Regulations on Supervision of Construction Projects in Shenzhen Special Economic Zone (revised 20 19)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of the Construction Law of People's Republic of China (PRC) and other relevant laws and administrative regulations and in combination with the reality of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone) in order to standardize the supervision activities of construction projects, improve the project management level and investment efficiency, and ensure the project quality and construction safety. Article 2 These Regulations shall apply to the supervision activities in the construction stage and warranty stage of construction projects.

The term "construction supervision" as mentioned in these Regulations refers to the supervision unit entrusted by the construction unit to supervise and manage the implementation of the project construction in accordance with the provisions of laws, regulations and rules concerning the project construction. Article 3 The municipal housing and construction department (hereinafter referred to as the municipal competent department) is the competent department in charge of supervision, and shall supervise and manage the supervision activities.

The district housing and construction department (hereinafter referred to as the district competent department) shall, under the guidance of the municipal competent department, supervise and manage the supervision activities within its administrative area in accordance with its duties and powers.

Municipal transportation, water affairs and other relevant departments shall, in accordance with their respective responsibilities, supervise and manage the supervision activities of related professional construction projects. Article 4 Supervision units and supervisors shall follow the principles of independence, objectivity, scientificity, impartiality and good faith, and strictly perform their supervision duties. Article 5 Shenzhen Association of Supervision Engineers is an industry self-discipline organization composed of supervision units and registered supervision engineers. Under the guidance of the municipal competent department, responsible for formulating industry regulations, qualification verification, training and examination, and carrying out activities in accordance with its articles of association.

Supervision units and registered supervision engineers registered in the Special Zone shall join the Municipal Association of Supervision Engineers and become members. Chapter II Scope and Contents of Supervision Article 6 Supervision shall be implemented in the construction stage and warranty stage of the following construction projects:

(a) construction projects with a total investment of more than 3 million yuan;

(2) Construction projects involving public safety such as bridges, underpasses, gas pipelines, boilers, pressure vessels and pressure pipelines with a total investment of less than 3 million yuan;

(three) other construction projects that should be supervised by the state. Article 7 Supervision includes the following contents:

(a) the legality of the construction project;

(2) Engineering quality;

(3) Construction safety and civilized construction;

(4) construction period;

(five) the use of construction funds, etc. Article 8 The main responsibilities of supervision in the construction stage are:

(a) review the commencement report prepared by the contractor, check the planning, planning permission, bidding, project quality supervision, construction safety supervision and construction permission of the construction project, review the qualifications of the contractor and its employees, and urge the project construction to be carried out according to law;

(2) Confirm the subcontractors selected by the contractor;

(3) Organizing the joint review of construction drawings;

(four) review the contractor's construction organization design, construction technical scheme, construction schedule, construction quality assurance system and construction safety assurance system;

(five) to urge and inspect the contractors to strictly implement the project contract and the national mandatory technical standards;

(six) check the quantity and quality of materials, components and equipment provided by the contractor or the construction unit;

(seven) control the progress, quality and investment of the project, and urge the contractor to implement the construction safety guarantee measures;

(eight) the organization division, subdivisional work and concealed engineering inspection and acceptance;

(nine) responsible for the construction site visa, deal with other matters of engineering change;

(10) Issue the payment voucher for the project;

(eleven) to urge the contractor to sort out the contract documents and technical files;

(twelve) to organize the preliminary acceptance of the project completion;

(thirteen) to urge the construction project to complete the acceptance and filing procedures. Article 9 The main responsibilities of supervision during the warranty period are:

(a) Urge the contractor to pay a return visit;

(two) to participate in the quality responsibility identification;

(three) to supervise the project warranty until it reaches the prescribed quality standards. Chapter III Supervision Units and Supervision Practitioners Article 10 Units and individuals engaged in supervision activities shall obtain corresponding engineering supervision qualifications and engage in supervision activities within the scope permitted by their qualifications. Eleventh supervision units are registered supervision engineer's practice institutions, and can take the form of enterprise legal person, partnership and other organizations.

The application for the qualification of supervision unit shall be handled by the municipal competent department in accordance with the relevant provisions of the state. Article 12 The qualification grades of supervision units are divided into three grades: A, B and C, and graded examination and approval shall be implemented in accordance with state regulations. Thirteenth non city supervision units in the special zone to undertake supervision business, shall go through the registration formalities with the municipal competent department. The specific measures shall be formulated by the municipal competent department. Fourteenth registered supervision engineer refers to the person who has obtained the "Practice Certificate of People's Republic of China (PRC) Registered Supervision Engineer" and the practice seal issued by the competent department of housing and urban and rural construction in the State Council, and is engaged in construction project supervision and related services.

Unregistered personnel shall not engage in supervision activities in the name of registered supervision engineer.

Supervisors who have passed the examination of the Municipal Association of Supervision Engineers and obtained supervision post certificates may assist registered supervision engineers in supervision activities. Fifteenth registered supervision engineer shall not practice in more than two supervision units at the same time.
