Provisions of Nanchang Municipality on Reservoir Management
Medium-sized reservoirs as mentioned in these Provisions refer to reservoirs with a storage capacity of100000 cubic meters to100000 cubic meters.
Small reservoirs mentioned in these Provisions include small (1) reservoirs and small (2) reservoirs. Small (1) reservoirs refer to reservoirs with a storage capacity of 1 10,000 cubic meters to 1 10,000 cubic meters; Small (II) reservoirs refer to reservoirs with a storage capacity of 65,438+10,000 cubic meters to 65,438+10,000 cubic meters. Third municipal water administrative departments in charge of the city's reservoir management. County (District) water administrative department in charge of reservoir management within their respective administrative areas. Article 4 Reservoirs shall be managed according to the following division of labor:
(1) State-owned reservoirs are managed by reservoir management units established by competent departments;
(two) small (a) collectively owned reservoirs by the township (town) reservoir management unit management;
(three) small (two) collectively owned reservoirs are managed by villagers' committees, but those that benefit from cross-village are managed by township (town) reservoir management units. Article 5 Reservoir management shall ensure the safety of dam head hub and canal system projects, scientifically dispatch the water storage and discharge, give full play to the benefits of reservoir projects, and reasonably collect water charges. Sixth reservoir management personnel should have the corresponding business knowledge and management level, regularly receive on-the-job training, and show certificates. Chapter II Safety Management of Reservoirs Article 7 State-owned reservoirs shall be reported to the county (district) people's government by the competent department to delimit the scope of management and protection according to the following standards:
(a) medium-sized reservoir dam end extension of 50 meters, downstream dam toe extension 100 to 300 meters, spillways and other drainage structures on both sides 10 to 20 meters for the management scope; The management scope extends from 100 to 500m for protection.
(2) The tail of a small reservoir extends 30 meters, and the downstream dam foot extends 50 to 100 meters; The management scope extends from 50 meters to 200 meters as the protection scope.
(3) Reservoir areas whose management scope is below the check flood level; The protection scope is above the management scope100m to150m or to the river basin.
Collectively owned reservoirs shall be protected by the county (district) people's government with reference to the provisions of the preceding paragraph.
The scope of reservoir management and protection shall be clearly marked. Eighth state-owned reservoirs within the scope of management, land ownership belongs to the state, land use rights belong to the reservoir management unit, no unit or individual may occupy. When delineating the scope of reservoir management, the procedures shall be handled in accordance with the relevant provisions of the land management law.
Within the scope of protection of state-owned reservoirs, the ownership and use right of land remain unchanged, and the use of land is subject to the supervision of reservoir management units. Article 9 Within the scope of reservoir management and protection, blasting, drilling wells, quarrying, mining, dredging, taking soil, burying graves and other activities endangering the safety of reservoirs are prohibited. Tenth reservoir operation should ensure safety.
When storing water in flood season, the reservoir shall make a flood season plan. Comprehensive utilization of the reservoir, its operation must obey the unified command of the city and county (District) flood control headquarters, and no unit or individual may illegally interfere. Eleventh reservoir flood control safety must meet the following flood control standards:
(1) Medium-sized reservoirs generally return once every 50 years, 1000.
(2) Small (1) type reservoirs normally occur once every 30 years, and once every 500 years in exceptional circumstances.
(3) Small (II) reservoirs are normally used once every 20 years, and are very used once every 200 years. Twelfth reservoirs can not meet the flood control standards or have serious quality defects, the reservoir management unit shall formulate a reinforcement plan, and report it to the competent authority for approval. Article 13 Hydrogeological survey and design of reservoir reinforcement shall be undertaken by units with corresponding qualifications; Reservoir reinforcement construction should be undertaken by units with corresponding qualifications through bidding.
The reinforcement of the main buildings at the dam head of medium-sized reservoirs shall be supervised by water conservancy project supervision units with corresponding qualifications, and shall be subject to the quality supervision of the water administrative department. Fourteenth reservoir reinforcement funds, mainly through the following channels to raise:
(a) the county (District) retained funds for flood control and security and water conservancy construction;
(two) special funds for financial arrangements at all levels;
(three) part of the water fee charged by the reservoir management unit;
(four) the special funds allocated by the higher authorities;
(five) the masses to labor. Chapter III Collection and Management of Water Fees Article 15 The reservoir shall be provided with paid water.
Water fee collection standards shall be implemented in accordance with the provisions of the provincial people's government. Sixteenth reservoir management units shall verify the irrigation area of agricultural users in conjunction with the beneficiary townships (towns) and villages, and the irrigation area after verification shall not be changed at will; If it is really necessary to change, it shall be re-approved by the original approving unit. Seventeenth reservoir management units shall register and publish the amount of water fees that users should pay, and report to the county (District) water administrative department for the record.
Reservoir management units can directly collect water charges from water users, and the relevant townships (towns) and villages should cooperate; Can also be entrusted to the township (town), the village collection.
