Measures for the Administration of Haikou Bonded Zone in Hainan Province

Article 1 In order to further open wider to the outside world and develop an export-oriented economy, these Measures are formulated in accordance with the principles of relevant national laws and with reference to international practices. Article 2 Haikou Bonded Zone (hereinafter referred to as Bonded Zone) is located in Jinpan Industrial Development Zone, Haikou, and is an area under customs supervision. Perfect isolation facilities should be set up at the boundary between bonded area and non-bonded area. Article 3 The bonded area shall focus on the development of bonded warehousing, entrepot trade and technology-intensive export processing industries, including international trade, entrepot trade, barter trade, transportation, warehousing and processing, packaging, commodity display, finance and insurance, etc. Article 4 The legitimate rights and interests of Chinese and foreign investors in the bonded area are protected by the laws of China. All enterprises, other economic organizations and individuals in the bonded area must abide by the laws, regulations and these measures of People's Republic of China (PRC) and Hainan Province. Article 5 The bonded area shall be led and managed by Haikou Municipal People's Government.

A management committee (hereinafter referred to as the management committee) shall be established in the bonded area to conduct unified management of the administrative affairs of the bonded area on behalf of Haikou Municipal People's Government, and to cooperate and coordinate the work of relevant state functional departments in the bonded area. Article 6 The main duties of the CMC are:

(a) unified management of the bonded area in accordance with these measures;

(two) to formulate and publish the detailed rules for the implementation of the bonded area management, and organize the implementation of the overall planning of the bonded area approved by the Haikou Municipal People's Government;

(three) to formulate and organize the implementation of various economic development plans and plans in the bonded area;

(4) Exercising the management functions of planning, finance, industry, foreign trade, land, planning, real estate, industry and commerce, labor, personnel, public security, environmental protection and municipal public facilities in the bonded area, and assisting the customs, taxation, finance, insurance, commodity inspection, health inspection and other departments in handling related businesses in the bonded area;

(5) Examining and approving the exit applications of administrative personnel of bonded areas, personnel of Chinese and foreign enterprises and Chinese personnel of foreign-invested enterprises, and going through passport and exit formalities with the foreign affairs department or public security department of Hainan Province;

(six) to exercise other functions and powers granted by the Hainan Provincial People's Government and the Haikou Municipal People's Government. Article 7 Customs, commodity inspection, foreign exchange, finance, health and other administrative agencies, as well as labor services, auditing, accounting, legal affairs and other agency services are established in the bonded area. Article 8 An investor who establishes an enterprise in the bonded area shall register with the administrative department for industry and commerce in the bonded area in accordance with relevant regulations and obtain a business license. Article 9 An enterprise with a business license shall go through the relevant formalities with the customs and tax authorities in the bonded area respectively. Article 10 The construction of enterprise engineering facilities in the bonded area must conform to the overall planning of the bonded area. Article 11 Enterprises in bonded areas must establish special account books for import and export duty-free and bonded goods recognized by the customs. Article 12 Enterprises in bonded areas must implement social security system and labor insurance for all employees. Thirteenth enterprises in the bonded area are allowed to mortgage loans with real estate in domestic and foreign banks and other financial institutions. Article 14 All enterprises in the bonded area may engage in foreign trade, including entrepot trade, entrepot trade, barter trade and direct processing business related to enterprise production. Unless otherwise stipulated by the state, goods involved in the administration of import and export licenses are exempted from import and export licenses when they are brought into the bonded area from abroad or transported from the bonded area to overseas; The transportation into or out of the bonded area from the domestic non-bonded area shall be handled according to the current relevant regulations of Hainan Province. Article 15 The organization, personnel, production and operation, product price, project bidding, asset disposal and salary distribution of enterprises in the bonded area shall be decided by the enterprises themselves. Article 16 Where an enterprise in the bonded area changes its name, legal representative, production, relocation, merger, transfer or termination in advance, it shall go through the formalities of change or cancellation of registration with the industrial and commercial and tax authorities in the bonded area and report to the administrative committee and the customs for the record. Article 17 With the approval of the People's Bank of China, foreign-funded banks, Sino-foreign joint venture banks and other financial and insurance institutions may be established in the bonded area. Domestic and foreign financial and insurance institutions established in Hainan with the approval of the People's Bank of China are allowed to enter the bonded area to set up business institutions. Article 18 The foreign exchange income of enterprises in the bonded area shall be managed in accordance with the provisions of the state and Hainan Province on foreign exchange management in the bonded area. Article 19 Profits obtained by foreign investors from enterprises, wages and other lawful incomes of foreign employees are allowed to be remitted abroad with tax payment certificates or tax payment certificates. Article 20 Enterprises in the bonded area may issue stocks and bonds at home and abroad upon approval; Foreign exchange funds can be raised from abroad according to the relevant provisions of the state. Article 21 Enterprises in the bonded area may conduct foreign exchange adjustment in foreign exchange adjustment centers inside and outside the bonded area according to the relevant provisions on foreign exchange adjustment. Article 22 Goods entering the bonded area from abroad shall be bonded. Goods re-exported through the bonded area are exempt from customs duties. Article 23 Products produced by enterprises in the bonded area shall be exempted from customs duties and product tax (value-added tax) when transported abroad; Products sold in the bonded area are exempt from product tax (value-added tax). Article 24 Machines, equipment, spare parts, raw materials, building materials, office supplies and daily necessities produced in non-bonded areas shall be exempted from export procedures and customs duties after being verified by the customs. Article 25 Goods that enter the bonded area duty-free and products produced by enterprises in the bonded area are sold to domestic non-bonded areas, which are regarded as imports and handled according to the existing laws and regulations of Hainan Province.
