The management of urban public facilities such as roads, electric power, communications, radio and television, road traffic safety, fire protection, national defense and flood control shall be implemented in accordance with the provisions of relevant laws and regulations. Third municipal administrative departments are responsible for the formulation, planning, industry guidance, supervision and inspection of municipal facilities management standards and municipal facilities directly managed as determined by the Municipal People's Government.
The municipal administrative departments of counties (autonomous counties) are responsible for the administration of municipal facilities in addition to the municipal facilities directly managed.
The specific measures for the management of urban municipal facilities shall be formulated by the people's governments of counties (autonomous counties).
Urban and rural planning, construction, gardening, water conservancy, transportation, public security and other administrative departments shall do a good job in the management of municipal facilities in accordance with the division of responsibilities. Fourth municipal facilities management should adhere to the principles of overall planning, scientific support, coordinated development, high efficiency and convenience, and strive to improve the level of modern management. Article 5 The planning, construction and management of municipal facilities shall establish and improve the system of information disclosure and public participation, and fully listen to and respect public opinions.
Units and individuals have the right to use municipal facilities according to law and the obligation to protect municipal facilities, and have the right to discourage and report acts that damage municipal facilities in violation of these regulations. Chapter II Planning and Construction Article 6 The municipal administrative department shall, according to the needs of urban economic and social development and the requirements of the overall planning of cities (towns), work out the professional planning of municipal facilities in conjunction with the administrative departments of development and reform, urban and rural planning, construction, land and housing management, and organize the implementation after being approved by the people's government at the same level.
The professional planning of municipal facilities should follow the principle of urban and rural planning and rational layout, pay attention to maintaining traditional features, highlight local characteristics, and create a livable environment.
The revision of the professional planning of municipal facilities shall be carried out in accordance with the original examination and approval procedures. Seventh municipal facilities professional planning should follow the overall urban and rural planning, and linked with the regulatory detailed planning. When preparing a detailed control plan, the opinions of the municipal administrative department shall be sought in writing.
Urban water supply, power supply, gas supply, fire protection, flood control, communication, landscaping and road traffic management and other public facilities professional planning should be coordinated with the municipal facilities professional planning. Article 8 In the development of new urban areas and the transformation of old cities, the municipal facilities construction projects determined in urban planning shall be included in the comprehensive development and transformation plan for supporting construction.
The construction of municipal facilities in the development of new urban areas should be designed, constructed and accepted simultaneously with the basic construction projects as a whole; The transformation of the old city should adapt to local conditions, make rational use of existing resources, and realize the organic unity of municipal facilities and original buildings.
The construction of municipal facilities shall implement the bidding system in accordance with the relevant provisions of the state and this Municipality. Article 9 The design and construction of municipal facilities construction projects shall comply with the technical standards, technical specifications and operating rules of the state and this Municipality, and shall be designed and constructed by units with corresponding qualifications, and shall be subject to the supervision and inspection of the competent construction department. Tenth construction projects involving the safety of municipal facilities, the competent department of urban and rural planning administration shall solicit the opinions of the municipal administrative department in writing when reviewing the planning scheme.
For municipal environmental sanitation construction projects, the construction administrative department shall solicit the opinions of the municipal administrative department in writing during the preliminary design review. Eleventh municipal facilities construction projects shall be completed and accepted in accordance with the relevant provisions of the state, and a complete file shall be established. Without acceptance or unqualified acceptance of municipal facilities shall not be handed over to put into use.
After the completion of the acceptance of municipal facilities handed over to the municipal administrative department, the construction unit shall establish and improve a complete file management system, provide municipal facilities engineering basic technical data, project acceptance, project warranty and other information, and go through the transfer procedures after being audited by the municipal administrative department. Chapter III Maintenance and Repair Article 12 The maintenance and repair of municipal facilities shall implement the relevant technical standards and specifications of the state and this Municipality, strengthen daily inspections, conduct regular maintenance and inspection, and immediately rectify any problems found to ensure the normal use of municipal facilities.
The maintenance quality of municipal facilities shall be implemented in accordance with the provisions of the state and this Municipality on the quality management of construction projects. Thirteenth municipal facilities maintenance should introduce market competition mechanism and implement bidding.
Municipal facilities maintenance management unit shall have corresponding qualifications and professional and technical personnel, equipped with special maintenance equipment. Fourteenth municipal facilities maintenance management units are responsible for the maintenance of municipal facilities under their respective management.
Municipal facilities invested and built by social units shall be maintained by the construction unit before handover.
Municipal facilities that are franchised shall be maintained by the management unit in accordance with the franchise contract and relevant regulations.
