Chapter 1 General Provisions Article 1 In order to accelerate the development of export-oriented economy in Futian Free Trade Zone of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone), further create a good investment environment, and protect the legitimate rights and interests of investors, in accordance with relevant national laws, This Regulation is formulated based on the basic principles of administrative regulations and in combination with the actual situation of the Special Administrative Region. Article 2 Futian Bonded Zone (hereinafter referred to as the Bonded Zone) is a special economic zone established with the approval of the State Council.
The bonded zone is located in Futian District within the Shenzhen Special Economic Zone. It starts from Huanggang Port in the east, ends on the east bank of Xinzhou River in the west, runs along the north bank of Shenzhen River in the south, and reaches Fuqiang Road in the north. It is fully closed and managed.
The scope of the living area in the bonded area (hereinafter referred to as the living area) is determined by the municipal government. Article 3 The bonded zone mainly develops international trade, warehousing industry, high-tech and technologically advanced industries, and accordingly develops tertiary industries such as finance, business services, transportation, communications, and information.
Bonded zones can establish social intermediary service agencies in accordance with the law to provide services to enterprises in the bonded zone. Article 4 Legal persons, other economic organizations and individuals in the bonded zone must abide by the laws and regulations of the People's Republic of China.
The legitimate rights and interests of investors in the bonded zone are protected by law. Chapter 2 Management Organization and Responsibilities Article 5 The Shenzhen Free Trade Zone Administration Bureau (hereinafter referred to as the Administration Bureau) is an agency dispatched by the municipal government and manages various administrative affairs of the Free Trade Zone on behalf of the municipal government. Article 6 The Administration shall exercise the following powers:
(1) Formulate development, construction plans and industrial policies for the bonded area, and organize their implementation after approval by the municipal government;
(2) In accordance with these regulations Develop specific management measures for the bonded area and issue them for implementation after approval by the municipal government;
(3) Under the guidance of the municipal planning, land and administrative department, be responsible for land planning, infrastructure and public utility projects in the bonded area and living areas development, and handle relevant procedures for the transfer of land use rights;
(4) Responsible for the management of water supply, power supply and other public utilities in the bonded area and living areas;
(5) Construction in the city Under the guidance of the administrative department, manage the construction of projects other than special professional projects in the bonded zone and living areas;
(6) Publish the investment-oriented catalog of the bonded zone, and assist the municipal industrial and commercial administration department in handling enterprise registration and other matters Management matters;
(7) Responsible for the labor and personnel management of the bonded area, formulating the annual employee recruitment plan for the bonded area as needed, and handling recruitment, approval and employment matters as planned after being approved by the municipal personnel and labor administration department;
(8) Responsible for the management of municipal state-owned assets in the bonded area;
(9) Under the guidance of the municipal environmental protection administrative department, responsible for the environmental protection of the bonded area and living areas; < /p>
(10) Handle the approval procedures for Chinese personnel in the bonded zone to go abroad for short-term business and to Hong Kong, Macao and overseas training;
(11) Coordinate with customs, border inspection, taxation, foreign exchange, Public security, health quarantine, animal and plant quarantine, commodity inspection and other management agencies carry out relevant business in the bonded area;
(12) Other powers granted by the municipal government. Article 7 The Administration Bureau shall be responsible for and report its work to the Municipal Government. The municipality may change or revoke inappropriate decisions of the authority. Article 8 Important decisions made by the Administration Bureau in exercising its powers under this Regulation shall be filed with the municipal government and relevant administrative departments. Article 9 With the approval of the municipal organizational establishment department, the Administration may establish several working institutions in accordance with the principles of simplicity and efficiency.
The working organization of the Administration Bureau is responsible to the Administration Bureau and accepts the business guidance of the relevant administrative departments of the municipal government. Article 10 Customs and border inspection agencies shall establish dispatched offices within the bonded area and exercise their powers in accordance with the law. Article 11 Health quarantine, animal and plant quarantine, and commodity inspection agencies shall, with the approval of the administrative bureau, set up offices in the bonded area or assign full-time personnel to conduct inspections in areas other than entry and exit channels in accordance with the law. Chapter 3 Enterprise Establishment and Management Article 12 The municipal government encourages investors to establish high-tech and technologically advanced industrial enterprises in the bonded zone and enjoy relevant preferential treatment. Article 13 Investors may establish trading enterprises and engage in commercial activities in the bonded zone upon approval.
Article 14 Investors may establish warehousing enterprises in the bonded zone and carry out bonded warehouse business. Article 15 Domestic and foreign information institutions may establish branches or offices in the bonded zone to carry out consulting services. Article 16 With the approval of the financial authorities, domestic and foreign financial and insurance institutions may set up business institutions or offices in the bonded zone to carry out financial and insurance business and contact and consulting services. Article 17 Investors may establish transportation, communications and other tertiary industry enterprises permitted by national laws and regulations in the bonded zone. Article 18 When an investor establishes an enterprise or representative office in the bonded zone, it shall be handled in accordance with the following procedures;
(1) When an investor submits an application, the industrial and commercial administration department shall, in accordance with the law, apply in accordance with the investment-oriented catalog issued by the bureau. be approved and registered;
(2) The establishment of an enterprise to engage in specific business shall be approved by the administrative department and registered with the industrial and commercial administration department in accordance with the law;
(3) After the investor obtains the business license , go to the customs, taxation, foreign exchange and other administrative agencies to complete the filing, registration and account opening procedures. Article 19 The administrative department for industry and commerce shall make a decision on whether to approve registration within 20 days from the date of receiving the investor’s application for establishing an enterprise.
If the approval of the administration is required, the administration shall make a decision on whether to grant approval within ten days from the date of receipt of the investor's application.
