What procedures and materials are needed for marriage registration?

The current marriage registration process can be roughly divided into three links: application, examination and registration.

(1) application

Couples who meet the requirements for marriage registration can apply for marriage registration at the marriage registration office where one party is located with relevant certificates, certification materials and registration photos, and fill in the declaration required for applying for marriage registration on the spot.

The preparation materials for marriage registration application depend on the specific circumstances. For example, if China citizens apply for marriage registration in China (except Hong Kong, Macao and Taiwan), they must hold their own identity certificate, household registration certificate, marriage inspection certificate, single spouse certificate and a signed statement that they are not related to each other. Those who apply for divorce and remarriage must also bring a divorce certificate.

Foreigners applying for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) must hold their valid passports or nationality certificates, foreigners' residence permits issued by public security organs, and certificates that can effectively prove their marital status.

(2) Review

The marriage registration office will check and review the submitted application materials to find out whether the marriage application meets the conditions for marriage. If there is any ambiguity, the marriage registration authority will ask the parties and ask them to provide relevant materials when necessary.

(3) Registration and licensing

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For divorced parties, the marriage registration office will generally cancel the divorce certificate; When necessary, the marriage registration office will also issue a notice of disapproval of marriage registration, explaining the reasons for disapproval of marriage registration.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If both parties divorce voluntarily, both parties who need a divorce shall sign a divorce agreement in accordance with the provisions, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1, marriage certificate of both men and women;

2. Valid identity documents that meet the requirements for divorce registration, such as household registration book, identity card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff will conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Code. After checking the documents and supporting materials submitted by the parties for the first time, the marriage registrar will issue a receipt for accepting the divorce registration application. Those who do not meet the application conditions will not be accepted, and the registrar may issue a notice that the divorce registration application will not be accepted.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, any party who does not want to divorce can withdraw the application for divorce registration at the marriage registration office that accepts the application for divorce registration with his valid identity document and the Receipt for Accepting the Application for Divorce Registration (if the receipt cannot be found, the reasons can be explained in writing), and fill out the Application for Withdrawal of Divorce Registration in person. After verification by the staff of the marriage registration office, a "Confirmation of Withdrawal of Divorce Registration" will be issued to the parties concerned, and the application for divorce registration, the application for withdrawal of divorce registration and the confirmation of withdrawal of divorce registration will be filed together. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period is a holiday, the first day after the holiday will be the expiration date), both parties shall apply to the marriage registration authority for divorce certificate with relevant documents and materials such as divorce agreement, marriage certificate, photos, and valid documents to prove their identity. The marriage registration authority shall conduct the examination in accordance with the procedures and conditions stipulated in the Code for Marriage Registration. Those who do not meet the conditions for divorce registration shall not be handled, and if necessary, a notice of divorce registration shall be issued at the request of the parties concerned.

(5) Registration (certification)

The marriage registration authority shall register in accordance with the provisions of the marriage registration work norms, and then issue a divorce certificate to the parties.
