Regulations of Chuzhou Municipality on the Administration of Fireworks and Firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, ensure public safety and personal and property safety, reduce environmental pollution, and advocate a healthy and civilized lifestyle, these Regulations are formulated in accordance with the provisions of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council and relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and related management activities within the administrative area of this Municipality. Third fireworks should follow the principle of combining prohibition with restriction, education and guidance, safety and civilization. Fourth cities and counties (cities, districts) are prohibited from setting off fireworks and firecrackers in urban built-up areas. The specific scope is determined by the people's governments of cities and counties (cities, districts) according to the actual situation and announced to the public.

City, county (city, district) people's governments may, according to needs, designate other areas where fireworks and firecrackers are prohibited, and announce them to the public. Article 5 It is forbidden to set off fireworks and firecrackers in the following places:

(a) cultural relics protection units, state organs, kindergartens, schools, medical institutions and pension institutions;

(2) Traffic hubs such as stations, docks and airports, traffic facilities such as expressway, tunnels, elevated roads and overpasses, and railway line safety protection zones;

(3) The place where inflammable and explosive articles are produced, stored and sold, and the safety range around it;

(4) Within the safety protection zone of power transmission and transformation facilities;

(five) exhibition halls, museums, libraries, archives and other public cultural places;

(six) scenic spots, forests, grasslands, nurseries and other key fire prevention areas, as well as factories and mines that prohibit the discharge of fireworks and firecrackers;

(7) Protected areas of important military facilities;

(eight) prisons, detention centers, detention centers and other places of supervision and their surrounding areas;

(nine) shopping malls, bazaars, stadiums, public places of entertainment and other crowded places;

(ten) other places where fireworks and firecrackers are prohibited as prescribed by laws and regulations.

Where fireworks and firecrackers are prohibited, the owner, user or management unit shall set warning signs prohibiting fireworks and firecrackers, and be responsible for management and maintenance. Sixth in the area where fireworks are prohibited, the built-up area where the Township People's Government is located is restricted from setting off fireworks. The specific scope is determined by the county (city, district) people's government according to the actual situation and announced to the public.

In areas where fireworks and firecrackers are restricted, fireworks and firecrackers are prohibited from 22: 00 to 5: 00 the next day, except on Lunar New Year's Eve to the third day and fifteenth day of the first month. Seventh yellow and above heavy pollution weather warning period, the administrative area of the city completely banned fireworks. The early warning information of heavy pollution weather shall be announced to the public by the Municipal People's Government in accordance with the prescribed procedures. Article 8 Fireworks and firecrackers shall not be sold in areas where fireworks and firecrackers are prohibited. If property losses are caused to operators licensed to sell fireworks and firecrackers, compensation shall be paid according to law.

Outside the area where fireworks and firecrackers are prohibited, the distribution of fireworks and firecrackers business units shall be carried out in accordance with the principles of reasonable layout, total control and gradual reduction. Article 9 In areas where fireworks and firecrackers are prohibited, the following safety requirements shall be observed when setting off fireworks and firecrackers:

(1) Fireworks and firecrackers shall not be set off in corridors, stairs, roofs, balconies and windows of buildings;

(two) not to pedestrians, vehicles, buildings, public green space, underground pipe network and other throwing fireworks;

(three) shall not hinder the safe passage of pedestrians and vehicles and affect traffic order;

(four) shall not use other means to endanger public safety and personal and property safety. Tenth in the area where fireworks are prohibited, the following acts are advocated:

(a) less or no fireworks;

(two) the use of low pollution and environmental protection fireworks;

(three) after the fireworks, clean up the residue in time. Eleventh city and county (city, district) people's governments should strengthen leadership, coordinate and do a good job in the management of fireworks and firecrackers, and incorporate the management of fireworks and firecrackers into the important content of environmental protection, civilization creation and safe construction evaluation.

Township people's governments and sub-district offices shall implement the responsibility of territorial management and do a good job in the management of fireworks and firecrackers within their respective jurisdictions.

Village residents' committees and owners' committees shall assist in the management of fireworks and firecrackers.

The management institutions of development zones and scenic spots shall, in accordance with the requirements of the people's governments of cities and counties (cities, districts), do a good job in the management of fireworks and firecrackers within their respective jurisdictions. Article 12 Public security organs shall be responsible for the safety management of fireworks and firecrackers, investigate and deal with illegal fireworks and firecrackers according to law, and establish a long-term working mechanism for joint prevention and control in conjunction with relevant departments.

The emergency management department is responsible for the supervision and management of the safety production of fireworks and firecrackers, and investigate and deal with the illegal production and operation of fireworks and firecrackers according to law.

Urban management law enforcement departments are responsible for investigating and handling fireworks and firecrackers that affect the city appearance and environmental sanitation.

The housing and urban-rural construction department is responsible for urging construction projects and other units to abide by the relevant provisions on the management of fireworks and firecrackers, urging property service enterprises to do a good job in the management of fireworks and firecrackers in the service area, and discouraging and reporting illegal fireworks and firecrackers.

The civil affairs department is responsible for urging marriage registration, funeral homes, cemeteries and other units to carry out publicity and education, and guiding weddings and funerals to comply with the relevant provisions on the management of fireworks and firecrackers.

Ecological environment, market supervision, transportation, education and sports, meteorology, culture and tourism departments shall, within the scope of their respective duties, do a good job in the management of fireworks and firecrackers.
