Opinions on the Implementation of the Institutional Reform of the People's Government of Henan Province According to the Notice of the Central Committee and the State Council on the Institutional Reform Plan of the People's Government of Henan Province (Guo Ban Fa [2000] 1 10), this opinion is formulated.

I. Objectives and principles of reform

Since the reform and opening up, especially since the 14th National Congress of the Communist Party of China, under the guidance of Deng Xiaoping Theory and the Party's basic line and in accordance with the deployment of the CPC Central Committee and the State Council, the reform of the administrative management system and government institutions in our province has been deepened and achieved positive results. However, due to the constraints of historical conditions and macro-environment, some deep-seated contradictions and problems have not been fundamentally solved, and problems such as separation of government from enterprises, separation of government affairs, huge institutions, overlapping functions, unreasonable personnel structure and excessive financial burden still exist. These problems not only hinder the transformation of government functions and the gradual improvement of the socialist market economic system, but also encourage unhealthy trends such as bureaucracy, affect the relationship between the party and the government and the people, and hinder economic development and social stability. Therefore, it is necessary to further reform government institutions.

The objectives of the reform are: in accordance with the spirit of the 15th National Congress of the Communist Party of China and the First Session of the Ninth National People's Congress, guided by the basic line of Deng Xiaoping Theory and the Party, and proceeding from the requirements of establishing a socialist market economic system, to effectively change functions, straighten out relations, streamline troops and simplify administration, improve efficiency, improve the national civil service system, build a team of high-quality professional administrative cadres, and establish an administrative management system with efficient operation, coordinated operation and standardized behavior.

The principle of reform is:

-In accordance with the principle of separating government from enterprise, we should effectively transform government functions and truly hand over the decision-making power of enterprise production, operation and investment to enterprises. Provincial governments mainly perform economic regulation, social management and public service functions.

Reasonably define the division of functions between departments, and hand over the same or similar functions to the same department to solve the problem of multi-door and multi-head management.

-In accordance with the principle of seeking truth from facts, combined with the regional characteristics of our province, the level of economic and social development, the degree of market development, the status of human resources and the status quo of administrative management, actively and steadily carry out reforms.

-in accordance with the requirements of administration according to law, we will vigorously strengthen the institutionalization, standardization and legalization of administrative management. Strengthen the management and supervision of institutional staffing, and establish a restraint mechanism that coordinates institutional staffing management and financial budget management.

Second, the main contents and measures of the transformation of government functions

According to the requirements of the socialist market economy, the provincial government should earnestly perform the functions of regional economic regulation and social management, formulate social and economic development plans in line with the provincial conditions according to national laws, regulations, principles and policies, pay attention to regional economic regulation, policy guidance, law enforcement supervision and organization and coordination, strengthen the construction of socialist spiritual civilization and material civilization, and maintain a balanced and orderly operation of the economic aggregate; Break the division between regions, create a fair, just and open competitive environment, maintain market order and promote the formation of a unified market; Realize the separation of government from enterprise, deepen enterprise reform and speed up enterprise reorganization; Strengthen the leadership and coordination of agriculture and rural work.

The main contents of the transformation of government functions are as follows: First, the separation of government from enterprise. The administrative subordination relationship between the government and enterprises will be transformed into an asset transformation relationship, and the production and management rights and investment decision-making rights of enterprises will be handed over to enterprises. The government enjoys the owner's rights and interests according to the cost of the investment enterprise. The second is to gradually change the leading role of the government in resource allocation and give full play to the basic role of the market. Third, vigorously promote the separation of government affairs, and separate some auxiliary, technical and service functions from government functions and transfer them to public institutions and social intermediary organizations. The fourth is to reasonably divide the powers and responsibilities of the provincial, municipal and county governments, clarify their respective powers and responsibilities, and ensure that the powers and responsibilities are consistent.

In order to achieve the above objectives, the transformation of government functions mainly adopts the following measures:

First of all, the administrative subordination between government departments and state-owned enterprises should be lifted. The competent department does not directly manage the enterprise and does not interfere with the production, operation and investment decisions of the enterprise. Government agencies no longer run economic entities, and those that have been run must be decoupled within a time limit.

Second, professional economic management departments such as industry and commerce are no longer retained, but administrative companies are reorganized and their administrative functions are merged into the comprehensive economic departments of the government. Improve the government's supervision of state-owned enterprises, and strengthen the inspection and supervision of key state-owned enterprises by sending supervisors; Establish and improve the management, supervision and operation mechanism of state-owned assets in accordance with the general requirements of "state ownership, hierarchical management, authorized operation and division of labor supervision".

The third is to reform the administrative examination and approval system. Comprehensively clean up the examination and approval items of the government and various departments, and vigorously reduce the examination and approval items. For the examination and approval items reserved according to law, it is necessary to improve the examination and approval methods, standardize procedures and reduce links; The examination and approval items that really need approval but do not involve global affairs should be delegated to the municipal and county governments as much as possible to simplify the examination and approval procedures and levels. The fourth is to promote the reform of the logistics service system of public institutions and organs. The sixth is to establish an efficient, coordinated and standardized administrative operation mechanism. Standardize the establishment of party affairs and cadre personnel management institutions.
