Interim Provisions on the Establishment of Economic Entities by the Agricultural Department of Ningxia Hui Autonomous Region

Article 1 In order to encourage the agricultural sector to set up economic entities, promote the construction of agricultural socialized service system in our region, and promote the reform of government institutions, these Provisions are formulated in accordance with the Decision of the Central Committee on Further Strengthening Agricultural and Rural Work and the Notice of the State Council on Strengthening the Construction of Agricultural Socialized Service System, combined with the actual situation in our region. Article 2 The agricultural departments mentioned in these Provisions refer to the administrative departments and institutions of agriculture, forestry, animal husbandry, water conservancy and meteorology at all levels in our district, as well as agricultural colleges, technical secondary schools and scientific research institutions (hereinafter referred to as agricultural administrative institutions). Article 3 Agricultural administrative institutions should set up economic entities according to local conditions, face rural areas, focus on setting up service-oriented economic entities that provide farmers with prenatal, mid-natal and post-natal services, gradually carry out whole-process and serialized services, and take the road of one-stop production, supply and marketing and integration of agriculture, industry and commerce. At the same time, other types of economic entities can be established according to the market and local resources. Article 4 The establishment of economic entities by agricultural administrative institutions should be closely integrated with the reform of government institutions, and gradually realize the "transfer of organs to cadres". Article 6 The economic entities established by agricultural administrative institutions (hereinafter referred to as agricultural economic entities) are uncertain in specifications and staffing, and the personnel are mainly adjusted and transferred from within agricultural administrative institutions. Professionals who really need to be introduced can be recruited from the society.

Encourage agricultural administrative institutions to set up economic entities in an organized manner. Within three years, economic entities can "have one team and two brands", and the nature of the original unit will remain unchanged, the original funds will not be reduced, and the identity of the original personnel will remain unchanged. If the adjustment is transferred to economic entities and administrative institutions, it can be implemented with reference to the provisions of this paragraph. Article 7 The funds needed by agricultural economic entities can be raised independently by borrowing goods, and the interest rate of fund-raising can be two to three percentage points higher than the interest rate of bank deposits. This money can be refunded before tax. Article 8 People's governments at all levels and their relevant departments shall actively support agricultural administrative institutions to set up economic entities, and give preferential policies to all kinds of service-oriented agricultural economic entities that serve farmers, engage in planting, planting and processing agricultural and sideline products.

(1) When registering, the administrative department for industry and commerce may reduce the registered capital by 50% within the prescribed limit.

(2) In the initial stage of establishing an economic entity, a certain proportion of the existing funds for supporting agriculture can be appropriately used as the start-up funds for establishing an economic entity.

(3) Comprehensive departments such as planning, science and technology, finance and agricultural construction should increase the infrastructure construction of agricultural economic entities such as technical equipment, storage, processing, transportation and marketing year by year.

(4) China Agricultural Bank provides convenience for agricultural economic entities to open accounts and settle accounts. Priority will be given to those who meet the loan conditions, and interest will be calculated according to the benchmark interest rate, and the proportion of the loan's own funds will be appropriately reduced.

(five) in line with the relevant provisions of the agricultural economic entity tax relief, income tax, transportation energy fund and budget adjustment fund shall be exempted within three years. If it is still difficult to pay taxes after the expiration of the tax exemption period, the tax exemption or reduction may be continued upon approval. The tax relief can only be used to supplement the production economic development fund.

(6) The departments of transportation, land, electric power and personnel should give priority to the transportation and land acquisition of agricultural economic entities, give priority to ensuring electric power, and give priority to the allocation of needed talents.

(VII) The agricultural resources department of the supply and marketing cooperatives wholesales a certain share of the franchised agricultural means of production to agricultural economic entities according to the needs of agricultural technology popularization, and the agricultural economic entities sell them to farmers at the prescribed retail price by combining technology and materials. Agricultural economic entities can directly organize the supply and marketing of agricultural means of production other than franchise. Ninth agricultural economic entities that provide paid services to farmers should improve the quality and efficiency of services according to the needs of farmers, so that farmers can accept services voluntarily. Service charges should follow the principles of rationality, capital preservation and low profit, and implement the charging standards stipulated by the price department. The economic benefits brought to farmers through services should be significantly higher than the service fees paid by farmers. Article 10 The income from production and operation of agricultural economic entities shall be mainly used to improve production and operation conditions and develop socialized agricultural services. After deducting the taxes payable, 40% of the profits will be used as the production and operation development fund, 30% as the welfare fund, 20% as the reward fund, and 65,438+00% will be handed over to the competent authorities as the reserve fund within three years. Reserve funds can only be used to set up economic entities. Article 11 Agricultural economic entities practice enterprise management, independent accounting, self-management, self-financing and manager (factory director) responsibility system, adhere to the principle of distribution according to work and linking service quality with economic benefits, and the income of their personnel can be higher than that of administrative institutions on the premise that the profits of economic entities are relatively stable. Twelfth administrative departments of agricultural economic entities shall guide and supervise the development direction, business direction and service function of economic entities, but shall not interfere with their normal production and business activities. After the reserve fund is drawn in proportion, it shall not increase the cost and its fixed assets shall not be transferred.

Agricultural economic entities shall establish and improve the financial system, and consciously accept the inspection and supervision of the competent departments and the departments of finance, auditing and taxation.
