Measures for the Administration of Dalian Jinshitan National Tourism Resort

Chapter I General Provisions Article 1 In order to further open wider to the outside world, develop and utilize the rich tourism resources of our city, promote the transformation of our city's tourism industry from sightseeing to sightseeing and holiday, and accelerate the development of tourism, these measures are formulated in accordance with the Notice of the State Council on Relevant Issues Concerning the Pilot Project of National Tourism Resort and relevant regulations. Article 2 Dalian Jinshitan National Tourist Resort (hereinafter referred to as the Resort) is a comprehensive tourist resort established with the approval of People's Republic of China (PRC) and the State Council, China, mainly to receive overseas tourists. Article 3 The resort shall focus on developing high-income tourism and unemployed people, and appropriately develop productive enterprises serving the tourism industry.

The enterprises in the resort must be modern, export-oriented, high foreign exchange earning and efficient. Article 4 Enterprises from foreign countries, Taiwan Province Province, Hongkong and Macao, as well as other organizations and individuals (hereinafter referred to as foreign businessmen) are encouraged to invest in developing tourist facilities and operating tourist projects in the resort. Fifth enterprises, other organizations and individuals in the resort must abide by the laws and regulations of People's Republic of China (PRC) and the relevant provisions of Liaoning and Dalian, and their legitimate rights and interests are protected by law. Sixth resort must strengthen the planning and management, and the overall planning of the resort should be coordinated with the overall planning of Dalian Jinshitan National Key Scenic Area.

No unit or individual may destroy the natural resources of Jinshitan Scenic Area. Chapter II Management Organization Article 7 A management committee (hereinafter referred to as the resort management committee) shall be set up in the resort to implement unified management of the resort under the leadership of the Dalian Municipal People's Government. Eighth resort management committee's main functions and powers are:

(a) the preparation of the overall planning and development plan of the resort, after the approval of the Municipal People's government, responsible for organizing the implementation;

(two) to implement the relevant laws and regulations of the state, Liaoning Province and Dalian City, and to formulate and promulgate the relevant specific management regulations of the resort;

(three) according to the provisions of the examination and approval of investment projects in the resort;

(four) the management of finance, industry and commerce, labor and personnel, land and real estate, environmental protection, road traffic, public security and fire control in the resort;

(five) responsible for the construction and management of various basic public facilities in the resort;

(six) to handle the relevant foreign affairs of the resort;

(seven) to exercise other functions and powers granted by the Municipal People's government. Article 9 Customs, foreign exchange management, banking, insurance and other departments have been approved to set up branches or agencies in the resort to handle related businesses and provide convenience for investors. Article 10 The relevant departments of the Municipal People's Government shall strengthen their professional guidance to the functional departments of the resort management committee and support the resort management committee to implement unified management of the resort. Chapter III Investment and Management Article 11 Upon approval, enterprises, other organizations and individuals inside and outside China can invest in establishing enterprises, investing in developing tourist facilities and operating tourist projects in the resort by means of joint ventures, cooperation and sole proprietorship. Twelfth resorts to encourage investment in the development, construction and operation of the following projects:

(1) Sightseeing and entertainment projects;

(two) hotels, villas, restaurants and shopping services;

(3) Productive enterprises serving the tourism industry;

(four) the public facilities, infrastructure and construction projects supporting the resort;

(five) other tourism and service projects. Article 13 Upon approval, foreign exchange shops, duty-free shops or Sino-foreign joint ventures may be established in the resort. Specific examination and approval shall be handled in accordance with relevant state regulations. Article 14 With the approval of the National Tourism Administration, a Chinese-foreign joint venture Class I travel agency may be established in the resort to engage in overseas tourism business. Fifteenth it is forbidden to set up projects that pollute the environment in the resort. Article 16 To set up an enterprise in a resort, an application shall be submitted to the resort management committee, and after approval, the industrial and commercial and tax registration management procedures shall be handled according to regulations.

In the resort investment, construction and management of tourism projects need land, should be in accordance with the relevant provisions of the "Dalian state-owned land use right transfer and transfer management approach", to the resort management committee to apply for land use procedures, to obtain a land use certificate. Seventeenth enterprises in the resort can determine their own internal structure, staffing, recruitment standards and salary distribution. The recruitment of employees by enterprises is not restricted by regional boundaries, and all employees are subject to the labor contract system. Eighteenth enterprises in the resort should establish financial accounting books. Enterprises engaged in diversified businesses should establish accounting books according to their business types. Special account books recognized by the customs shall be established for the import and export-free materials handled by the customs as bonded goods.

Enterprises should submit accounting statements to the finance, taxation, customs and other relevant departments of the resort according to regulations, and accept supervision. The annual accounting statement of an enterprise shall be verified by an accountant registered in China. Article 19 Where a resort enterprise changes its name, business place, legal representative, economic nature, business scope, mode of operation, registered capital, term of operation, division, merger or termination of business, it shall apply for change of registration or cancellation of registration in accordance with relevant regulations. Article 20 Profits earned by foreign investors in foreign-invested enterprises in holiday resorts, salaries and other lawful incomes of foreign employees may be remitted abroad after paying taxes according to law. Twenty-first all foreign exchange management of enterprises in the resort area shall be the responsibility of the designated foreign exchange bank in China or other banks designated by the foreign exchange administration department.
