Regulations of Jinan Municipality on the Protection of Famous Springs (revised on 20 17)

Chapter I General Provisions Article 1 In order to strengthen the protection of famous springs, maintain a complete ecological system of famous springs, highlight the features of famous springs and historical and cultural cities, and promote sustainable economic and social development, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection of spring recharge areas, gathering exposed areas, famous spring pools, spring canals and their cultural landscapes within the administrative area of this Municipality. Article 3 The Municipal People's Government shall set up a famous spring protection committee, which shall be responsible for organizing and leading the protection of famous springs in this Municipality, and coordinating, studying and solving major problems in the protection of famous springs.

The Municipal Bureau of Landscaping and Greening is the competent department in charge of the protection of famous springs in this Municipality, and is responsible for the unified management and supervision of the protection of famous springs within the administrative area of this Municipality.

The relevant county (District) people's government shall determine a department responsible for the protection and management of famous springs within its jurisdiction.

Development and reform, urban and rural planning, land and resources, environmental protection, water conservancy, forestry, agriculture, meteorology, public security, urban management and law enforcement, urban and rural construction, municipal utilities, hydrology, tourism, cultural relics, civil affairs and other relevant departments shall do a good job in the protection of famous springs according to their respective responsibilities.

The town (street office) where the famous spring is located shall do a good job in the protection of the famous spring according to the requirements of the county (District) people's government. Article 4 The municipal and relevant county (district) people's governments shall incorporate the protection of famous springs into the national economic and social development plan, increase financial input, arrange special funds for the protection of famous springs in the fiscal budget at the same level, and establish an ecological compensation mechanism for the protection of famous springs. Fifth city construction and development should adhere to the priority of spring city protection and highlight the characteristics of spring city.

The protection of famous springs should strengthen the protection of springs, implement scientific protection of springs, keep springs spewing, ensure the quality of springs, give consideration to the rational use of springs, and combine with the promotion of spring culture. Article 6 All units and individuals have the obligation to protect famous springs and have the right to put forward opinions and suggestions on the protection of famous springs.

The municipal department in charge of the protection of famous springs shall establish a system of public participation in the protection of famous springs, unblock the channels of public participation, publish relevant information on the protection of famous springs according to law, and promptly accept the opinions and suggestions put forward by the public on the protection of famous springs. Seventh city and county (District) people's governments and relevant departments should strengthen scientific research on the protection of famous springs, organize publicity and education activities on the protection of famous springs, popularize the knowledge of the protection of famous springs, and raise the public's awareness of the protection of famous springs. Chapter II Planning Article 8 The city and relevant counties (districts) shall formulate plans for the protection of famous springs. The protection planning of famous springs is divided into the overall protection planning of famous springs and the detailed protection planning of the top ten springs.

The municipal department in charge of the protection of famous springs shall, jointly with the municipal department in charge of urban and rural planning, prepare the overall plan for the protection of famous springs and the detailed plan for the protection of Baotu Spring Group, Pearl Spring Group, Black Tiger Spring Group, Wulongtan Spring Group and Baiquan Group, which shall be promulgated and implemented after being reported to the Municipal People's Government for approval.

Zhangqiu District, Licheng District, Changqing District and Pingyin County People's governments shall, according to the master plan for the protection of famous springs, respectively organize the preparation of detailed plans for the protection of Baimaiquan Group, Yongquan Group, Yuhe Spring Group, Zuquan Group and Hongfan Chiquan Group within their respective jurisdictions, which shall be audited by the municipal famous spring protection department and the municipal urban and rural planning department and promulgated for implementation after being approved by the Municipal People's government. Article 9 The main contents of the master plan for the protection of famous springs include: the recharge area of famous springs, the direct recharge area within the recharge area, the key leakage area, the collection and exposure area, the protection scope of rivers and rivers in the recharge area and the collection and exposure area, the forbidden and restricted construction areas within the direct recharge area, the evaluation of famous springs resources, the environmental impact assessment of famous springs, and the protection objectives and measures of famous springs. Article 10 The Municipal People's Government shall organize the relevant departments to delimit the direct recharge area of spring water, the key leakage area, the ecological control red line of spring water recharge area and the river system of exposed area, delimit the forbidden construction area and restricted construction area of direct recharge area, determine the scope of protection, put forward control requirements, and incorporate them into the overall plan for the protection of famous springs. Eleventh famous spring protection planning should be linked with the overall urban planning, land use planning, ecological environment protection planning, water resources comprehensive planning, and coordinated with forestry, agriculture, meteorology, tourism, hydrology, cultural relics and other planning. Article 12 When compiling the protection plan for famous springs, the compiling organ shall solicit opinions from relevant departments, experts and the public extensively, make overall planning and scientific compilation, and attach the adoption of opinions and reasons in the materials submitted for examination and approval.

Before the famous spring protection plan is submitted for approval, the organization organ shall publicize it to the public for not less than 30 days. Thirteenth after the announcement of the spring protection plan, no unit or individual may change it without authorization. If it is really necessary to make changes, the original organization shall announce the contents and reasons for the changes according to law, listen to public opinions, inform interested parties of their right to apply for a hearing, organize expert argumentation, determine the change plan, and report it to the Municipal People's Government for approval before promulgation and implementation. Article 14 The regional scope and the master plan for the protection of famous springs as stipulated in Article 10 of these regulations, namely, "delineating the direct recharge area of spring water, the key leakage area, the ecological control red line of spring water recharge area and the exposed mountain and river system, delineating the direct recharge area, the forbidden construction area and the restricted construction area", shall be promulgated and implemented at the same time as these regulations.
