Xi'an Urban Nightscape Lighting Management Measures (2020 revision)
Article 1: In order to strengthen the management of urban night scene lighting, standardize night scene lighting behavior, beautify the city night scene, and display the image of Xi'an as a historical and cultural city, these measures are formulated in accordance with the "Urban Lighting Management Regulations" and in conjunction with the actual situation of this city. Article 2 These Measures shall apply to the planning, construction, maintenance, use and management of nightscape lighting in urban built-up areas such as Xincheng District, Beilin District, Lianhu District, Yanta District, Weiyang District, Baqiao District and Development Zone. Article 3 The term "night scene lighting" as mentioned in these Measures refers to the decorative lighting used outdoors for the purpose of beautifying the city's night scene through artificial light. Article 4 The municipal urban management department is the department in charge of urban nightscape lighting work in this city and is responsible for the construction, maintenance, use, supervision and management of nightscape lighting facilities in this city.
The District People's Government and the Development Zone Management Committee are specifically responsible for the construction, maintenance, use, supervision and management of urban nightscape lighting facilities within their jurisdiction.
Resource planning, development and reform, housing and construction, cultural relics, public security, finance, transportation, electricity and other departments should do a good job in urban nightscape lighting-related work in accordance with their respective responsibilities. Article 5 Urban nightscape lighting shall follow the principles of unified planning, hierarchical responsibility, scientific setting, energy conservation and environmental protection, outstanding characteristics, harmony and beauty. Article 6: Encourage citizens, legal persons and other organizations to participate in the construction of nightscape lighting facilities in various forms. Article 7 The municipal urban management department shall, in accordance with the overall urban plan, work with the municipal resource planning, development and reform, housing and construction and other departments to prepare a special plan for urban nightscape lighting, and submit it to the Municipal People's Government for approval, and then the municipal urban management department shall organize and implement it.
The people's governments of each district and the development zone management committee shall prepare urban nightscape lighting zoning plans based on the city's special urban nightscape lighting plan and submit them to the municipal urban management department for filing. Article 8 The following buildings (structures) or places should be equipped with night lighting facilities:
(1) Buildings (structures) on both sides of prosperous commercial districts and main urban streets;
(2) Landscape lighting places for public places such as city squares, greening, sculptures, fountains, stations, bridges, scenic spots, rivers and lakes, and coastal landscape areas, as well as temporary major events;
< p>(3) Public cultural and sports facilities such as stadiums (venues), theaters, museums, cultural relics protection units at or above the municipal level;(4) Urban landmark buildings (structures), main streets Non-residential buildings (structures) more than 50 meters away;
(5) Advertising light boxes and commercial plaques on main streets;
(6) Special project for city night scene lighting Other places determined by planning and zoning plans.
The specific scope of the buildings (structures) and urban landscape areas in the city’s prosperous commercial areas, on both sides of the main streets, shall be determined by the municipal urban management department in conjunction with the resource planning and other departments, and shall be announced after approval by the Municipal People’s Government . Article 9 Nightscape lighting facilities in city squares, bridges, cultural relics scenic spots and other buildings (structures) or places managed by government departments shall be installed by their management departments; other buildings (structures) and places that should be equipped with nightscape lighting facilities shall be installed by their management departments. The owner or manager is responsible for setting up nightscape lighting facilities. Article 10 The installation of urban nightscape lighting facilities shall comply with the municipal special planning for urban nightscape lighting and comply with the following regulations:
(1) Patterns, shapes, specifications and proportions shall be coordinated with the buildings (structures) and the surrounding environment ;
(2) Use new technologies, new processes, new materials, and new light sources to avoid light pollution; night lighting facilities on both sides of the road must not affect traffic safety;
(3) Comply with Environmental protection requirements include fire protection, wind protection, leakage prevention and other safety facilities;
(4) Adopt a graded lighting mode for weekdays, general holidays, and major holidays (celebrations). Article 11 The design and construction of urban nightscape lighting facilities shall comply with the technical specifications, standards and construction operating procedures for nightscape lighting facilities. Units engaged in the design and construction of urban nightscape lighting facilities should have corresponding qualifications. Article 12 For newly built, renovated or expanded buildings (structures) or urban squares, the construction unit shall construct supporting urban nightscape lighting facilities in accordance with these Measures and the special planning and zoning planning for urban nightscape lighting. Urban nightscape lighting facilities should be designed, constructed and put into use at the same time as the main project, and the required costs should be included in the construction cost.
If no supporting nightscape lighting facilities were built before the implementation of these Measures or the existing urban nightscape lighting facilities do not comply with these Measures and the special urban nightscape lighting plan, the owner or manager shall carry out construction or renovation.
Article 13 When reviewing planning and construction matters for new construction, reconstruction, or expansion of buildings (structures), the resource planning department shall review the attached nightscape lighting facility project plan based on the special urban nightscape lighting plan and zoning plan; housing construction The administrative department shall review the construction content of the attached nightscape lighting facilities and check the responsibility letter for the simultaneous construction of nightscape lighting facilities signed by the construction unit and the district people's government or the development zone management committee.
The urban management department should inspect and accept the nightscape lighting facilities of the construction project during the comprehensive acceptance of the completion of the construction project, and urge the construction unit to put the nightscape lighting facilities into use at the same time as the main project. Article 14 The nightscape lighting design plan for large-scale and iconic buildings (structures) in the city, as well as important cultural relics, scenic spots, and squares shall be demonstrated by an expert committee. After preliminary review of the plan by the urban management department, it shall be reported to the resource planning, housing and construction and other departments. For review, major nightscape lighting projects should be submitted to the Municipal People's Government for review and approval.
