Article 1 These Measures are formulated in accordance with the relevant provisions of the Regulations of People's Republic of China (PRC) Municipality on the Administration of Inland River Traffic Safety, with a view to strengthening the collection of port charges for ships on the Yangtze River (hereinafter referred to as port charges for ships) and maintaining the management of water traffic safety. Article 2 All vessels entering and leaving the Yangtze River trunk ports engaged in domestic route transportation and operation shall pay port fees in accordance with these Measures. Article 3 The Jianggang Navigation Supervision Bureau, the Minister of Communications, and the vessel port dues collection agency established by it (hereinafter referred to as the collection agency) are specifically responsible for the collection of vessel port dues within their respective jurisdictions. Article 4 As extra-budgetary funds, the ship and port fees shall be managed in accordance with the Decision of the State Council on Strengthening the Management of Extra-budgetary Funds (Guo Fa [1996] No.29), and it is strictly forbidden for any unit or individual to intercept, finance or misappropriate them. Article 5 Every time a ship enters or exits a port, a port charge of 0.55 yuan per net ton (horsepower) shall be levied on the imported or exported ships respectively. Article 6 The port charges of ships shall be collected by net tonnage (gross tonnage without net tonnage, deadweight tonnage without deadweight tonnage, and deadweight tonnage of 500 tons) or horsepower, and those less than 1 ton or 1 horsepower shall be collected by 1 ton or 1 horsepower.

Non-motorized ships are charged according to the net tonnage of the ship; Motorized boats are charged according to the net tonnage or horsepower of the ship, whichever is greater; Towing barge fleet is charged according to the net tonnage of barges. Article 7 Passenger ships and passenger and cargo ships calling at midway ports shall be taxed at the prescribed tax rate of 1/30 of the net tonnage of the ship; Cargo ships (including barge fleets) calling at midway ports shall be taxed at the prescribed tax rate according to the tonnage of cargo loaded and unloaded or the number of containers (including empty containers) (20 tons for 40-foot TEUs and 20-foot TEUs 10 tons).

Engineering ships engaged in water operations and underwater construction operations shall be taxed at the prescribed rates each time they enter and leave the port. Mud barge and harrow suction ship shall enter and leave the port once every 30 days (30 days is counted as less than 30 days), and shall be taxed at the prescribed tax rate.

Sand dredgers, cars and train ferries shall enter and leave the port once every three days (if less than three days, they shall be counted as three days), and shall be taxed at the prescribed tax rate. Article 8 The following vessels shall be exempted from port charges:

(1) Ships engaged in national defense, public security, fire protection, customs, water administration, flood control, emergency rescue, surveying, hydrology, quarantine, medical treatment, environmental protection, scientific investigation, sports activities, waterway regulation and maintenance of the Yangtze River trunk line, and port operation ships that do not enter or leave the port;

(2) Refuge, distress and rescue of ships;

(3) Refurbishment without refurbishing (except refurbishment);

(four) inland passenger ferries operating within the jurisdiction of the city (town).

If a ship exempted from port charges as stipulated in the preceding paragraph changes its use and engages in inter-port business, it shall also pay port charges. Article 9 When a ship enters or exits a port, it shall pay the port fee in one lump sum according to the prescribed standards.

The collection agency may agree with the ship owner or operator on the payment method, or implement fixed lump sum collection and sign a payment agreement.

The collection agency may entrust the relevant units to collect the port fees of ships and sign a collection agreement. Article 10 When collecting fees, the collection department must use the special bills for administrative fees uniformly issued by the Ministry of Finance in accordance with the provisions of the state. The specific measures shall be formulated separately by the Ministry of Finance in consultation with the Ministry of Communications. Article 11 Ships must be inspected by the collection agency, and actively provide and report the evidence and materials related to the payment of port fees, such as the name of the ship, quantity, tonnage (power), port of destination, port of call, tonnage of loading and unloading goods or increase or decrease of containers. Article 12 For those who violate these measures and fail to pay the port fees within the time limit, the collection agency shall, in addition to the recovery, charge a late fee of 5‰ of the port fees payable on a daily basis from the day after settlement.

For those who pay or refuse to pay port fees in violation of regulations, the collection agency has the right to recover and refuse to go through the formalities for the departure of the ship, and will be punished according to the Regulations of People's Republic of China (PRC) on the Administration of Inland River Traffic Safety. Article 13 If a payer refuses to accept the decision on administrative punishment made by the tax collection organ, he may apply for reconsideration according to law or bring a lawsuit directly to the people's court. If the payer neither applies for reconsideration nor complies with the decision on administrative punishment within the statutory time limit, the collection agency may enforce it or apply to the people's court for enforcement according to the provisions of the Regulations of People's Republic of China (PRC) Municipality on Administrative Penalties for Violation of Traffic Safety. Fourteenth siege, insult, beating the parties and the main person in charge of the collection personnel who perform official duties, in violation of the provisions of public security management, shall be dealt with by the public security department according to law; Those who violate the criminal law shall be investigated for criminal responsibility according to law. Fifteenth tax collectors in performing official duties, should take the initiative to produce the "Yangtze River Port and Shipping Supervision Bureau Ship Port Fee Collection Certificate" issued by the Ministry of Communications, so as to enforce the law in a civilized manner and be polite to others. Article 16 The Yangtze River trunk ports mentioned in these Measures refer to Chongqing, Fuling, Wanxian, Badong, Yichang, Zhicheng, Jingsha, Jianli, Chenglingji, Honghu, Wuhan, Huangshi, Wuxue, Jiujiang, Anqing, Chizhou, Tongling, Wuhu, Maanshan, Nanjing, Zhenjiang, Gaogang, Jiangyin, Zhangjiagang, Nantong Port and Article 17, which enter and leave the Yangtze River. Among them, the port fee for tourist ships in yangtze river international is only charged once every time they enter and leave the port.
