Measures of Nanjing Municipality on the Administration of Construction Site of Construction Projects

Chapter I General Provisions Article 1 In order to strengthen the construction site management of construction projects, ensure safe production and civilized construction on the construction site, and maintain urban environmental sanitation, these measures are formulated in accordance with the Construction Law of People's Republic of China (PRC), the Regulations of the State Council on the Safety Management of Construction Projects and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the construction safety and civilized construction activities at the construction site of construction projects within the administrative area of this Municipality and their supervision and management. Article 3 The term "construction site" as mentioned in these Measures refers to the construction site occupied by building construction, municipal infrastructure, urban rail transit, architectural decoration and other construction projects and the demolition of buildings (structures). Fourth city housing and urban and rural construction administrative departments (hereinafter referred to as the municipal construction site supervision department) is responsible for the comprehensive supervision and management of the city's construction site. The district (Park) construction site supervision department shall be responsible for the supervision and management of the construction site within its jurisdiction in accordance with the prescribed responsibilities.

Urban management, land and resources, environmental protection, production safety supervision, public security, planning and other administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of the construction site. Fifth to encourage the use of green and advanced construction technology in engineering construction, promote the standardized and scientific management of the construction site, and improve the management level of the construction site. Units and individuals that have made remarkable achievements in construction site management shall be commended or rewarded. Chapter II General Provisions Article 6 The scope of the construction site shall be subject to the approved scope of land for construction projects, the scope of temporary land use and the scope of temporary road occupation.

The construction unit or the project management unit entrusted by it (hereinafter referred to as the construction unit) shall go through the formalities of safety supervision and filing at the construction site supervision department before the construction project starts, and provide information on the management of safe production and civilized construction. Seventh construction, survey, design, supervision, construction and other parties responsible for the main body and other relevant units shall perform the duties of civilized construction and safe production in accordance with the provisions of laws, regulations and rules, implement the provisions of the construction site, and bear the corresponding responsibilities. Article 8 A construction unit shall perform the following duties:

(a) when bidding for a construction project or directly contracting out a contract, the requirements and measures for civilized construction and safe production by units such as survey, design, supervision and construction shall be clearly defined in the bidding documents and contracts;

(2) When preparing the project budget, the cost of safe and civilized construction measures shall be determined in accordance with the relevant provisions, and shall be separately charged in the bidding documents and the project contract, and shall not be included in the bidding scope;

(3) Before the construction project starts, pay not less than 60% of the cost of safety and civilized construction measures in advance, pay the cost of safety and civilized construction measures to the construction unit in time as agreed in the contract, and urge the construction unit to implement safety production and civilized construction measures;

(four) before the design documents of the construction project are determined, organize the relevant units to investigate the sites that may affect the adjacent buildings (structures), various pipelines and important facilities, and submit the investigation results to the design units in writing;

If there are potential safety hazards in adjacent buildings (structures), various pipelines and important facilities due to construction, relevant units shall be organized to take effective measures to ensure the safety of personnel, and professional testing institutions or appraisal institutions shall be entrusted to conduct safety appraisal in time to eliminate potential safety hazards;

(five) the establishment of construction site quality and safety management institutions, formulate the corresponding management system and assessment methods; Be fully responsible for dust control on the construction site, and designate a special person to be responsible for the coordination and management of civilized construction on the construction site;

(six) other duties that should be performed according to law. Ninth survey and design units shall perform the following duties:

(a) survey and design in accordance with the mandatory standards for engineering construction, and the survey report and design documents provided shall be true and accurate;

(two) to implement the relevant provisions of the operating rules and civilized construction, and take measures to ensure the safety of all kinds of pipelines, facilities and surrounding buildings (structures);

(3) The engineering design should consider the needs of safe operation and protection during construction, and indicate the key parts and links involved in construction safety, the monitoring requirements and monitoring control boundaries of the construction project itself and adjacent buildings, various pipelines and important facilities, etc. In the design documents, put forward the guiding opinions to prevent production safety accidents;

(4) Indicate the nodes, items and contents of on-site service in the survey and design documents, explain the approved construction drawing design documents to the construction and supervision units in detail, and deal with the safety technical problems related to design in construction in time;

(five) according to the needs of safety production and emergency rescue on the construction site, cooperate with relevant units to put forward treatment measures in time;

(six) other duties that should be performed according to law. Tenth supervision units shall perform the following duties:

(a) equipped with professional supervision personnel and full-time safety supervision personnel suitable for the construction project, and full-time safety supervision personnel shall be qualified through safety production education and training. Without the consent of the construction unit, the chief supervision engineer shall not be replaced without authorization, and if it is really necessary to change, the corresponding qualification conditions shall not be lowered, and the relevant change procedures shall be performed;

(2) Review the qualification certificates, safety production licenses and qualification certificates of the project managers, full-time safety management personnel and special operations personnel of the construction units entering the site, and record the posts of the project managers and safety management personnel of the general contracting and professional subcontractors;

(three) review the safety technical measures and special construction plans in the construction organization design, and implement follow-up supervision; Focus on monitoring the construction of sub-projects with high risks, and implement side-by-side supervision on key parts and links involving construction safety;

(four) witness the spot sampling inspection, participate in the acceptance of construction machinery and safety facilities, supervise the safety inspection of construction units, and eliminate hidden dangers in time;

(five) review the investment, use and management of safety and civilized construction measures, and urge the construction unit to do a good job in civilized construction management on the construction site;

(six) other duties that should be performed according to law.
