall not be approved.
