(A) the identification of housing property rights
The identification of the expropriated house property right is based on the records in the house ownership registration book of the house ownership management department; For houses with no property right registration or unclear ownership, relevant functional departments shall investigate and identify them according to law.
(2) Identification of the nature of the house
The nature of the house to be expropriated shall be subject to the registration of the house ownership certificate or the immovable property certificate.
If there is no house ownership certificate or immovable property certificate, the relevant certificates such as state-owned land use right certificate and construction project planning permit shall be determined by the relevant functional departments such as housing construction and natural resources according to the actual situation.
(three) the identification of business premises
If the expropriated house has relevant functional departments such as housing construction and natural resources, and the relevant evidence such as the approval or registration of the house for business and productive use and the business license can prove that it is engaged in business activities, it is recognized as a business and productive house.
(4) Identification of commercial housing.
The expropriated house is residential, and it is impossible to provide proof that the relevant functional departments such as housing construction and natural resources have approved or registered the house as a production house. However, since the publication of the Notice of Qinyuan County People's Government on Severely Cracking down on Illegal Acts of Disturbing and Disrupting the Construction and Reconstruction of Big Counties (hereinafter referred to as the Notice) on July 5, 2002/KLOC-0, there are relevant evidences such as business licenses to prove that it is engaged in business activities.
(five) the identification of the area of the house to be expropriated
The compensation area of the expropriated house is determined on the basis of certificates such as house ownership certificate, land use right certificate, immovable property certificate and construction project planning permit. If the above-mentioned documents are not available for objective reasons, the relevant functional departments such as natural resources, housing construction and administrative examination and approval shall investigate, identify and deal with them according to law.
Verb (abbreviation of verb): Ways and standards of collection and compensation
The expropriation and compensation of houses on state-owned land take two ways: property right replacement and monetary compensation. In principle, it is mainly based on property rights replacement.
(A) the replacement of property rights
1. Non-residential houses
Expropriation of houses owned by party and government organs, institutions and state-owned enterprises shall not be compensated in principle. If there is no office space or normal production due to expropriation, the county people's government shall decide whether to give compensation or relocate.
If the expropriated land is paid for transfer, compensation shall be given according to the remaining service life after evaluation.
2. Courtyard residence
The land use area registered in the house ownership certificate, real estate certificate or land use right certificate plus the floor area of the second floor above ground is replaced by1:1; If there is no title certificate, but the land transfer fee has been paid, it shall be replaced according to the land use area identified by the relevant functional departments plus the second floor building area above ground multiplied by 1: 1; If the land transfer fee is not paid, 90% of the land use area will be replaced by two floors above the ground.
The compensation for frame, brick-concrete and brick-wood structures with three or more floors shall be 1.500 yuan/m2, 1.000 yuan/m2 and 700 yuan/m2 respectively.
The basement is compensated by 1600 yuan/m2.
Due to the compensation for the area occupied by the quadrangle, all buildings, structures and attachments on the ground floor (including gates, wells, toilets, manholes, etc. ) and supporting facilities such as groundwater, electricity, heating and gas have been included in the compensation for land occupation and will not be compensated separately.
3. Modular shell
Units that have registered property rights or paid land transfer fees but have not registered property rights shall replace the registered construction area or the construction area recognized by relevant functional departments according to 1: 1. 1; Units that have not registered their property rights and paid the land transfer fee shall be replaced with the construction area recognized by relevant functional departments according to 1: 1.09.
On the state-owned land, the brick-concrete and brick-wood structure buildings supporting the ground of the unit residence shall be subsidized at the rate of 1.000 yuan/square meter, and the basement shall be compensated at the rate of 1.600 yuan/square meter.
4. Choice of replacement room
The replacement house is a unit house, and the principle of exchanging the old for the new, signing first and selecting later is followed. According to the order of signing the agreement, choose the replacement house from the following replacement houses (faster houses) to settle the difference of house price.
(1) North of Xiqiao Street, east of Dingcheng Canal, south of Qiquan Street and west of Taiyue Middle School (old public security bureau plot). The plot covers an area of about 1.97 million square meters, with a building area of about 46,400 square meters, with * * * 3 18 sets.
(2) East of Renmin Road, south of Renzhigong Primary School, west of Qinyuan Road and north of South Outer Ring Road (Zone B of Dingxing Jiayuan). The plot covers an area of about 30,500 square meters, with a building area of about 8 1.200 square meters and 462 sets of * * *.
(3) Songjiayao Block, Chengxi Village, Qinhe Town. The plot covers an area of about 93,500 square meters, with a building area of about195,200 square meters and * * * 1356 sets.
