Chapter I General Provisions Article 1 In order to promote the construction and development of Lhasa Economic and Technological Development Zone in Tibet, these Measures are formulated in accordance with the provisions of relevant laws and regulations. Article 2 These Measures shall apply to the Lhasa Economic and Technological Development Zone in Tibet (hereinafter referred to as the Development Zone) approved by the State Council.

The Development Zone is located in Dongga Town, Duilong Deqing County, Lhasa City, with a planned area of 5.46 square kilometers. Article 3 The autonomous region shall set up a leading group for development zones to lead and coordinate major issues in the development zones. The people's government where the development zone is located shall support all the work of the development zone and create a good external environment for its development.

Water, electricity and gas needed for production, operation and life in the development zone should be included in the plan of the autonomous region to ensure supply. Article 4 The Development Zone adheres to the policy of focusing on attracting foreign investment, focusing on industrial projects, focusing on exports, and devoting itself to developing high and new technologies. Actively introduce capital, advanced technology, advanced equipment and scientific management methods to play a window role in an open economy.

The Development Zone shall establish an efficient management mechanism that meets the requirements of the socialist market economic system, build a sound infrastructure, gradually improve the comprehensive service functions, and create a good investment environment and production, operation and living conditions for investors. Article 5 Enterprises, institutions, other economic organizations and individuals at home and abroad (hereinafter referred to as investors) are encouraged to invest and set up high-tech enterprises, advanced technology enterprises and product export enterprises in the Development Zone.

Investors are encouraged to invest in industrial projects that conform to the industrial orientation of the state and the autonomous region, and vigorously develop characteristic industries, advantageous industrial projects and service projects.

Encourage investors to invest in energy, transportation and other infrastructure and public utilities projects in the development zone. Article 6 Projects with backward technology and equipment that do not meet the relevant environmental protection standards and industrial policy standards of the state and the autonomous region and other projects prohibited by the state and the autonomous region shall not be established in the Development Zone. Article 8 The investment, income and other lawful rights and interests of investors in the Development Zone shall be protected by law.

All units and individuals in the Development Zone must abide by the laws and regulations of the state and these measures, and shall not harm the interests of the state and society. Chapter II Organizational Structure and Responsibilities Article 9 The Development Zone Management Committee (hereinafter referred to as the Development Zone Management Committee) shall be established in the Development Zone to exercise administrative functions at the prefecture (city) level under the authorization of the people's government of the autonomous region and exercise unified leadership and management over the Development Zone. Tenth Development Zone Management Committee shall exercise the following functions and powers:

(a) the implementation of national laws, regulations and industrial policies;

(two) the preparation of the overall planning of the development zone and the economic and social development plan, and organize the implementation after the approval of the people's government of the autonomous region;

(three) according to the authorization of the people's Government of the autonomous region, examine and approve all kinds of investment projects in the development zone;

(four) in accordance with the overall planning of the development zone, the land requisition and development of the development zone and the transfer, transfer and lease of the land use right shall be under unified management;

(five) unified planning, construction and management of infrastructure and public facilities in the development zone;

(six) to manage the import and export trade and other foreign-related economic activities in the Development Zone;

(seven) to manage the administrative work of finance, taxation, industry and commerce administration, labor and social security, personnel, statistics, prices, urban construction, real estate, environmental protection, sanitation, public security, fire protection, transportation, judicial administration and family planning in the Development Zone;

(eight) the establishment and management of the development zone of culture, education, health, sports and other social welfare undertakings;

(nine) according to the authorization of the people's government of the autonomous region, examine and approve the franchise rights of various special or franchise projects of enterprises and institutions in the development zone;

(ten) to coordinate the work of the branches or agencies of the relevant departments in the development zone;

(eleven) to ensure that investors in the development zone operate independently according to law;

(twelve) to formulate and organize the implementation of administrative regulations of the development zone;

(thirteen) to exercise other functions and powers granted by the people's Government of the autonomous region. Article 11 The administrative committee of the Development Zone may set up necessary functional institutions to manage the affairs of the Development Zone. Article 12 The financial, insurance, foreign exchange management, customs, quality and technical supervision of the Development Zone shall be handled by the relevant departments or their branches located in the Development Zone. Chapter III Investment and Operation Article 13 To establish an enterprise or institution in the Development Zone, an application shall be submitted to the Development Zone Management Committee, and after examination and approval, the land use, industrial and commercial registration and tax registration procedures shall be handled according to law. Article 14 To set up enterprises and institutions in the Development Zone, capital shall be invested and construction shall be started within the prescribed time limit. If it is unable to invest capital or start construction on schedule, it shall apply for extension of approval in advance. Failing to apply for extension within the time limit, the land use certificate and business license shall be cancelled according to law. Fifteenth enterprises in the development zone shall enjoy the autonomy in business decision-making, product sales, organization setting, labor employment and wage distribution according to law. Article 16 Enterprises in the Development Zone shall establish complete accounting books, submit accounting statements and annual inspection reports to the relevant departments of the Development Zone in accordance with regulations, and accept the supervision of the financial, taxation and industrial and commercial administrative departments of the Development Zone.

The annual accounting statements of enterprises in the Development Zone must be verified by accountants or auditors registered in China.
