Chapter III Provisions on the Administration of Government Acceptance of Water Conservancy Construction Projects

Nineteenth stage acceptance and completion acceptance shall be presided over by the host unit of completion acceptance. The host unit of completion acceptance can entrust other units to host the stage acceptance according to the needs of the work.

Special acceptance shall be conducted in accordance with the relevant provisions of the state.

Twentieth national key water conservancy projects shall be completed and accepted by the host unit in accordance with the relevant provisions of the state.

In addition to the provisions of the preceding paragraph, the Ministry of Water Resources shall be responsible for the completion and acceptance of river basin control projects and major key river basin construction projects determined by the state.

In addition to the provisions of the preceding two paragraphs, other water conservancy construction projects, the completion acceptance of the host unit in accordance with the following principles:

(a) the Ministry of Water Resources or the river basin management agency is responsible for the preliminary design approval of the central project, and the host unit for the completion acceptance is the Ministry of Water Resources or the river basin management agency;

(2) For local projects whose preliminary design is examined and approved by the Ministry of Water Resources, the central investment is the mainstay, and the host unit for completion acceptance is the Ministry of Water Resources or the river basin management institution, and the host unit for completion acceptance is the provincial people's government (or its entrusted unit) or the water administrative department of the provincial people's government (or its entrusted unit);

(three) the local project is responsible for the examination and approval of the preliminary design, and the host unit of the completion acceptance is the water administrative department of the provincial people's government (or its entrusted unit).

If the host unit of the completion acceptance is the Ministry of Water Resources or the river basin management institution, it may co-chair with the provincial people's government or relevant departments according to the actual situation of the project.

The host unit of the completion acceptance shall be clear in the approval document of the preliminary design of the project. Twenty-first hub project diversion (river closure), reservoir storage and other stages of acceptance, involving resettlement, it should complete the corresponding special acceptance of resettlement.

Before the project is completed and accepted, special acceptance shall be conducted for environmental protection, soil and water conservation, resettlement and project files in accordance with relevant state regulations. With the consent of the relevant departments, special acceptance can be carried out together with the completion acceptance.

Article 22 The project legal person shall, within 10 working days from the date of receiving the special acceptance document, submit the special acceptance document to the organizer for the record.

Special acceptance documents are part of stage acceptance or completion acceptance documents. Twenty-third project construction has entered a critical stage, including water diversion (river closure), reservoir storage, water diversion (regulation) and drainage project storage, and the start-up of the first (last) unit. , should organize the stage acceptance.

According to the actual needs of project construction, the host unit of completion acceptance can add a stage acceptance link.

The acceptance committee of the twenty-fourth stage acceptance is composed of the host unit, engineering quality supervision institutions and safety supervision institutions, representatives of operation management units and relevant experts; When necessary, the local people's government and relevant departments where the project is located shall be invited to participate.

The project organizer is the acceptance unit and should send representatives to participate in the stage acceptance work.

Twenty-fifth large water conservancy projects in the stage before acceptance, according to the need for technical pre-acceptance. Technical pre-acceptance shall refer to the provisions of the fourth section of this chapter on the pre-acceptance of completed technology.

Twenty-sixth after the acceptance of reservoir water storage, the project legal person shall complete the water storage safety appraisal in accordance with the relevant provisions.

Twenty-seventh acceptance of the host unit shall, within 30 working days from the date of acceptance of the stage, make the stage acceptance certificate, send it to the units participating in the acceptance, and submit it to the completion acceptance host unit for the record.

The stage acceptance certificate is the reference material for completion acceptance. Article 28 The completion acceptance shall be carried out within 1 year after the construction project is completely completed and reaches certain operating conditions. If the completion acceptance cannot be carried out on schedule, the period may be appropriately extended with the consent of the host unit of the completion acceptance, but the longest period shall not exceed 6 months. If the completion acceptance cannot be carried out within the time limit, the project legal person shall make a special report to the host unit of the completion acceptance.

