Notice of the Provincial People's Government on the Issuance of the "Guizhou Province Surveying and Mapping Management Measures"

Chapter 1 General Provisions Article 1 In order to strengthen the management of surveying and mapping work and promote the development of surveying and mapping, in accordance with the "Surveying and Mapping Law of the People's Republic of China" and other relevant laws and regulations, and in combination with the actual situation of our province, we have formulated this method. Article 2 All units and individuals engaged in surveying and mapping activities (except military surveying and mapping) within the administrative region of our province must abide by these Measures. Article 3 The administrative department of surveying and mapping of the Provincial People's Government shall be in charge of the surveying and mapping work of the province. Other relevant departments shall manage the professional surveying and mapping work of their own departments according to the division of responsibilities. Article 4 The main responsibilities of the provincial surveying and mapping administrative departments:

(1) Implement the laws, regulations, guidelines and policies for national surveying and mapping work.

(2) Formulate the province’s surveying and mapping development plan. Work with the provincial land management department and other relevant departments to prepare cadastral surveying and mapping plans, and organize and coordinate cadastral surveying and mapping work according to the plan.

(3) Responsible for the province’s surveying and mapping qualification review and surveying and mapping task registration work.

(4) Work with relevant departments of the Provincial People’s Government to prepare plans for basic surveying and mapping and major surveying and mapping projects in the province and organize their implementation.

(5) Responsible for the supervision and quality management of surveying and mapping technology in the province.

(6) Responsible for the management and supervision of surveying and mapping results in the province.

(7) Organize and manage the surveying and mapping work of the province’s administrative regional boundaries. Review the basic geographical information data of our province and submit it to the Provincial People's Government for approval and release.

(8) Responsible for the compilation and publication of survey marks, maps, and place name management on maps throughout the province.

(9) Centrally manage provincial-level foreign surveying, mapping, science and technology and economic cooperation and exchanges. Article 5 Surveying and mapping shall use the surveying and mapping benchmarks and standards prescribed by the state. Article 6: No unit or individual may hinder or obstruct the staff of the surveying and mapping department from performing official duties in accordance with the law and the surveying and mapping personnel from conducting surveying and mapping activities in accordance with the law. Chapter 2 Surveying and Mapping Management Article 7 Implement the surveying and mapping qualification review system. All units and economic organizations engaged in surveying and mapping activities must obtain surveying and mapping qualifications before they can carry out surveying and mapping activities within the prescribed business scope. The review of surveying and mapping qualifications shall, after preliminary review by the regional administrative department for surveying and mapping work, be reported to the provincial surveying and mapping administrative department for approval and a "Surveying and Mapping Qualification Certificate" will be issued. Applications for Class A qualifications shall be reviewed by the provincial surveying and mapping administrative department and then reported to the surveying and mapping administrative department of the State Council for approval.

Surveying and mapping units affiliated to other relevant departments of the provincial government shall undertake surveying and mapping tasks within the business scope of their own departments. The competent departments of the units shall conduct surveying and mapping qualification examinations and report to the provincial surveying and mapping administrative department for record. Article 8: Implement a surveying and mapping task registration system. All units and economic organizations that undertake surveying and mapping tasks must register their tasks with the local department responsible for surveying and mapping work before conducting surveys.

For surveying and mapping tasks within the scope of national and provincial basic (or professional) surveying and mapping plans, the department that prepares the surveying and mapping plan shall notify the department that manages the surveying and mapping work where the surveying and mapping project is located before the survey is carried out, and the task registration may no longer be carried out.

Surveying and mapping units from other provinces come to our province to conduct surveying and mapping activities, and military surveying and mapping units conduct civilian surveying and mapping activities. They must register with the provincial surveying and mapping administrative department before conducting surveys. Article 9 Units and economic organizations that undertake surveying and mapping tasks must hold a "Surveying and Mapping Qualification Certificate." If it is an enterprise, it should apply for a "Business License"; if it is an institution, it should apply for a "Charging License" and charge according to the charging standards prescribed by the state. Article 10: No unit or individual may use the following unfair competition methods:

(1) Use the name of other surveying and mapping units to undertake surveying and mapping tasks.

(2) Using bribery to undertake surveying and mapping tasks.

(3) Undertake surveying and mapping tasks at a lower cost for the purpose of squeezing out competitors.

(4) Damage the professional reputation of competitors.

(5) Tenderers collude with each other and disrupt fair competition.

(6) Infringement of competitors’ trade secrets.

(7) Other unfair competition methods. Article 11 No unit or individual may forge, alter, lend, transfer or lease the "Surveying and Mapping Qualification Certificate" and "Business License". To change the unit name, business scope, etc., you must apply for change procedures to the provincial surveying and mapping administrative department and the industrial and commercial administrative department.

To terminate the surveying and mapping business, you must go through the cancellation procedures with the issuing unit. Article 12 When a surveying and mapping unit submits its annual surveying and mapping production plan and statistical annual report to the competent department, a copy shall be submitted to the provincial surveying and mapping administrative department.

Article 13: Surveying and mapping projects above the following quotas shall be managed by the provincial surveying and mapping administrative department.

(1) Mapping limit

(3) Major provincial surveying and mapping projects.

(4) Compile and publish various general maps and atlases across the province.

Surveying and mapping projects below the quota are managed by the prefecture, state (city) surveying and mapping management departments. Article 14 Units within the province that conduct aerial photography for the purpose of mapping or remote sensing (including military units performing civilian tasks) must submit plans in advance to the provincial surveying and mapping administrative department in accordance with national regulations, and implement unified centralized management of civil aerial photography plans. Article 15 The surveying and mapping work for the boundaries of administrative areas above the township (town) level in this province shall be coordinated and implemented by the provincial surveying and mapping administrative department in conjunction with the civil affairs department.

The ownership boundary lines of land, buildings, structures and other attachments on the ground shall be surveyed and mapped according to the ownership boundary lines determined by the local people's government at or above the county level or the entrusted township (town) people's government.
