What constitutes sexual harassment?

Sexual assault generally refers to all kinds of sexual acts against the will of others. Including rape and sexual harassment, can be regarded as a kind of sexual assault, such as nudity and voyeurism. This word is generally used to refer to rape, but it can also refer to forced anal sex, forced oral sex, indecent assault and sexual abuse.

The following acts constitute sexual harassment:

1. Oral way: tease each other in the following languages and tell their personal sexual experiences, pornographic jokes or pornographic literature;

2. Action mode: intentionally touching, bumping and kissing the other person's face, breasts, legs, buttocks, genitals and other sexually sensitive parts;

3. Setting environment: namely, arranging obscene pictures, advertisements, etc. Embarrass each other in or around the workplace.

The Criminal Law has the following penalties for sexual assault:

1. Constitution of the crime of compulsory molestation of women and children: the act of harming women's shame and violating the normal sexual order by violence, coercion or other means against women (who have reached 14 years of age), including direct molestation of women, forcing women to commit or force them to watch other people's indecent acts (molesting children is an aggravating circumstance), and the minimum legal penalty is fixed-term imprisonment of not more than five years or

2. The crime of rape, that is, by violence, coercion or other means against the will of women, constitutes an illegal sexual relationship. The statutory minimum penalty is fixed-term imprisonment of more than 3 years 10 years, and the statutory maximum penalty is fixed-term imprisonment of more than 10 years, life imprisonment or death penalty. China has no legislation on sexual harassment. According to the principle of legality, sexual harassment does not constitute a crime. In addition, China's current criminal law has deleted the crime of hooliganism and replaced it with the crime of compulsory molestation of women and children.
