Land Management Law

Article 8 Land in urban areas belongs to the state.

Land in rural areas and urban suburbs, except for the state-owned land as stipulated by law, is collectively owned by farmers; homesteads, private land, and private hills are collectively owned by farmers.

Regulations for the Implementation of the Land Management Law

Article 2 The following lands are owned by the whole people, that is, by the state:

(1) Land in urban areas;< /p>

(2) Land in rural areas and urban suburbs that has been confiscated, expropriated, and requisitioned as state-owned according to law;

(3) Land requisitioned by the state according to law;

( 4) Forestry, grassland, wasteland, tidal flats and other lands that are not collectively owned according to law;

(5) If all members of a rural collective economic organization become urban residents, the land originally owned by their members collectively;

(6) The land originally owned by the collective of the relocated farmers is no longer used after the collective relocation of farmers to organized areas due to state-organized migration, natural disasters and other reasons.
