Interim Measures of Xiamen Municipality on the Administration of Automobile Maintenance Industry

Chapter I Management Organization and Responsibilities Article 1 The Xiamen Municipal, county and district transportation bureaus shall establish and improve the management organization of the automobile maintenance industry according to the tasks of their respective regions and the principle of industry management and streamlining, and be responsible for the cleaning, rectification and management of the automobile maintenance industry.

On behalf of Xiamen Transportation Bureau, Xiamen Automobile Maintenance Management Office is responsible for the rectification and management of Xiamen automobile maintenance industry.

The responsibilities of the management organization are:

First, responsible for cleaning up, rectifying and managing the automobile maintenance industry in the region. Conscientiously implement the party's principles and policies and the relevant provisions of the government, adhere to the principle of "planning, coordination, service and supervision", support diversified operations of the whole people, collectives and individuals, promote horizontal integration of industries, take the road of specialized production, and make all kinds of automobile maintenance industries develop in a coordinated way.

Two, to undertake the examination and approval of the national, collective and individual automobile maintenance industry in the whole region, and to formulate and issue the License for Automobile Maintenance and the Technical Certificate for Maintenance Workers.

Three, organize the professional technical training and technical level assessment of automobile maintenance workers, and do a good job in the exchange of maintenance technology, accessories and information.

Four, responsible for arbitration and handling disputes between the repair unit and the repaired unit about maintenance quality and price. Chapter II Scope of Administration of Automobile Maintenance Industry Article 2 All enterprises engaged in automobile maintenance, maintenance or special repair within their respective jurisdictions, whether they are citizens, collectives, individuals or consortia (hereinafter referred to as automobile maintenance industry operators), are within the scope of administration of these Interim Measures. Auto repair shops, workshops and teams within the enterprise, who are engaged in foreign auto repair business, also belong to the management scope of these measures.

The technical conditions for the opening of automobile maintenance enterprises and individual maintenance households should be formulated according to the classification of business projects, and the main types can be divided into the following four categories:

1. Automobile overhaul, assembly overhaul and automobile modification enterprises.

Two, senior automobile maintenance (three-level maintenance) enterprises.

Three, automobile low-level maintenance (primary and secondary maintenance and minor repairs) enterprises.

4. Special auto repair (refers to the enterprises that specialize in auto glass repair, auto body repair, painting, electrical equipment, storage batteries, tarpaulins and cushions, water tanks, oil tanks, tire repair, auto high-pressure oil pumps, auto air conditioners, heaters, motorcycles, tractors and other repairs. Chapter III Application and Management of Opening and Closing of Automobile Maintenance Enterprises Article 3 Any unit applying for automobile maintenance business shall, with the approval of the competent department, report to the local transportation department (the first-class enterprise shall be examined and approved by Xiamen Municipal Bureau of Transportation) with the certificate issued by the neighborhood office or the township people's government where the household registration is located, and then issue a business license to the local administration for industry and commerce and the tax bureau with the certificate. For tax registration, enterprises and self-employed individuals that have already started business should be cleaned up and rectified in accordance with the provisions of these Interim Measures. Those who pass the examination shall verify their business scope according to their technical conditions, issue automobile maintenance licenses, and be re-approved and registered by the administrative department for industry and commerce. Unqualified to suspend production for rectification within a time limit. If it is still unqualified after rectification, its business license shall be revoked by the administrative department for industry and commerce, and it shall not continue to operate. Article 4 When the operator of the automobile maintenance industry changes the maintenance items and business locations, it shall report to the local transportation department for examination and approval, and then go through the change registration with the local administration for industry and commerce and the tax bureau. Article 5 An applicant who applies for suspension of business shall submit an application report to the local transportation department one month ago. After approval, he shall hand in his automobile maintenance license, be responsible for clearing up his creditor's rights and debts, and go through the formalities of cancellation of registration, cancellation of bank account and payment of management fees and taxes payable at the Administration for Industry and Commerce and the Tax Bureau in accordance with relevant regulations. Article 6 Those who have not obtained the automobile maintenance license, the technical certificate of maintenance workers and the business license shall not engage in the automobile maintenance business. Beyond the scope of approved maintenance projects without authorization, it shall be handled in accordance with relevant regulations. Chapter IV Operating Conditions of Automobile Maintenance Operators Article 7 Maintenance of workshops and parking spaces

First, automobile overhaul, assembly overhaul, automobile modification enterprises, the main operating plant area should be not less than 200 square meters.

Two, senior automobile maintenance enterprises, the main plant area of not less than 80 square meters.

Three, low-level automobile maintenance enterprises, mainly engaged in plant area of not less than 50 square meters.

Four, automobile special maintenance enterprises, the main plant area is set according to actual needs.

Five, shunting and parking places, low-level maintenance enterprises should be not less than 60 square meters. Specialized enterprises can operate as long as they have suitable parking lots.

Six, there must be spare parts warehouse or facilities.

Seven, are not allowed to work in the open air, are not allowed to occupy streets, roads and public places parking for maintenance work. Article 8 Maintenance technicians are equipped.

First-class enterprises: automobile overhaul, assembly overhaul and automobile modification enterprises, with at least 1 engineer (or assistant engineer or technician) in this major. Small enterprises (annual overhaul 10 or less) must have at least technicians who have been engaged in the front-line work of automobile maintenance technology 15 years or engaged in automobile maintenance technology 10 years and have technical secondary school education or above. There must be full-time inspection technicians (including test drivers who have been driving safely for more than two years and have a formal driver's license), and the types of work must be complete. Among them, there should be six automobile mechanics, six automobile electricians, five painters and four carpenters.

Second-class enterprises: automobile advanced maintenance enterprises, with at least 1 person of technicians who have been engaged in this professional technical work for at least 1 person or have been engaged in this professional technical work for at least 5 years and have technical secondary school education or above, at least 1 person of repairman, sheet metal worker 1 person, electrician1person, and other types of work must be equipped accordingly.

Three types of enterprises: automobile low-level maintenance enterprises, at least 1 5 repairmen, and other types of work must also be equipped accordingly.

Four types of enterprises: automobile special maintenance enterprises, simple technology (tires, tarpaulins, cushions, fuel tanks, installation of automobile glass, batteries, etc. ) Must have at least 1 worker in this major, with complicated technology (automobile body, painting, high-pressure pump, electrical appliances, water tank, air conditioner, heater, etc. ) must be equipped with maintenance technicians and senior technicians according to regulations.

The title of engineering technicians and the technical level of workers must be evaluated or recognized by the competent department, and the level of self-employed technicians must be certified by the competent department of the original work unit (national and collective enterprises) or the labor bureau. Those who engage in automobile maintenance after short-term study in the form of apprentices must be assessed and graded by the local transportation authorities and issued with technical grade certificates. Among them, the requirement of being promoted to senior engineer (above level 5) must be approved by a special group organized by the Provincial Department of Transportation.

The above-mentioned personnel must be approved by the local transportation authorities and issued with the "Technical Certificate of Automobile Maintenance Workers" before undertaking maintenance business, but they may not be employed by two or more enterprises at the same time.
