(5) Paragraph 1 of Article 27 is amended as: "Whoever dismantles or leaves idle noise pollution prevention facilities without the approval of the environmental protection department shall be fined between 1,000 yuan and 50,000 yuan; If the environmental noise exceeds the standard, it shall be ordered to make corrections and be treated within a time limit, and a fine of not less than 5,000 yuan but not more than 30,000 yuan may be imposed. "

The second item is amended as: "Whoever refuses to report or falsely reports the specified environmental noise emission declaration shall be given a warning or fined less than 1 10,000 yuan".

(6) Article 28 is amended as: "Those who violate the provisions of Article 6 and fail to implement the relevant provisions of the state on environmental protection of construction projects shall be investigated and dealt with by the environmental protection department in accordance with the Law of the People's Republic of China on Environmental Impact Assessment and the Regulations on Environmental Protection Management of Construction Projects."

In the no-burn zone, it is forbidden to sell and burn highly polluting fuels; It is forbidden to build or expand facilities burning highly polluting fuels. (3) Article 12 is merged with Article 13 as Article 12 and amended as: "It is forbidden to mine coal containing radioactive substances, arsenic and other toxic and harmful substances exceeding the prescribed standards.

"It is forbidden to import, sell and use coal fuel and petroleum coke that do not meet the requirements, and it is encouraged to burn high-quality coal, clean briquette or other clean fuels.

"The Municipal People's Government may formulate quality standards for raw coal, briquette and other coal-fired fuels according to the air quality and economic development level in its jurisdiction, stipulate the implementation period and scope of the standards, and announce them to the public."

(4) Article 14 is renumbered as Article 13 and amended as: "In urban built-up areas, residents are prohibited from burning raw coal. Encourage residents to burn high-quality coal and clean briquette, and promote energy-saving and environmental protection stoves.

"Units that store coal, coal gangue, coal cinder, coal ash and other materials shall take fire prevention measures to prevent air pollution.

"It is forbidden to sell raw coal to residents in urban built-up areas."

(5) One article is added as Article 14: "Agricultural producers and operators shall, in accordance with the relevant provisions of the state, improve fertilization methods, scientifically and rationally apply chemical fertilizers and pesticides, and reduce the emission of air pollutants such as ammonia and volatile organic compounds.

"It is forbidden to spray highly toxic and toxic pesticides on trees and flowers in densely populated areas."

(6) Article 17 is deleted and one article is added as Article 17: "Enterprises, institutions and other producers and operators that discharge pollutants into the atmosphere shall set up air pollutant discharge outlets in accordance with laws, regulations and the provisions of the competent administrative department of environmental protection of the State Council.

"It is forbidden to evade supervision by stealing, tampering with or forging monitoring data, temporarily stop production for the purpose of evading on-site inspection, open emergency discharge channels in non-emergency situations, and discharge air pollutants by means of abnormal operation of air pollution prevention and control facilities.

"It is forbidden to occupy, damage or move or change the atmospheric environmental quality monitoring facilities and automatic monitoring equipment for atmospheric pollutant discharge without authorization."

(7) Article 18 is amended as: "Unless otherwise stipulated by the state and the province, direct coal-fired, heavy oil, residual oil boilers and boilers directly burning biomass with rated evaporation of less than 20 tons shall not be built in urban built-up areas, development zones and industrial parks."

(8) Article 19 is amended as: "Boilers that do not meet the standards or requirements for environmental protection shall not be produced, imported, sold or used."

(9) Article 24 is amended as: "No unit or individual may barbecue food in the open air or provide a venue for barbecue food in the area prohibited by the local people's government. If an indoor barbecue is approved, there should be smoke and dust removal facilities. "

(10) Article 29 is amended as: "Catering service operators who discharge oil fume shall install oil fume purification facilities and keep them in normal use, or take other oil fume purification measures to make the oil fume discharge reach the standard and prevent pollution to the normal living environment of nearby residents.

"It is forbidden to build, rebuild or expand catering service projects that produce oil smoke, odor and waste gas in residential buildings, commercial and residential buildings and commercial floors adjacent to residential floors in commercial and residential buildings without special flues."

(11) Article 30 is amended as: "Motor vehicles, ships and non-road mobile machinery shall not discharge atmospheric pollutants beyond the standard. It is forbidden to produce, import or sell motor vehicles, boats and non-road mobile machinery with excessive air pollutant emissions.

"It is forbidden for motor vehicle owners to pass the motor vehicle emission inspection by fraudulent means such as temporary replacement of motor vehicle pollution control devices. Motor vehicle maintenance units are prohibited from providing such maintenance services. It is forbidden to destroy the on-board emission diagnosis system of motor vehicles.

"City, district (city) people's government may, according to the quality of atmospheric environment, delimit and publish areas where the use of high-emission non-road mobile machinery is prohibited.

"It is forbidden to produce, import and sell fuels for motor vehicles, boats and non-road mobile machinery that do not meet the standards; It is forbidden to sell ordinary diesel and other non-motor vehicle fuels to automobiles and motorcycles; It is forbidden to sell residual oil and heavy oil to non-road mobile machinery, inland rivers and river-sea direct ships. The content of harmful substances in additives such as engine oil, nitrogen oxide reducing agent, fuel and lubricating oil additives and other atmospheric environmental protection indicators shall meet the requirements of relevant standards, and shall not damage the effect and durability of pollution control devices for motor vehicles and ships, and shall not increase the discharge of new atmospheric pollutants. "

(12) Article 33 is deleted and one article is added as Article 33: "Whoever violates the provisions of these Regulations shall be punished in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and the Regulations of Shandong Province on the Prevention and Control of Air Pollution."
