Regulations of Tangshan Municipality on Property Management

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of all parties involved in property management, and improve the living and working environment of the people, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management activities and their supervision and management within the administrative area of this Municipality.

The term "property" as mentioned in these Regulations refers to all kinds of houses and their facilities, equipment and places that have been built and put into use. Property management refers to the maintenance, conservation and management of buildings, structures, supporting facilities, equipment and related sites in the property management area by the owners through others or by themselves, so as to maintain the environmental sanitation and related order in the property management area.

Property management is divided into standard property management and quasi-property management. Standardizing property management refers to the property management conducted by the owners and property service enterprises in the property management area in accordance with the property service contract. Quasi-property management refers to all other forms of property management except standard property management. Article 3 People's governments at all levels should create conditions to gradually implement standardized property management for residential and non-residential properties, advocate and guarantee owners to choose property service enterprises through an open, fair and just market competition mechanism, implement preferential policies, and promote the healthy development of the property management industry.

People's governments at all levels should promote the maintenance, conservation, renewal and transformation of the parts and facilities used in old residential areas, and constantly improve the living environment of residents. Fourth city housing and urban and rural construction administrative departments responsible for the guidance and supervision of the city's property management activities.

County (city) District People's government housing and urban and rural construction administrative departments to guide and supervise the property management activities within their respective jurisdictions.

Planning, urban management, greening, environmental protection, health, public security, fire protection, price, industry and commerce, taxation, civil affairs, finance, postal services, civil air defense and other relevant departments shall, according to their respective responsibilities, do a good job in the relevant work of property management activities within their respective administrative areas.

Neighborhood offices and Township People's governments specifically guide the establishment of the owners' congress and the election of the owners' committee within their respective jurisdictions, guide and supervise the owners' congress and the owners' committee to perform their duties according to law, mediate property management disputes, and coordinate the relationship between property management and community management.

Neighborhood (village) committees shall assist and cooperate with sub-district offices and township people's governments to carry out property management-related work. Article 5 The realty service industry association shall strengthen the self-discipline management of the industry according to law, standardize the service behavior of the industry, maintain market order and fair competition, urge realty service enterprises and their employees to operate and serve in good faith according to law, and promote the healthy development of the industry. Chapter II Owners and Owners' Congress and Owners' Committee Article 6 The owner of a property is the owner. The owner implements * * * the same management for the * * part of the property management area. The following matters shall be decided by the Owner * * *:

(a) to formulate or modify the management statute and the rules of procedure of the owners' congress;

(two) to elect or replace the members of the owners' committee;

(three) to decide or change the property management mode, service content, service standard and charging scheme;

(four) the selection and dismissal of property services companies;

(five) to raise, manage and use special maintenance funds;

(six) to apply for the renovation of buildings and their ancillary facilities;

(seven) to apply for the division or merger of the property management area;

(eight) other property management matters stipulated by laws, regulations and rules.

Decisions on items (5) and (6) shall be approved by the owners whose exclusive parts account for more than two-thirds of the total building area and more than two-thirds of the total; The decision in Item (7) shall be approved by the owners in the original property management area, and the exclusive parts in the property management area need to be divided or merged, accounting for more than two-thirds of the total construction area and more than two-thirds of the total; Decisions on other matters shall be subject to the consent of the owners whose exclusive parts account for more than half of the total area of the building. Owners in the same property management area shall set up owners' meetings and elect owners' committees under the guidance of the county (city) district housing and urban-rural construction administrative departments, sub-district offices or township people's governments where the property is located. If it is not convenient to convene all owners' meetings due to the large number of owners, owners' representatives may be elected to participate in the owners' meeting in units, buildings or a certain construction area and the number of owners. If the number of owners is small and all owners agree unanimously, it is decided not to set up the owners' meeting, and the owners will perform the duties of the owners' meeting and the owners' committee.

The division of property management areas shall be determined by the administrative department of housing and urban and rural construction of the county (city) district according to the scope of the red line map determined by the construction land planning permit, and taking into account the factors such as property facilities and equipment, building scale, community construction and urban road planning.

If a property is developed and built by stages or by two or more construction units, and its supporting facilities and equipment are used by * * * *, it shall be included in a property management area; If the supporting facilities and equipment can be used separately, the property management area can be designated separately.
