Chapter I General Provisions Article 1 In order to promote the development of the technology market, standardize the management of the technology market, maintain the order of the technology market and safeguard the legitimate rights and interests of the parties involved in technology trade, these Measures are formulated in accordance with the Decision of the Central Committee of the Communist Party of China and the State Council on Strengthening Technological Innovation and Developing High-tech to Realize Industrialization. Regulations of Gansu Province on the Administration of Technology Market and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 All citizens, legal persons and other organizations engaged in technology trade within the administrative area of this Municipality shall abide by these Measures. Article 3 The term "technology market" as mentioned in these Measures refers to various technology trading places and activities where technology buyers, sellers and intermediaries legally operate and fairly trade technology commodities. Article 4 All business activities such as technology development, technology transfer, technical service, technical consultation, technical training, technology intermediary, technology shareholding and so on that comply with laws, regulations, rules and policies shall be brought into the technology market management. Technologies prohibited by laws, regulations and rules or endangering public interests shall not enter the technology market. Technologies involving national security or vital interests that need to be kept confidential shall be implemented in accordance with relevant state regulations. Article 5 People's governments at all levels shall incorporate the construction of technology market into the national economic and social development plan.

People's governments at all levels shall support and encourage units and individuals to invest in the construction of technology trading places and protect the legitimate rights and interests of investors. Sixth people's governments at all levels should actively support and encourage scientific research institutions and scientific and technological personnel to set up technical intermediary service institutions and enter the technology market.

People's governments at all levels shall actively support and guide all kinds of technical innovation service institutions, technical evaluation institutions, technical brokerage institutions and other technical intermediary institutions to provide good services for accelerating the transfer and transformation of scientific and technological achievements. Article 7 The municipal administrative department of science and technology is the administrative department in charge of technology market management in this Municipality.

The technology market management office of the municipal administrative department of science and technology (hereinafter referred to as the technology market office) is responsible for the management of the technology market.

The county and district administrative departments of science and technology are specifically responsible for the daily management of the technology market in their respective jurisdictions, and are subject to the supervision and guidance of the technology market office in business.

The administrative departments for industry and commerce at all levels shall supervise and manage the technology market according to law. Eighth administrative departments of science and technology should actively cultivate and support the development of technology brokers.

The Technology Market Office shall strengthen the management of all kinds of technical trade intermediary activities of technical brokers, and conduct training and assessment for the main employees of technical brokers and technical intermediary institutions and other relevant personnel engaged in technical trade activities according to the development and actual needs of the technology market. Ninth technology market can gradually establish a membership system.

Units and individuals entering the technology market for technology trade may set up self-regulatory organizations for technology trade.

The technical market office is responsible for the specific management of the establishment of the technical market membership system. Chapter II Management of Technology Trade Article 10 Technology trade refers to various business activities aimed at promoting the commercialization of technological achievements.

Technology trade should follow the principles of voluntariness, equality, mutual benefit and compensation, honesty and credibility. Article 11 Those engaged in technology trade may set up technology trade institutions.

To apply for the establishment of a technical trade organization, the following conditions shall be met:

(1) Having a name that meets the requirements;

(2) Having a clear business direction and a business scope that conforms to the provisions of laws, regulations and rules;

(3) Having a fixed business place and necessary technical facilities and conditions;

(4) Having professional and technical personnel suitable for the business scope;

(5) Having registered capital that meets the requirements of the state and is suitable for its business scope;

(six) other relevant conditions stipulated by the state. Twelfth the establishment of technology trading institutions, shall apply to the administrative department of science and technology; The establishment of technical trade institutions in special industries stipulated by laws, regulations and rules shall be approved by the competent department of the industry first.

The administrative department of science and technology shall make a written reply within ten days from the date of receiving the application. After examination and approval, a technical trade certificate will be issued; If it is not approved, it shall explain the reasons.

Those who have obtained the technical trade certificate issued by the administrative department of science and technology shall apply to the administrative department for industry and commerce for registration before conducting business activities.

Institutions of higher learning, scientific research institutes and other organizations and individuals that have established technical trade institutions and engaged in technical trade activities before the implementation of these Measures shall, within 90 days from the date of promulgation of these Measures, go through the relevant formalities in accordance with the provisions of these Measures. Thirteenth technology trading institutions established after examination and approval enjoy the preferential policies of the state and local governments in the technology market.

Technical intermediary service institutions, which mainly provide public services to the society, can be operated and managed as non-profit organizations after being identified. The technical market office is responsible for the appraisal. Article 14 The merger, division, cancellation or change of registered items of technical trade institutions shall be handled in accordance with the original examination and approval, registration and registration procedures. Article 15 It is forbidden to forge, resell or lend technical trade certificates. Sixteenth technology trade institutions and citizens can charge service fees for technology intermediary activities, and the specific amount shall be agreed by the parties to technology trade.

Technical trade institutions and citizens engaged in technical intermediary activities have the responsibility of keeping confidential the technical achievements of the parties concerned, and may not disclose or transfer the technical secrets of the parties concerned in their own names.
