Regulations of Shenzhen Special Economic Zone on Traditional Chinese Medicine (revised in 219)

chapter I general provisions article 1 these regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Shenzhen special economic zone (hereinafter referred to as the special zone) in order to guarantee and promote the development of Chinese medicine, standardize the management of Chinese medicine industry and protect and promote human health. Article 2 Units and individuals engaged in traditional Chinese medicine activities in the Special Zone shall abide by these Regulations. Article 3 The development of Chinese medicine should follow the principle of combining inheritance with innovation and the coordinated development of Chinese medicine. Article 4 The municipal and district people's governments shall pay equal attention to both Chinese and western medicine, protect, guide, support and promote the development of Chinese medicine, and incorporate Chinese medicine into the national economic and social development plan of their respective jurisdictions. Article 5 The municipal and district health departments are the competent departments of traditional Chinese medicine in their respective administrative areas, and perform the following duties according to law:

(1) Implementing laws and regulations on traditional Chinese medicine, drafting and organizing the implementation of development plans for traditional Chinese medicine;

(2) Practice registration, filing, supervision and management of medical institutions of traditional Chinese medicine;

(3) management of continuing education of Chinese medicine, mentoring education, health education and foreign exchange;

(4) Handling of disputes over medical malpractice in traditional Chinese medicine;

(5) Other duties as stipulated by laws and regulations. Article 6 The relevant municipal and district departments shall, according to their respective responsibilities, guarantee and promote the development of Chinese medicine. Article 7 The municipal health department shall organize the establishment of an expert committee on traditional Chinese medicine, which shall perform the following duties:

(1) Organize research on major topics and provide suggestions for the development of traditional Chinese medicine;

(2) sorting out and studying the literature of traditional Chinese medicine and the methods and techniques of folk diagnosis and treatment of traditional Chinese medicine, so as to promote the development of theory and technology of traditional Chinese medicine;

(3) to provide professional advice for the relevant departments to formulate Chinese medicine management policies.

the Chinese medicine expert Committee is composed of famous Chinese medicine practitioners, famous Chinese medicine pharmacists, experts recommended by trade associations, and Chinese medicine administrators of health departments. The specific measures shall be formulated separately by the municipal health department. Article 8 The Chinese Medicine Industry Association is a self-regulatory organization with the participation of Chinese medicine medical institutions, Chinese medicine enterprises and Chinese medicine professionals and technicians, and performs the following duties:

(1) Standardizing industry behaviors and safeguarding the legitimate rights and interests of its members;

(2) organizing academic and business exchanges of Chinese medicine, popularizing Chinese medicine knowledge, popularizing Chinese medicine technology and training practitioners in Chinese medicine industry;

(3) to carry out the evaluation of key specialties and characteristic specialties of traditional Chinese medicine and integrated traditional Chinese and western medicine;

(4) mediating internal disputes in the industry;

(5) other duties as stipulated by laws, regulations and articles of association. Ninth to strengthen the propaganda, popularization and application of traditional Chinese medicine culture and popular science knowledge.

October 22nd every year is the Chinese Medicine Publicity Day. Chapter II Guarantee and Promotion Article 1 The Municipal People's Government shall set up a joint meeting on the development of Chinese medicine to perform the following duties:

(3) supervise and inspect the implementation of relevant policies and measures.

The joint meeting on the development of traditional Chinese medicine is convened regularly by the leaders in charge of health work of the Municipal People's Government, specifically organized by the municipal health department, and attended by the departments of development and reform, education, scientific and technological innovation, industry and informatization, public security, civil affairs, finance, human resources protection, planning and natural resources, culture, radio, film, television, tourism and sports, market supervision, medical security, urban management and comprehensive law enforcement. Eleventh municipal and District People's governments and their relevant departments shall solicit the opinions of the Committee of Experts on Traditional Chinese Medicine when formulating policies involving traditional Chinese medicine. Article 12 The municipal and district people's governments shall support the development of traditional Chinese medicine, gradually increase the financial input to the cause of traditional Chinese medicine, and focus on supporting the characteristic services of traditional Chinese medicine, the infrastructure construction of public traditional Chinese medicine hospitals, the construction of key disciplines and key specialties, and the cultivation of talents in traditional Chinese medicine.

the municipal and district people's governments can set up special funds to promote the development of Chinese medicine, which can be used for basic medical treatment, teaching, scientific research and popular science work of Chinese medicine. Thirteenth municipal and district people's governments shall establish a subsidy and compensation mechanism for municipal and district public medical institutions of traditional Chinese medicine, and formulate subsidy and compensation measures that are conducive to promoting medical services with Chinese medicine characteristics. Article 14 The municipal medical security department shall support the development of Chinese medicine when formulating the medical insurance drug list and diagnosis and treatment items.

the municipal medical security department should reflect the service cost of traditional Chinese medicine and the value of technical services when determining the charging standard for diagnosis and treatment. The charging items and standards shall be formulated by the municipal medical security department in conjunction with the municipal health department in accordance with the relevant price management regulations of the state and Guangdong Province. Fifteenth municipal and district people's governments shall incorporate Chinese medicine services into public health services and support the active use of Chinese medicine methods and technologies in disease prevention and control.

Encourage medical institutions of traditional Chinese medicine to give full play to the advantages of traditional Chinese medicine in health care and sub-health diagnosis and treatment, and carry out preventive and health care services. Sixteenth relevant departments should treat Chinese medical institutions equally when determining the designated medical institutions for social medical insurance, industrial injury insurance and public health emergencies. Seventeenth relevant departments of the city and district should improve the evaluation system of Chinese medicine personnel training and formulate policies conducive to the training and evaluation of Chinese medicine personnel.
