Provisions of Zhuhai Municipality on the Administration of Small Passenger Ships

Chapter I General Provisions Article 1 In order to strengthen the management of small passenger ships in this Municipality, ensure the safety of people's lives and property, and standardize and maintain the operation order of the waterway passenger transport market, these Provisions are formulated in accordance with the provisions of laws and regulations and the actual situation of this Municipality. Article 2 The term "small passenger ship" as mentioned in these Provisions refers to a ship carrying less than 12 passengers (excluding 12 passengers) engaged in commercial activities such as passenger transport, leisure and sightseeing. Article 3 These Provisions shall apply to small passenger ships within the waters of this Municipality.

These Provisions do not apply to ships that provide water transport services for fishing boats in fishing ports, ships that engage in water entertainment activities in closed non-navigable waters such as parks and scenic spots, and passenger ferries in towns and villages. Article 4 The municipal transportation department is the administrative department of small passenger ships in this Municipality.

Maritime affairs, tourism, public security, marine and fishing port supervision departments shall assist in the management of small passenger ships within their respective functions and duties. Article 5 The municipal transportation department shall follow the principles of openness, justice, fairness and convenience in carrying out the management of small passenger ship industry.

Operators should follow the principles of safety first, honesty and trustworthiness, and fair competition when conducting business activities. Chapter II Business Qualification Article 6 An operator of a small passenger ship shall meet the following conditions:

(1) Having the qualification of an enterprise legal person in People's Republic of China (PRC).

(two) equipped with corresponding communication, life-saving and fire fighting equipment.

(three) reach a docking agreement with the port or terminal operator of the docking station.

(four) there are more than five ships that are suitable for the business scope and meet the provisions of Article 8, and the total number of seats is more than 50.

(5) Having crew members and at least two managers commensurate with the scale of operation.

(six) to set up a special safety production management organization, formulate a perfect safety production management system, including safety production operation rules, safety production responsibility system, safety production supervision and inspection system, employees and ship safety production management system. Article 7 The crew and managers of small passenger ships shall meet the following conditions:

(1) No major water traffic accidents were recorded during the year.

(two) to obtain the qualification certificate issued by the competent department of transportation.

(3) The crew members hold the corresponding certificates of competency issued by the maritime or fishing port supervision departments.

(four) the captain and the operator signed a safety production management contract.

(5) The management personnel have obtained technical secondary school education or above in shipping, navigation, ship or marine engineering and other related majors, or hold competency certificates of not less than the first mate and the second engineer respectively. Article 8 Small passenger ships shall meet the following conditions:

(a) there are garbage collection and pollution prevention facilities that meet the requirements.

(two) in accordance with the provisions of the state on the age, type and noise of the ship.

(3) meeting the technical inspection standards of the ship inspection department and the registration requirements of the maritime or fishing port supervision department. Ninth small passenger ships engaged in business activities shall submit the following materials to the municipal transportation department:

(1) application and commitment.

(2) Articles of association.

(3) A copy of the notice of pre-approval of enterprise name or business license.

(four) the certificate of use of the fixed office space.

(5) enterprise management system or safety management system.

(six) the competency certificate and qualification training certificate of the crew to be hired.

(seven) the ship berthing facilities certificate or letter of intent of port and shipping agreement.

(eight) the qualification training certificate and labor contract of the management personnel.

(nine) the identity certificate and credit certificate of the major shareholder issued by the asset appraisal institution.

(10) The ship to be built shall provide a written description of the type of ship, the number of ships and the number of seats, as well as a ship design drawing or simulation effect drawing. The ship to be purchased, barechartered or existing shall provide a valid ship certificate, as well as a photo of the ship's appearance and cabin. Tenth operators who have obtained the business license of small passenger ships shall provide the following materials when applying for the addition of small passenger ships:

(1) application and commitment.

(two) a copy of the waterway transportation business license.

(3) A copy of the business license of the enterprise as a legal person.

(four) the certificate of competency and qualification training certificate of the crew to be hired.

(five) the certificate of the berthing facilities of the ship or the letter of intent of the port and shipping agreement.

(6) The ship to be built shall provide a written description of the type of ship, the number of ships and the number of seats, as well as a ship design drawing or simulation effect drawing. The ship to be purchased, barechartered or existing shall provide a valid ship certificate, ship appearance and cabin photos. Eleventh city transportation departments shall not accept the application for the operation of small passenger ships, and explain the reasons in writing; If it is accepted, it shall make a decision within 20 days from the date of acceptance; If the license is not granted, the reasons shall be explained in writing.

Operators shall go through the formalities of industrial and commercial registration with the administrative department for industry and commerce with the water transport license. Twelfth operators shall, in accordance with the time and licensing matters determined by the municipal transportation department, implement the personnel and ships to be put into operation. If it meets the requirements after examination by the municipal transportation department, it shall be issued with a Notice of Confirmation of Domestic Shipping Qualification and a Ship Operation Certificate; If it is not implemented within the time limit, its business license shall be cancelled, and the industrial and commercial and tax departments shall be notified to cancel the registration.