Twenty-ninth completed financial statements shall be reviewed and audited by the host unit of completion acceptance. Completion acceptance can only be carried out after 15 days after the final accounts of completed projects are audited.

Thirtieth projects have the conditions for completion and acceptance, the project legal person shall apply for completion and acceptance, and after examination by the project legal person acceptance supervision and management organ, report to the organizer for completion and acceptance. The host unit of the completion acceptance shall decide whether to agree to the completion acceptance within 20 working days from the date of receiving the application for completion acceptance.

Thirty-first completion inspection and acceptance shall be carried out in principle in accordance with the standards and contents determined in the approved preliminary design.

If a project has an overall preliminary design and a single project preliminary design, it shall be carried out in principle according to the standards and contents of the overall preliminary design, or the single project may be completed and accepted first, and finally the overall completion and acceptance shall be carried out according to the overall preliminary design.

If the project has an overall feasibility study but no overall preliminary design but a preliminary design of a single project, in principle, it should be completed and accepted according to the standards and contents of the preliminary design of a single project.

For projects that have a long construction period or cannot be implemented for some reasons, some completed projects can be completed and accepted by individual projects or stages.

Thirty-second completion acceptance is divided into two stages: pre-acceptance of completion technology and completion acceptance.

Article 33 Before the pre-acceptance of the completion technology of a large-scale water conservancy project, the project legal person shall conduct the technical appraisal of the completion acceptance in accordance with the relevant provisions of the project construction. Before the pre-acceptance of the completion technology of medium-sized water conservancy projects, the host unit of the completion acceptance can decide whether to carry out the technical appraisal of the completion acceptance according to the needs.

Thirty-fourth technical pre-acceptance of completion is the responsibility of the technical pre-acceptance expert group composed of the host unit of completion acceptance and relevant experts.

Representatives of engineering contractors shall participate in technical pre-acceptance, report and answer relevant questions.

Article 35 The completion acceptance committee is composed of representatives from the host unit of completion acceptance, relevant water administrative departments and river basin management institutions, relevant local people's governments and departments, engineering quality supervision institutions and safety supervision institutions, engineering operation management units and relevant experts. Representatives of project investors may participate in the completion acceptance committee.

Thirty-sixth completion inspection and acceptance of the host unit may, according to the needs of completion inspection and acceptance, entrust a project quality inspection agency with corresponding qualifications to test the quality of the project.

Article 37 The project legal person shall be fully responsible for all the preparatory work before the completion acceptance. Design, construction, supervision and other engineering contractors should make preparations for acceptance and cooperate with them, send representatives to attend the completion acceptance meeting, be responsible for answering the questions raised by the acceptance Committee, and sign the completion acceptance certificate as the acceptance unit.

Thirty-eighth completion inspection and acceptance of the host unit shall, within 30 working days from the date of completion acceptance, make a certificate of completion acceptance and send it to the relevant units.

The certificate of completion acceptance is the certificate for the project legal person to complete the project construction task. Thirty-ninth project legal persons and other relevant units shall properly handle the problems left over from the completion acceptance and complete the finishing work according to the requirements of the completion acceptance certificate.

After the problems left over from the acceptance are handled and the completion acceptance is qualified, the project legal person shall submit the handling situation and acceptance results to the host unit of the completion acceptance.

Fortieth if the project has passed the completion acceptance, the problems left over from the acceptance have been handled, and the finishing work has been completed and passed the acceptance, the host unit of the completion acceptance will issue the project completion certificate to the project legal person.

The format of the project completion certificate shall be uniformly formulated by the Ministry of Water Resources.

Forty-first project legal person is different from the project operation and management unit, the project should be handed over in time after completion and acceptance.

After the project is handed over, the project legal person and other contractors shall bear the subsequent related quality responsibilities in accordance with the provisions of laws and regulations and the contract. If the project legal person is revoked, the department that revoked the project legal person shall bear the relevant responsibilities.
