National epidemic refund policy

Legal Analysis: Refund of tour groups during the epidemic: On February 26th, the Tourism Quality Supervision and Management Office of the Ministry of Culture and Tourism issued "Several Opinions on Properly Handling Complaints about Epidemic Tourism" (hereinafter referred to as "Opinions"), clarifying that if the contract cannot be fulfilled or can not be continued due to force majeure during the epidemic, the tourism enterprise shall return the rest to the tourists after deducting the actual expenses and irreparable expenses.

Legal basis: "Several Opinions on Properly Handling Complaints about Epidemic Tourism" adheres to six principles in the work of canceling travel contracts due to epidemic situation. First, tourism enterprises should return the balance after deducting actual expenses and irreparable expenses to tourists; Second, domestic tours should be refunded according to the refund policy announced by the transportation and tourism departments of the country or provinces and cities, and according to the refund policy announced by large-scale tourism platform enterprises and scenic spots; Third, outbound tourism should be refunded according to the refund policy announced by the relevant destination country or region. For outbound travel products that have not yet issued a refund policy in the destination country or region, the tourism enterprise should try its best to coordinate the refund with the tour agent and the performance assistant; Fourth, tourism enterprises should provide clear proof of expenses and non-refundable expenses to ensure tourists' right to know; Fifth, it is difficult to reach an agreement on complaints about outbound travel involving a large amount. It is suggested that tourists solve the dispute of withdrawing from the group and refunding fees through judicial channels; Sixth, tourism enterprises have the obligation to receive tourists' consultation and make explanations.
