Article 1 Model contract for production workshop

Party A: Party B:

In order to better manage the production workshop, improve production efficiency, improve the quality of finished products and improve product utilization. Through consultation between Party A and Party B, it is decided that the production workshop will be contracted by Party B. In order to clarify the rights and obligations of both parties, this contract is hereby concluded.

I. Contract Scheme:

Party A will contract all the factories owned by Party A to Party B to process them for Party A. During the contract period: ① Party A will provide the site, equipment and production line, and all expenses such as materials, equipment, electricity and water will be paid by Party A. (2) Party B will only bear the wages of workers, equipment maintenance expenses and equipment accessories expenses.

Two. Party A's responsibilities:

1. Party A has the right to carry out various administrative management on Party B's hygiene and safety. Smoking is prohibited in the workshop to avoid fire. In case of factory accidents and personal injuries, all economic losses shall be borne by Party B, and Party A shall not be responsible.

2. Party A has the right to supervise Party B's production environment and labor protection. If Party B is found to have violated the rules, Party A has the right to terminate the contract or give economic sanctions.

3. Party A assigned the production task to Party B a week ago, and Party B should complete the production task with good quality and quantity on time according to Party A's requirements. Party A has the right to impose economic penalties on Party B for delaying the delivery, and deduct 30,000 yuan from Party B for every delay that affects the production speed, and all expenses arising from Party A's delay shall be borne by Party B. ..

Three. Party B's responsibilities:

1. Party B is responsible for production management and production operation (monitoring and testing, pumping out of eight warehouses of building materials and products, production operation of product workshop, production operation of oxidized asphalt workshop, production operation of asphalt granulation workshop and operation of heat conduction oil furnace).

2. Party B is responsible for implementing the quota of production operators.

3. In production and operation, Party B must obey the management of Party A, complete the production tasks assigned by Party A on time, and carry out production according to Party A's various rules and regulations. ..

4. Party B is responsible for regularly maintaining the equipment and facilities provided by Party A, and should report the abnormal situation of the equipment as soon as possible. Party B shall be responsible for the equipment damage caused by Party B's operational mistakes.

5. During the contract period, Party B shall not subcontract the plant to others.

6. For the personal safety of Party B's staff, Party B shall be responsible for any personal injury or death. Party A is not responsible.

Four. Obligations of Party A:

1. Provide plant, equipment and supporting facilities.

2. Provide materials, water, electricity, office supplies, dormitory, canteen equipment, tools and labor insurance supplies. (If Party B damages the above items, it shall be borne by Party B).

3. Party A is responsible for the sales of all kinds of products, and Party B cooperates with the sales of products. If the production is stopped due to the procurement of opaque solid raw materials and product sales, special circumstances shall be discussed separately.

4. Party A must provide Party B with correct and effective raw material warehousing statements and monthly inventory records every time.

VII. Term of the Contract

The term of the contract is one year, counting from the date of signing.

VIII. Price and Scheme of Contract Products

3. Party B produces qualified products and creates profits.

4. Every ton of raw materials produced and processed is calculated as one ton of 20 yuan, and the downstream products of oxidized asphalt and asphalt granulation are calculated as one ton of 35 yuan.

5. If Party A stops production or the output is less than 20xx tons, the processing fee shall be calculated as 1500 tons (except for special reasons such as insufficient power supply and natural disasters).

Nine. Settlement and payment methods

1. Settlement method: After Party B submits the production report of the current month to Party A for accounting, Party A's finance department can make settlement only after checking it correctly.

2. Payment time: the handling fee of the current month will be paid to the account designated by Party B on 20 10/February 15. The second month 10. (If it is a weekend, it will be postponed to working hours)

3. Cooperation security deposit: When the processing fee is paid, 10% of the processing fee of the current month is deducted as the cooperation security deposit, which is paid once every six months.

X. Other matters

1. In case of contract dispute, both parties shall bring a lawsuit at the place where Party A's factory is located.

2. Matters not covered shall be settled by both parties through consultation.

3. This contract is made in duplicate, one for each party, with the same legal effect, and shall be implemented as of the date of signing.

5. Party B shall not change the performance and use of the plant, equipment and facilities. If it is really changed due to production needs, it shall be reported to Party A in writing for approval before it can be modified, but the expenses shall be borne by itself.

6. Upon the expiration of the contract, the plant, equipment and facilities must be kept in their original state, and the losses or losses shall be fully compensated by Party B according to the actual value at the time of handover. (See Annex 1 for the list of equipment)

7. Party B must accept Party A's weekly equipment maintenance and safety inspection.

Eight. Party B shall strengthen employee management in accordance with Party A's labor management system and China's Labor Contract Law. In addition, all accidents such as work-related injuries of Party B's workers shall be solved by Party B itself, which has nothing to do with Party A. ..

Nine. Party B shall bear all expenses required for the labor protection of employees. (See Annex 2 for details of the labor contract)

X. Party B may recruit or dismiss employees on its own according to the production situation, and shall file with Party A for the record and go through relevant procedures. When recruiting employees, Party B must do a good job in factory registration and relevant knowledge training, but shall not employ employees from other departments or workshops of Party A or employees dismissed or handled by Party A. The recruitment of old employees must be approved by Party A. The dismissal of employees must be implemented in accordance with Party A's labor management system and fault (negligence) accountability system to avoid labor disputes.

Eleven, employees must abide by the factory rules, law-abiding, saving water and electricity, unity and friendship, love each other's good fashion, proficient in technology, technology, to achieve quality and quantity to complete the task, to contribute to the factory and society.

12. If any employee of Party B violates the regulations and laws of the factory, Party A can immediately expel him from the factory and send him to the administrative department for handling.

Thirteen, in the normal production of the factory, if there is any dispute or illegal behavior between Party A and Party B, both parties should coordinate to solve it. If it cannot be solved, it shall be submitted to the administrative department for solution.

14. In the production process, Party B must cooperate with the production progress made by Party A, deliver the goods on time, and never pick orders without authorization. If the goods cannot be delivered in time, Party B shall be responsible for the losses caused.

15. In the production process, if Party A and Party B disagree or are thoughtless, both parties can * * * negotiate with each other to solve it. Where there are imperfections, we can refer to the effective labor contract law to solve them.

16. This contract shall come into effect as of the date of signature by both parties.
