Defendant Ren Moshan, male, born in 1976, Han nationality, primary school culture, farmer. * *, unit * *, building * *, fengzhen city District, Inner Mongolia Autonomous Region, account number. Garden of * * Town, Jinghai District, Tianjin. On August 9th, 20 19, he was criminally detained by Jinghai Branch of Tianjin Public Security Bureau on suspicion of robbery. Jinghai Branch of Tianjin Public Security Bureau investigated the case. The defendant Ren Moushan was suspected of robbery and intentional homicide, and was transferred to our hospital for review and prosecution on September 19, 2009. According to legal review, at about 2 1997 19 on the evening of June, the defendants Ren Moshan and Yan Moumou (sentenced) cheated to rent a red taxi driven by Yue Moumou on the road opposite Jinghai Town Hotel in Jinghai District, and lied that they were looking for someone in Luogezhuang Village, Liangwangzhuang Township, Jinghai District. When the car drove to the side of a brick pile in Luogezhuang Village, Liangwangzhuang Township, Jinghai District, the defendants Ren Moushan and Yan Moumou knocked Yue Moumou unconscious with bricks, tied Yue Moumou's hands behind his back with green rubber ropes, and turned Yue Moumou's cold-proof clothes over to cover his head. They tied Yue Moumou's head and neck with a torn Dafa seat cover, and then put Yue Moumou into the big starting carriage and snatched Yue Moumou's cash 8 10 yuan. When the defendant Ren Moushan drove a cart to the vicinity of Fan Zhuangzi Vegetable Market in Jinghai Town, Yue Moumou was knocked unconscious again after waking up, causing 7 lacerations on his right temporal pillow skin, reaching the aponeurosis of the cap, contusion on his left occipital brain, laceration on his upper lip skin and nasal bone fracture. Later, the defendants Ren Moushan and Yan Moumou pulled Yue Moumou to the west side of Donghe Longgang River Bridge in Xiliumu Village, Liangtou Town, Jinghai District, and threw Yue Moumou in a coma into the river. The two men fled the scene by car robbery. Yue Moumou called for help after falling into the water and was rescued by nearby villagers. It was identified that Yue was slightly (seriously) injured, and the value of the robbed train was RMB 33,000. On August 9, 20 19, the defendant Ren Zhongshan was arrested by the police.

Our court believes that the defendant Ren Moushan colluded with others to rob citizens' property by violent means for the purpose of illegal possession, and after the robbery, he illegally deprived others of their lives and killed them, which violated the provisions of Article 263 of the Criminal Law of People's Republic of China (PRC) and Articles 132 and 22 of the Criminal Law of People's Republic of China (PRC) (1979), and the criminal facts were clear. The defendant Ren Moushan has committed the crime of intentional homicide, but failed for reasons other than his will, which is an attempted crime, and the provisions of Article 20 of the Criminal Law of People's Republic of China (PRC) (1979) shall apply. If the defendant Ren Zhongshan is punished for several crimes, the provisions of Article 64 of the Criminal Law of People's Republic of China (PRC) (1979) shall apply. If the defendant Ren Moushan truthfully confesses the crime, the third paragraph of Article 67 of the Criminal Law of People's Republic of China (PRC) shall apply. According to Article 176 of the Criminal Procedure Law of People's Republic of China (PRC), if a public prosecution is initiated, please be sentenced according to law.
