Provisions of Guangzhou Municipality on Safety Management of Large-scale Mass Activities

Chapter I General Provisions Article 1 In order to standardize the safety management of large-scale mass activities in this Municipality and safeguard the social order and public safety in this Municipality, these Provisions are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Large-scale Mass Activities and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "large-scale mass activities" as mentioned in these Provisions refers to the following activities held by legal persons or other organizations to the public, except those held in shopping malls, pedestrian streets, theaters, concert halls, parks, squares, entertainment places, swimming pools and other places, and the number of participants is expected to reach 1000 or more each time. Within the scope of its daily business:

(1) Sports activities.

(2) Art performance.

(three) exhibitions, exhibitions, exchanges and other activities.

(four) flower market, sacrifice, garden, lantern festival, mountaineering, fireworks, temple fairs, festivals, food festivals and other activities.

(five) job fairs, promotion meetings, on-site lottery sales activities.

(6) Charity activities. Article 3 These Provisions shall apply to the safety management of holding large-scale mass activities within the administrative area of this Municipality. Where there are other provisions in laws and regulations on production safety, fire control, assembly and demonstration, those provisions shall prevail. Article 4 The safety management of large-scale mass activities shall follow the principles of safety first, prevention first and comprehensive management, and adhere to the principle that the undertaker is responsible and the government supervises. Article 5 The municipal and district public security organs shall be responsible for the safety management of large-scale mass activities, and implement the safety license for large-scale mass activities in accordance with the Regulations on the Safety Management of Large-scale Mass Activities.

Other relevant administrative departments shall perform their duties in accordance with the following provisions:

(a) the traffic administrative department shall, according to the nature and scale of activities, provide necessary public transport resources support for large-scale mass activities, cooperate with traffic control measures, do a good job in the adjustment of bus lines in controlled sections, and guide subway and bus units to actively cooperate with the adjustment of capacity.

(two) the construction administrative department is responsible for the inspection and guidance of temporary buildings (structures) in large-scale mass activities notified by the public security organs, and guiding the organizers to entrust appraisal units to issue appraisal reports.

(3) The administrative department in charge of urban management is responsible for reviewing and controlling the occupation of sidewalks and related public venues by holding large-scale mass activities, rectifying the activity venues and surrounding city appearance and environment, and guiding the setting of temporary hanging objects and indicating signs.

(four) the administrative department of health shall carry out health supervision according to law, guide the undertaker to do a good job in on-site emergency rescue work, contact the nearest medical rescue point, and open a green channel for emergency rescue.

(5) The food and drug supervision and administration department is responsible for the food safety supervision and administration of large-scale mass activities.

(six) the competent meteorological department is responsible for providing timely meteorological and disaster information related to activities.

Water supply, power supply, gas, communications and other units shall, in accordance with their respective ownership, conduct safety supervision and inspection of related equipment and temporary facilities in and around the activity area, eliminate hidden dangers in time, and ensure the normal operation of equipment and facilities. Article 6 The municipal and district people's governments and their relevant departments shall take various forms to strengthen the publicity, education and drills of laws, regulations and safety knowledge related to large-scale mass activities, and enhance the safety awareness and safety prevention ability of relevant units, individuals and the public. Chapter II Safety Management Article 7 Public security organs shall implement a safety licensing system for large-scale mass activities. Holding large-scale mass activities shall meet the following conditions stipulated in Article 11 of the Regulations on Safety Management of Large-scale Mass Activities:

(1) The undertaker is a legal person or other organization established in accordance with legal procedures.

(two) the contents of large-scale mass activities shall not violate the provisions of the Constitution, laws and regulations, and shall not violate social morality.

(3) Having a safety work plan that meets the requirements, with clear safety responsibilities and effective measures.

(4) The activity places and facilities meet the safety requirements. Article 8 If the expected number of participants in a large-scale mass activity is more than 1000 and less than 5,000, the district public security organ where the activity is located shall accept and implement the safety license.

Large-scale mass activities are expected to have more than 5,000 participants, which shall be accepted by the district public security organ where the activity is located and reported to the municipal public security organ for the implementation of safety license.

For large-scale mass activities held across regions, the undertaker shall directly apply to the municipal public security organ for safety permission. Article 9 The expected number of participants in an activity refers to the number of staff directly involved in the organization, coordination and security of the activity, as well as the sum of the number of certificates, tickets or audience expected to be distributed and sold to the public. For activities with fixed seats in the venue, the number of people shall be calculated according to the fixed seats; For activities without fixed seats in the venue, the number of people is calculated according to the total area of the venue after deducting the space occupied by various facilities such as temporary structures, and the remaining area is calculated according to the per capita occupation 1 square meter. Article 10 The undertaker shall apply to the public security organ for a safety license 20 days before the event is held. When applying, the following materials shall be submitted to the public security organ, and a list of application materials shall be made:

(a) the legal establishment certificate of the contractor and the identity certificate of the person in charge of safety.

(two) the agreement signed by the organizer and the organizer. If two or more organizers jointly undertake large-scale mass activities, they shall submit a joint undertaking agreement. The mutual commitment agreement shall include the safety responsible person and the division of safety responsibilities of each contractor, the safety inspection system and the accountability system.

(3) Large-scale mass activities and their explanations. Including time, place, content, participants, process, vehicle parking arrangement, functional area division, site plan, audience seat map and audience seat number description.

(four) the safety work plan for large-scale mass activities.

(five) the site lease agreement or the certificate that the site manager agrees to provide the site; Legal proof of the website owner's unit.
