Measures of Shenyang Municipality on Supervision and Administration of Safety Facilities of Construction Projects

Article 1 In order to strengthen the supervision and management of safety facilities of construction projects, prevent and reduce production safety accidents, and ensure the safety of employees' lives and property, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production and the Measures for the Supervision and Management of Safety Facilities of Construction Projects in Liaoning Province, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the construction, supervision and management of safety facilities for new construction, renovation and expansion projects (hereinafter referred to as construction projects) of production and business units within the administrative area of this Municipality.

Where there are other provisions in laws, regulations and rules on the construction of safety facilities of construction projects and their supervision and management, those provisions shall prevail. Article 3 Safety facilities of construction projects refer to the equipment, facilities, devices, structures and other technical measures used by production and business units to prevent production safety accidents. Article 4 The municipal, district and county (city) safety production supervision and management departments shall be responsible for the supervision and management of safety facilities of construction projects approved, approved or filed by the relevant competent departments of the people's government at the corresponding level.

Development and reform, urban and rural construction, economy and informatization, foreign trade and economic cooperation, quality supervision and other departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of safety facilities in construction projects. Article 5 Production and business operation entities shall be responsible for the construction of safety facilities of construction projects. The safety facilities of a construction project must be designed, constructed and put into production and use simultaneously with the main project. Article 6 During the feasibility study of a construction project, the production and business operation entity shall make a comprehensive analysis of its safety production conditions and facilities, and prepare a safety condition demonstration report. The safety condition demonstration report shall include the following contents:

(a) the inherent dangers and harmful factors of the construction project and their influence on safety production;

(two) the interaction between the construction project and the surrounding facilities (units) in production, business activities and residents' lives;

(three) the impact of local natural conditions on the safety production of construction projects;

(4) Other contents that need to be demonstrated. Article 7 When conducting feasibility study, production and business operation entities shall conduct safety pre-evaluation on the following construction projects with high safety risks:

(a) municipal key construction projects in chemical industry, metallurgy, nonferrous metals, building materials, machinery, light industry, textile, tobacco, commerce, military industry, highway, water transport, rail transit, electric power and other industries;

(two) the use of dangerous chemicals (including monitoring chemicals, dangerous chemicals belonging to drugs and pesticides) and the disposal of abandoned dangerous chemicals;

(3) Construction projects in steel and nonferrous metallurgy industries;

(four) construction projects that can produce explosive dust in the production process of grain, feed, plastics and wood processing;

(five) construction projects with major fire hazards such as paper and paper products industry, plastic products industry and rubber products industry;

(6) Construction projects involving complete sets of chemical equipment, pressure vessels and pipelines with inflammable, explosive, toxic and harmful media, large-scale heating and power generation boilers and pipelines;

(seven) the production and use of toxic substances, the degree of occupational exposure to toxic substances is level one, level two and level three;

(8) Factories and warehouses with Class A, B and C fire risks and construction projects involving Class A and B production sites;

(nine) other construction projects with high security risks.

Safety pre-evaluation may not be carried out for construction projects with less safety risks as stipulated by laws, regulations and standards. Article 8 A production and business operation entity shall entrust a safety evaluation institution with corresponding qualifications to conduct safety pre-evaluation of its construction projects. The safety pre-evaluation report of a construction project shall be filed with the safety production supervision and management department. Article 9 In the preliminary design of a construction project, the production and business operation entity shall entrust a design unit with corresponding qualifications to design the safety facilities of the construction project and prepare a special article on the design of safety facilities. The design of safety facilities for construction projects shall include the following contents:

(1) design basis;

(2) General situation of construction projects;

(3) Architecture and site layout;

(four) the analysis of the dangerous and harmful factors involved in the construction project, the degree of danger and harm and the safety of the surrounding environment;

(five) analysis of the advanced nature and reliability of technology, equipment and facilities;

(6) Preventive and emergency rescue measures for possible accidents;

(seven) a description of the adoption of safety countermeasures and suggestions in the safety pre-evaluation report, which belongs to a construction project with great safety risks;

(eight) safety facilities and measures taken;

(9) Conclusions and suggestions;

(ten) the general plan of the construction project. Article 10 After the design of safety facilities for construction projects with high safety risks is completed, the production and business operation entity shall submit an application for review to the safety production supervision and management department and submit the following documents:

(a) the relevant competent departments for examination and approval, approval or filing documents;

(2) Safety pre-evaluation report;

(3) Special articles on safety facilities design of construction projects.

The safety production supervision and management department shall, within 5 working days, assign relevant personnel or organize experts to review the application materials for the special review of the safety facilities design of construction projects. Those who pass the examination shall be awarded the design audit of safety facilities of construction projects.