5. Treatment of regional differences
In principle, the replacement room area selected by the expropriated person should be the closest replaceable area.
(1) If the total replaceable area of the expropriated person is greater than the total area of the replaced house, the excess part shall be paid to the expropriated person at the cost price of the replaced house of 3,657 yuan/m2.
(2) If the total replaceable area of the expropriated person does not reach the total area of the replacement house, and the area is less than 20 square meters (including 20 square meters), the expropriated person shall pay the cost price of the replacement house (3,657 yuan/square meter); More than 20 square meters, paid by the expropriated person according to the market price of the replacement house.
(two) the following circumstances will not be compensated
1. Illegal buildings and temporary buildings exceeding the approved period.
2. From the date of the announcement, the buildings, structures and appendages that have been robbed of construction shall be repaired within the scope of collection.
(three) relocation allowance, temporary resettlement transition fee, operating allowance, decoration compensation fee and incentive fee.
1. Relocation allowance
The relocation of residential houses includes moving out and moving in, with a one-time payment of 2000 yuan and two payments.
If it is recognized as a residence and converted into a business house, it shall compensate its recognized business area according to the replacement of the residence, and give a one-time relocation fee of 50 yuan/square meter for the recognized business area of the house.
2. Temporary resettlement transition fee
The collection department pays the temporary resettlement transition fee, and the expropriated person makes the transition by himself. The longest transition period is three years, counting from the day when the expropriated person signs the expropriation compensation agreement and moves out of the house until the expropriated person changes the house and delivers it.
The transition fee for temporary resettlement shall be calculated according to the approved construction area 10 yuan/m2/month, and shall be paid once every twelve months and once every six months thereafter.
After the replacement house is handed over, a six-month temporary resettlement transition fee will be subsidized separately.
3. Operating subsidies
If the house is changed into a business house, the recognized business area will be compensated according to the replacement of the house, and then the business subsidy of 500 yuan/m2 will be given to the recognized business area of the house.
4. Decoration compensation fee
Decoration compensation fees shall be assessed and determined by real estate price assessment agencies with corresponding qualifications in accordance with the house expropriation assessment methods.
5. Incentive fee
If an agreement is signed within the first time limit stipulated by the collection department and the house is relocated and vacated, rewards will be given according to the construction area of 400 yuan/square meter determined by the collection compensation agreement; If an agreement is signed within the second time limit and the vacated house is relocated, it will be rewarded according to the construction area of 200 yuan/square meter determined in the compensation agreement; No reward will be given if the time limit is exceeded.

Expropriation of urban low-income families or urban housing, the compensation area is less than 60 square meters and there is no housing elsewhere, and the housing is not less than 60 square meters to be targeted.
Seven. carry out
If the expropriated person fails to reach an agreement on expropriation compensation or the property right of the expropriated house is unknown, the expropriated subject will make a decision on expropriation compensation, and will not move within the time limit specified in the expropriation compensation decision, and fails to apply for administrative reconsideration or bring an administrative lawsuit within the statutory time limit, the expropriated subject who has made the decision on expropriation compensation will apply to the people's court for compulsory execution according to law.
Eight. job requirement
(1) Whoever practises fraud, obstructs, delays or destroys the compensation and resettlement work, stirs up troubles, publishes false statements through the Internet, disturbs social order, insults, abuses or threatens violence to hinder staff from performing official duties shall be punished in accordance with relevant laws and regulations, and criminal responsibility shall be investigated according to law if the case constitutes a crime.
(two) the staff of all relevant units should conscientiously perform their respective duties in the work of house expropriation and compensation. No unit or individual may abuse their powers, neglect their duties, engage in malpractices for selfish ends or shirk their responsibilities. In violation of the relevant provisions, shall be investigated for responsibility according to law and discipline.

(a) before the implementation of this plan, the unfinished house expropriation and renovation can be compensated according to the original plan.
(two) the identification of housing expropriation and compensation shall be decided by the relevant functional departments according to law, and other departments shall not exceed their functions and powers.
(3) The Qinyuan County Housing and Urban-Rural Construction Administration is responsible for the interpretation of this scheme.
The "first floor", "second floor" and "third floor" mentioned in this scheme refer to the first floor, second floor and third floor above ground, excluding underground.
In this scheme, the "two-story building area above ground" only refers to the two-story building area above ground, excluding the first floor above ground.
(4) This scheme shall be implemented as of the date of promulgation. Matters not covered in these Measures shall be decided by the county people's government or the relevant departments authorized by the county people's government according to the actual situation.
