Regulations of Nanning Municipality on Handling Management

Chapter I General Provisions Article 1 In order to strengthen the handling management, maintain the normal handling market order, and safeguard the legitimate rights and interests of the undertaker, these Regulations are formulated in accordance with the relevant provisions of the state and combined with the actual situation of our city. Article 2 The term "handling" as mentioned in these Regulations refers to commercial handling and its additional services that provide handling services to the society in various ways. Article 3 All units and individuals engaged in cargo handling operations within the administrative area of this Municipality shall abide by these Regulations. Article 4 The traffic administrative departments at all levels in our city are in charge of the handling management within their respective administrative areas, and the transportation management institutions at all levels to which they belong are specifically responsible for the daily management of handling.

Government departments such as industry and commerce, taxation, prices and public security shall be responsible for the supervision and management of handling within their respective responsibilities. Article 5 The handling industry shall follow the principles of unified management, overall planning, diversified business, equal competition and coordinated development. Chapter II Opening, Closing and Closing Article 6 An operator engaged in handling shall meet the following conditions:

(1) Having articles of association, a sound production and operation organization and management systems for safety, quality, finance and sales;

(2) Having machines, tools and equipment suitable for the business scope and qualified in technical conditions;

(3) Having a fixed business place. Renting other people's houses and sites as office buildings shall have signed a legal and effective lease contract for more than one year;

(four) in addition to the fixed assets, there are liquidity that is suitable for its business and not less than 5% of the value of loading and unloading machinery and equipment, and there are more than 30 thousand yuan (inclusive) of compensation deposit for work-related accidents;

(5) Having professional managers and relatively fixed employees. Recruiting employees must meet the labor and employment conditions stipulated by the state. Operators engaged in handling and loading and unloading shall be qualified through training and examination, and obtain a work permit.

Operators engaged in dangerous goods handling must also have corresponding safety protection equipment and tools. Its employees should hold a dangerous goods handling operation certificate. Which should be equipped with corresponding professional and technical personnel.

Operators engaged in handling large objects must also have professional protective equipment and tools. Its employees should hold operation certificates for handling and loading large objects. Among them, professional and technical personnel with the title of assistant engineer or above shall be equipped according to the requirements of the state on the allocation of technical personnel.

Individuals engaged in simple handling are not restricted by the above provisions of this article, but should go through relevant procedures in the transportation management institution. Article 7 An operator who applies for handling must go through the following procedures before starting business:

(1) Application for starting business. Units and individuals within the urban area and enterprises at or above the city management level within the county and suburbs are engaged in handling and loading, and apply to the municipal transportation agency; Units and individuals under the jurisdiction of counties and suburbs shall apply to the local county and suburban transportation agencies.

(two) for the "handling business license" (hereinafter referred to as the license). The applicant shall submit an application to the competent transportation authority, and fill in the application form with the relevant business materials stipulated in these regulations. The transportation management institution shall, within 30 days from the date of receiving the application, review its application conditions, and issue a license if it meets the conditions.

(3) Apply for business license and tax registration. After applying for a business license from the local administrative department for industry and commerce with a permit, the applicant shall go through the tax registration with the tax authorities and handle the corresponding insurance for employees in accordance with the relevant provisions of the state.

(four) to receive the handling number plate. The applicant shall, with the documents specified in Items (2) and (3) of this article, respectively obtain the handling operation license and operation license of the operators and loading and unloading machinery from the original license-issuing transportation agency, and work in the specified area.

(5) Handling the Business License. The applicant shall, with the documents specified in the second and third paragraphs of this article, apply to the municipal competent price department for the "License for Operating Fees" before charging the handling fee.

Individuals applying for simple handling shall go to the local transportation management agency with the unit certificate, personal identity card, family planning certificate and other documents. Migrant workers who apply for this job should also hold temporary residence permits. Article 8 Where an operator engaged in handling changes its name, business address, business items and business scope, or merges or splits, it shall report to the relevant department of the original registration and examination and approval 30 days in advance, and go through the corresponding formalities. Ninth operators engaged in handling shall go through the formalities with the relevant departments that issue licenses 30 days in advance. Article 10 Operators engaged in handling and loading shall apply to the original license-issuing department 30 days in advance if they close down. After approval, the company must pay all kinds of licenses and recovered bills and settle the transportation management fee before it can close down. Chapter III Operation and Management Article 11 Loading and unloading operators shall operate in accordance with the operation area and scope approved by the transportation management department, and shall not load or unload dangerous goods for unlicensed vehicles or vehicles without the qualification for transporting dangerous goods. Twelfth handling operators engaged in handling business activities across the operation area, should hold the certificate of the transportation agency of the place of origin to go through the formalities with the transportation agency of the place of operation. Thirteenth practitioners engaged in handling should implement the system of holding certificates. Loading and unloading machinery and equipment must be equipped with operation signs in accordance with relevant regulations.
