Local regulations that stipulate the basic system of the Municipal People's Congress, and local regulations that the Municipal People's Congress deems necessary to be formulated by the Municipal People's Congress shall be adopted by the Municipal People's Congress.
When the Municipal People's Congress is not in session, the Standing Committee of the Municipal People's Congress may partially amend and supplement the local regulations formulated by the Municipal People's Congress, but it shall not conflict with the basic principles of the local regulations and report to the Standing Committee of Jiangsu Provincial People's Congress for approval. Article 4 The Legislative Affairs Committee of the Municipal People's Congress shall be responsible for the unified deliberation of the draft local regulations. Chapter II Formulation of Legislative Planning Article 5 The Municipal People's Government, the Municipal Intermediate People's Court, the Municipal People's Procuratorate, the special committees of the Municipal People's Congress and the working bodies of the Standing Committee may put forward opinions on the legislative planning and annual legislative planning to the Standing Committee. Legislative planning opinions shall be put forward within three months after the first meeting of each Municipal People's Congress; The annual legislative plan shall be put forward before the end of September of the previous year.
Other organs, organizations and citizens within the administrative area of this Municipality may put forward suggestions to the Standing Committee on formulating local regulations.
Opinions and suggestions on the formulation of local regulations shall be put forward in writing. Opinions and suggestions on the formulation of local regulations shall include the reasons and basis for the formulation of local regulations and the main problems to be solved. Article 6 The legislative affairs office of the Standing Committee shall, jointly with the relevant special committees or working offices, the legislative affairs office of the Municipal People's Government and other relevant organs, work out the draft legislative plan and the draft annual legislative plan according to the opinions and suggestions put forward by relevant parties for formulating local regulations. Legislative planning shall be discussed and decided by the meeting of directors of the Standing Committee. The Standing Committee shall submit the legislative plan for the next year to the Standing Committee of the Provincial People's Congress before the end of the year.
If the legislative plan needs to be adjusted due to changes in circumstances during implementation, it shall be decided by the meeting of directors and printed and distributed to the meeting of the Standing Committee. The adjustment plan shall be reported to the Standing Committee of the provincial people's Congress two months in advance. Chapter III Drafting of Local Regulations Article 7 Local regulations shall be drafted by the meeting of directors, special committees, the Municipal People's Government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate according to their respective functions and duties.
The organ responsible for drafting local regulations and the representatives of the Municipal People's Congress or members of the Standing Committee who jointly put forward local regulations may draft them by themselves or entrust relevant departments, units or experts to draft them. Article 8 Where any project is included in the annual legislative plan, the organ responsible for drafting shall set up a drafting group with the participation of the person in charge of the drafting organ, actual staff and relevant experts.
The drafting of local regulations should be widely listened to. Before proposing local regulations, the organ proposing local regulations shall be responsible for coordinating different opinions on major issues in the draft local regulations.
In the process of organizing the drafting of local regulations, the relevant authorities can intervene in advance to understand the drafting situation, participate in research and demonstration, and put forward suggestions and opinions. Ninth local regulations generally include the name of the regulations, legislative purpose and basis, adjustment object and scope of application, competent authorities, code of conduct, legal responsibility, implementation time and other basic contents.
Local regulations can be divided into chapters, sections, articles, paragraphs, items and items according to the content needs. If there are few articles, there may be no chapters.
The language of local regulations should be scientific, accurate, clear and easy to understand, concise, rigorous and consistent.
