Measures of Huainan Municipal Government for the Administration of Investment Projects

Chapter I General Provisions Article 1 In order to regulate the government investment behavior, strengthen the management of government-invested construction projects, and reasonably control the project cost, these Measures are formulated in accordance with the Construction Law of People's Republic of China (PRC), the Bidding Law of People's Republic of China (PRC), the Regulations of Anhui Province on the Management of Project Construction Cost and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "government-invested construction projects" as mentioned in these Measures refers to construction projects invested by fiscal funds and other government funds, mainly including public services, public infrastructure, ecological environment protection, social management and other construction projects.

Where there are special provisions on the bidding activities, project changes, and conditions and procedures for the payment of funds for projects with loans from foreign governments or international financial organizations, those provisions shall prevail.

The construction and management of government and social capital cooperation projects shall be implemented in accordance with the relevant provisions of the state and the province. Article 3 The decision-making of government projects shall be scientific, democratic and legal, the capital construction procedures shall be strictly implemented, and the construction shall be carried out according to the approved investment, scale and standards. Chapter II Decision-making and Planning Article 4 A project reserve system shall be implemented for government projects. Project reserve includes 3-year project reserve plan and annual investment project construction plan. Included in the 3-year project reserve plan, the relevant departments shall demonstrate the necessity and feasibility of the project and report to the municipal government for approval before the preliminary work of the project can be carried out. Preliminary work such as feasibility study and preliminary design can only be carried out after the project is approved.

Small projects that have been included in the annual plan of government investment projects or related special construction plans at the corresponding level, with simple construction content and total investment of100000 yuan, can be combined with the feasibility study report for approval if there is no special need. Article 5 The development and reform department shall, in combination with the completion of the preliminary work of government projects, solicit the opinions of relevant departments and make a comprehensive balance, and then prepare a three-year rolling plan and an annual plan. In principle, the projects in the annual plan are selected from the three-year rolling plan project library invested by the government. In principle, the project applicant will report the project to be included in the next year's plan to the development and reform department before August each year, and the development and reform department will work out the draft investment plan for the next year after reviewing with relevant departments. Article 6 Projects included in the annual plan of government projects include continued construction projects, newly-built projects and preliminary work projects.

As a new project, the project proposal and feasibility study report have been approved, the source of funds has been implemented, and the project has been approved by the government at the same level to meet other relevant conditions. Article 7 The development and reform department shall, jointly with relevant departments, put forward an annual plan for government projects at the corresponding level, which shall be submitted to the people's government at the corresponding level for deliberation, and the approved annual investment plan shall be submitted to the Standing Committee of the people's congress at the corresponding level for the record.

The annual project plan shall specify the project name, construction content and scale, total project investment, commencement time, construction period, annual investment and sources of funds, investors, project construction units, etc. Article 8 The annual plan of government projects issued upon approval shall not be changed without authorization. In the implementation of the annual plan, if it is really necessary to adjust the project and related contents, the development and reform department shall, jointly with relevant departments, put forward adjustment opinions and report them to the people's government at the same level for deliberation. Article 9 The main responsibilities of the relevant administrative departments of government projects are:

(a) the development and reform department is responsible for the preparation of the government project reserve plan and annual plan, and is responsible for examining and approving the project proposal, feasibility study report and preliminary design;

(two) the department of land and resources is responsible for the project pre-trial, land approval, land acquisition and land supply, real estate registration and other work;

(three) the urban and rural planning department is responsible for the project site selection, land use planning and project planning permission, and solicit opinions from civil air defense, fire protection, power supply and other departments according to the situation;

(four) the supervision and administration department of public resources transaction is responsible for supervising the project bidding, supervising the transaction process of public resources trading projects, and supervising the project performance in conjunction with the relevant competent departments;

(five) the construction department is responsible for issuing construction permits and supervising the quality and safety of government projects;

(six) the project construction management department is responsible for supervising the government project construction and contract performance, project supervision bidding, project construction permit application and construction process management;

(seven) the financial department shall be responsible for the arrangement and disbursement of project funds in accordance with the approved annual investment plan and budget, and supervise and manage the use of project financial funds;

(eight) the audit department is responsible for the audit supervision of the project preparation, construction implementation and final accounts.

Environmental protection, transportation, water conservancy, forestry, public security, production safety supervision, civil air defense, urban management and other power supply, water supply and gas supply units shall do relevant work according to their respective responsibilities.

County and District People's governments are responsible for organizing the implementation of government projects, compensation and resettlement, and investment in environmental protection. Chapter III Project Management Article 10 The preliminary work of government projects includes project construction documents, feasibility study, preliminary design, construction drawing design, land handling, planning, environmental assessment and other procedures.

Distinguish between different projects, in principle, organize the preliminary work of the project according to the following provisions:

(a) belongs to the public welfare infrastructure projects, the development and reform department shall organize the relevant competent departments to implement;

(two) is a municipal engineering project, by the construction administrative department;

(three) in the case of water conservancy projects, the water administrative department shall be responsible;

(four) in the case of traffic engineering, the traffic administrative department shall be responsible for it;

(five) Development Zone (Park) construction projects, by the Development Zone (Park) Management Committee;

(six) the preparatory work for other government investment projects shall be the responsibility of the relevant units designated by the government.
